BEING AN ORDINANCE AMENDING CHAPTER 47 OF THE
CODE OF THE CITY OF FORT COLLINS BY ADOPTING
AN ELECTRICAL CODE AND PROVIDING FOR THE
PROTECTION OF THE PUBLIC HEALTH AND SAFETY
IN RELATING TO THE REGULATION OF PERSONS
-ENGAGED IN THE BUSINESS OF ELECTRICAL WIRING,
PERSONS LABORING AS ELECTRICIANS,
THE INSTALLATION, ALTERATION OR REPAIR OF
ELECTRICAL WIRING, AND THE INSPECTION THEREOF,
IN THE CITY OF FORT COLLINS AND ADOPTING BY
REFERENCE THE NATIONAL _ELECTRICAL CODE, 1981
EDITION, PROMULGATED BY THE NATIONAL FIRE
PROTECTION ASSOCIATION, IN PROVIDING PENALTIES
FOR THE VIOLATION THEREOF .
.BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1 . That Section 47-1 of the Code of the City of Fort Collins
be, and the same hereby is, repealed and re-enacted to read as follows:
§47-1 . Adoption of National Electrical Code.
Pursuant to the authority conferred by Section 7, Article
II, of the Charter of the City of Fort Collins and the laws of
the State of Colorado, there is hereby adopted by the City of
Fort Collins for the purpose of providing for the protection of
the public health and safety and for the purpose of regulating
persons engaged in the business of electrical wiring, or persons
-laboring as electricians, or for the purpose of regulating the
installation, alteration or repair of electrical wiring systems
in the City of Fort Collins, Colorado, that certain Code known as
the National Electrical Code, 1981 Edition, promulgated by the
National Fire Protection Association and the whole thereof,
including the introduction, tables and examples , index and
appendix thereto, of which code not less than .three (3) copies
have been and now are filed in the office of the Clerk of the
City of Fort Collins and may be inspected at regular business
hours or purchased by the public at a price not to exceed the
actual cost of the same to the City of Fort Collins, and such
code is hereby adopted and incorporated as fully as if set forth
at length herein and from the date on which this ordinance shall
take effect, the provisions thereof shall be controlling within
the limits of the City of Fort Collins, Colorado.
Section 2. That Section 42-7 of the Code of .the City of Fort Collins
be, and the same . hereby is, repealed and re-enacted to read as follows:
§47-2. Amendments and Additions to Code.
The following articles, sections, divisions, sub-sections,
-appendices, or parts thereof of the National Electrial Code are
hereby amended, except as noted, to read as follows:
Article 100. Definitions. (ADD.ITIONS)
(A) . General
Garden Level : A floor level below the first story in a
's route Occupancy, as defined in the. Uniform Building
Code, where the upper surface of the floor directly
above is more than 35 inches above grade for 50% of the
total perimeter of the structure.
Habitable Space: A .room or space . in .a. structure for
wing, seeping, eating or cooking, and shall include
kitchen, family room, dining room, and living room.
Unfinished garden levels shall be considered habitable
space.
r Section 210-52 . Dwelling Unit Receptacle Outlets .
a. General Provisions.
In every habitable space of dwelling units, recep-
tacle outlets shall be installed so that no point
` along the floor line in any wall space is more than
six . (6) feet, measured horizontally, from an outlet
in that space, including any wall space two (2) feet
or more in width and the wall space occupied by
sliding panels in exterior walls. The wall space
afforded by fixed room dividers, such as free
standing bar-type counters, shall be included in the
six (6) foot measurement.
Section 3. That Section 47-3 (Use of Approved Materials; Electrical
Signs.) of the Code of the City of Fort Collins, be, and the same herby is,
amended by deleting the words and figures "National Electrical Code, 1978,"
and by inserting the words and figures "National Electrical Code, 1981
Edition".
Section 4. Violations and Penalties.
The National Electrical Code, 1981 Edition, as adopted by this ordi-
nance does not contain a separate penalty provision. Section 1-23 of the
Code of the City of Fort Collins provides as follows:
Section 1=23. General- Penalty for Violations. .
-Any person, firm or corporation who shall violate
any provision of the Code, or any provision of any code
or other regulation adopted by reference by this Code,
by doing any act prohibited or declared to be unlawful
thereby, or who shall engage in or exercise any busi-
ness or occupation or doing anything for which a
license or permit is required, without having a valid
license or permit therefore as required, or who shall
fail to do any act required by any such provision, or
who shall fail to do any act when such provisions
declare such failure to be unlawful or to be an offense
or misdemeanor and, upon conviction, shall be punished
by a fine not exceeding $300 or by imprisonment not to
exceed 90 days, or by both such fine and imprisonment,
in addition to the collection of any costs which may be
. .provided for, unless a specific penalty. is provided for
a particular misdemeanor. Each day upon which any
violation shall continue shall constitute a separate
misdemeanor unless some other specific time period is
provided for any particular violation.
Section 5. Severability.
The Council hereby declares that should any section, paragraph,
sentence, word or other portion of this ordinance or the Code hereby
adopted be declared invalid for any reason, such invalidity shall not
affect any other portion of this. . ordinance or said Code, and . the City
Council hereby declares that we have passed all other portions of this
ordinance and adopted all other portions of said Code, independent of the
elimination herefrom of any such portion which may be declared invalid.
