BEIITG AN EMERGENCY ORDINANCE TO REGULATE THE INSTALLATION
STORAGE TRANSPORTATION HANDLING AND USE OF LIQUEFIED
PETROLEUM GASES fi ND GAS BURNING APPLIANCES WITHII` THE
CORPORATE LIMITS OF THE CITY OF FORT COLLINS, AND FIXING
PENALTIES FOR VIOLATION THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 Right of Entry Any duly qualified
city employee authorized to make inspections shall have the
right to enter any public or private building or premises
during any reasonable hour, in the discharge of his dutues
Section 2 Permits It shall be unlawful for any
person firm or corporation to do any work on any gas main
lines equipment, system or appliance without taking out a
license in the city of Fort Collins Colorado, and securing
a permit from the City Building Inspector provided however
that no permit is required for adjusting or testing appliances
already installed under permit
Section 3 Certificate of Inspection Upon
completion of the installing of any pipe line, storage tank,
system, utilization equipment or appliance, it shall be the
duty of the person firm, or corporation doing the work to
notify the City Building Inspector that the work is ready
for inspection The City Inspector upon making and completing
the inspection in compliance with thisKordinance, shall issue
a certificate approving the work done
Section 4 Definition The term, liquefied petroleum
gas shall mean and include any of the Hydrocarbon gases such
as otharo propane, propylene butanes isobutane normal
butane or mixtures thereof or mixtures of these and any other
gases
Section 5 Odor In order to facilitate the
quick detection of leaks all liquefied gas shall be
odorized by an agent of such nature as to positively indicate
by its odor the presence of gas
Section 6 Systems, Appliances, Equipment and
Storage (a) The Underwriter's Label (UL) and the A G A
American Gas Association stamp of approval are indicative
of the approval for liquefied gas service but final approval
of all systems appliances equipment, storage containers
and installations rests in the State Department of Public
Health
(b) The rated input capacity of gas appliances is
based on barometric pressure at sea level This rating must
be reduced 5% for each 1 000 feet above sea level
(c) All containers used in liquefied gas service
shall be constructed inspected and marked in shops licensed
to construct Unfired Pressure Vessels by the American Society
of Mechanical Engineers the Interstate Commerce Commission,
or tested, inspected, approved and marked by inspectors authorized
to make pressure vessel inspection by the State Department
of Public Health
(d) All equipment appliances systems, or con-
tainers shall be marked with a brass plate attached or die
stamped as follows
Name and address of the manufacturer
With the working pressure in pounds per square
inch for which the system appliance, equipment
or container is designed to operate
With the water capacity in pounds or gallops
With the statement "This container or system shall
not be filled with a product having a vapor
pressure in excess of pounds per square
inch at 1000 F " I C C will be stamped in
accordance with the Interstate Commerce require-
ments

Section 7 Location of Containers
(a) Containers and first stage regulation shall
be located outside of buildings not especially provided for
that purpose
(b) Each container shall be located with respect
to buildings and property lines as follows
Water Opacity Minimum Distance to nearest
of Container Building or Property Line
Above Ground Tanks Underground Tank:
Less than 125 gallons any distance 10 feet
125 to 499 gallons 10 feet 10 feet
500 to 1199 gallons 25 feet 25 feet
1200 and over 50 feet 50 feet
(c) Any deviation from those requirements must be
covered by special permission of the City Council
(d) No container shall be installed which holds in
excess of 30 000 gallons, U S Standard
(e) All containers holding in excess of 29 gallons
shall be provided with concrete or masonry saddles or pads
whether underground or above ground type
(f) Above ground containers shall be finished and
maintained with a reflecting surface equivalent to aluminum or
white paint
(g) Underground containers shall have the manufacturer' s
label accessable at all tames so that the approved working
pressure is available for delivery purposes
Section 8 Vapor Pressure Marketers and users
shall use every precaution to assure that only those gases for
which the system and containers have been designed listed
tested and approved are employed in their operation
PARTICULARLY WITH RESPECT TO PRESSURE
Section 9 Filling or Transfer of Products
Transfer of liquefied gas in the city limits shall comply with
the following requirements

(a) Truck wheels shall be blocked to prevent move-
ment
(b) Operator shall satisfy himself that there are
no open fires within 50 feet or any other hazards to the
transfer of product
(c) Operator shall check the receiving tank as to
its suitability for the product he is about to deliver so that
the approved working pressure will not be exceeded
(d) Operator shall connect the tanks involved in
the transfer of product with a suitable bonding cable
(e) Operator may then connect hoses and proceed with
the transfer of product, if found free from leaks
(f) After transfer of the requisite amount has been
completed the operator will check the container to assure
himself that the liquid content will not completely fill the
tank at 1300 F above ground and at 1050 F for underground
In case excess is found it must be reduced to a safe amount before
the operator leaves the premises I
(g) After checking the liquid content and assuring
himself that no other hazards have been introduced he may
proceed to disconnect hoses bonding cables and remove the
blocks
(h) No transfer on city streets, alleys or vacant
lots shall be made without the special approval of the Fire
Department
Section 10 Venting or Bleeding The release of
liquid or vapor through gauges outage indicators or in any
other manner to reduce pressures as an aid in transfer of
product is forbidden under all circumstances
Section 11 Transportation and Delivery
(a) Only tanks or containers constructed in shops
licensed to construct Unfired Pressure Vessels by the ASME and

API-ASME Code and ICC and which are designed constructed
tested and approved and a certificate of inspection issued
to cover each unit as complying under the code for trans-
portation purposes may be used in the city limits
(b) The parking of any tank truck swing tank
or transport unit in use in liquefied delivery service on
any street alley public thoroughfare or vacant lot except
the time necessary to actually make delivery or parking
within 150 feet of any building except in areas specifically
set aside by the fire enforcing agency, is expressly forbidden
(c) The delivery of all liquefied products shall
be made during daylight hours in the event this is impractical
special arrangements must be made with the city fire department,
for each nighttime delivery
(d) No transportation or delivery unit shall be
permitted in the liquefied gas service which is not provided
with anc uses a bonding cable and drag chain
Section 12 Piping Valves and Accessories
(a) All piping valves fittings and accessories
shall be designed for the use of liquefied petroleum gas
or tested and approved as satisfactory by the State Department
of Public Health
(b) Piping valves, and fittings shall be suitable
for a pressure of 250 pounds
(c) The use of cast iron valves or fittings is
expressly forbidden
(d) Only rigid metallic pipe or pipe connections
shall be permitted
(e) In any aystem in which gas in liquid form
enters a building only heavy walled seamless brass or copper
tubing may be used An internal diameter greater than 3/32
inch and a wall thickness of less than 3/64 inch will not be

permitted Provided this requirement will not apply to
commercial gas plants, industrial vaporizer buildings or
in plants set aside for petroleum products
(f) All threaded joints must be set up in a dope
or paste which is insoluble in liquefied petroleum gas,
gasoline or water

(g) All installations shall be inspected and tested
for leaks They must maintain a pressure of not less than 30
pounds for a period of 30 minutes In event the system is to
carry pressures in excess of 25 pounds the system must be
tested at a pressure of one and one-half times its operating
pressure for a period of at least 30 minutes without a loss
in pressure
Section 13 Open Fires, Lights and Switches No
open fire, electric light, or open electrical switch may be permitted
within 50 feet of any transfer of liquefied gas Electric
lights rust be vapor proof and switches carry the UL as
satisfactory for explosive gases
Section 14 Venting All water heaters bathroom
and bedroom appliances shall be fully vented or adjusted so
that the maximum B T U input to the appliance shall not exceed
15 B T U per cubic foot of space or an area of 48 square inches
must be provided with a wind cap and a downdraft diverter
Section 15 Penalty Any person firm or
corporation violating any of the provisions of this ordinance
shall upon conviction, be fined in any sum not in excess of
$300 00 nor less than $5 00
Section 16 Repeal of Existing Ordinances All
ordinances and existing clauses of ordinances conflicting with
the provisions of this ordinance are hereby repealed The

invalidity of any section paragraph sentence or clause
of this ordinance shall not affect the validity of any
section, or clause which can be given effect without such
invalid part
Section 17 Responsibility or Liability This
ordinance shall not be construed to relieve from or lessen
the responsibility or liability of any party owning con-
trolling, or installing any liquefied petroleum gas or other
flammable gas systems from damages to persons or property
caused by any defect therein nor shall the city be held as
assuming any liability by reason of the inspection authorized
herein
Section 18 Emergency In the opinion of the City
Council an emergency exists for the preservation of the public
health peace and safety, and this ordinance shall take effect
upon its passage, under and by virtue of the authority contained
in Sections 6 and 7 of Article IV of the City Charter
Introduced read at length and adopted by the un-
animous vote of all the members of the City Council at a
regular meeting held this 8th day of May A D 1947

said Ordinance consisting of eighteen sections, was duly
proposed and read at length at a regular meeting of the City
Council held on the 8th day of May, A D 1947 and
was duly adopted and ordered published in the Fort Collins
Coloradoan a daily newspaper and official newspaper of
the City of Fort Collins by the unanimous vote of all
members of the City Council, as an Emergency Ordinance, in
accordance with the provisions of Sections 6 and 7 of
Article IV of the City Charter and thereafter and on to-wit
the 13thday of May A D 1947 said Ordinance
No 7 was duly published in the Fort Collins Coloradoan
a daily newspaper published in the City of Fort Collins Colorado
IN WITNESS WHEREOF I have hereunto set my hand and
