BEING AN EMERGENCY ORDINANCE PROVIDING FOR THE SUBMISSION TO
A VOTE OF THE DULY QUALIFIED TAXPAYING ELECTORS OF THE CITY
OF FORT COLLINS, AT THE GENERAL ELECTION OF A CITY COMMISSIONER
TO BE HELD IN SAID CITY ON TUESDAY, THE 5TH DAY OF APRIL, A D
19381 THE QUESTION OF AUTHORIZING THE CITY COUNCIL OF SAID CITY
TO CONTRACT AN INDEBTEDNESS ON BEHALF OF THE CITY, AND-UPON THE
CREDIT THEREOF, BY ISSUING THE NEGOTIABLE COUPON BONDS OF THE
CITY IN AN AGGREGATE PRINCIPAL AMOUNT NOT EXCEEDING $2003,000,009
FOR THE PURPOSE OF ACQUIRING A SEWAGE DISPOSAL PLANT' TOGETHER
WITH ALL NECESS&RY APPURTENANCES FOR THE CITY. _
WHEREAS, in the opinion of the City Council
of the City of Fort Collins, provision should now be made to
rise funds for ^the purpose of acquiring a sewage disposal
plant, together with necessary lands , rights of way, sewer
mains and appurtenances for the treatment of the sewage of the
City of Fort Collins, which plant complete as herein described
is hereinafter referred to as a sewage disposal plant , and
WHEREAS, the City of Fort Collins is unable
to provide Rinds for a sewage disposal plant out of its
current revenues , and
WHEREAS, in the opinion of the City Council
of said City, an indebtedness should be contracted on behalf
of the City and upon the credit thereof, by issuing the
negotiable interest bearing bonds of the City, for the purpose
of acquiring a sewage disposal plant.
NOW THMMFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF FORT COLLINS
Section 1. That at-the general election of
a City Commissioner to be held in the City of Fort Collins
on Tuesday, the 5th day of April, A D. 1938, the question
of authorizing the City Council of s4Aid City to contract an
indebtedness on behalf of the City and upon the credit thereof,
by issuing the negotiable interest bearing bonds of the City
in an aggregate amount not exceeding $200 ,000.009 for the

purpose of acquiring a sewage disposal plant for the City,
be and the same is hereby submitted to a vote of such qualified
electors of the City as shall in the year next preceding said
election have paid a property tax therein, for their determina-
tion.
Section 2 The question so submitted shall be
voted on at said election by the voters qualified as aforesaid,
at the several precincts of said City as hereinafter set forth
in the notice of the election.
Section 3. The voting shall be by ballot of
the form hereinafter provided, and said election shall be in
all respects, as nearly as may be, held and conducted in the
manner prescribed by law and the charter of the City of Fort
Collins in cases of elections for City Commissioners.
Section 4. The ballots to be used in voting
upon the question submitted shall be prepared and furnished
by the City Clerk to the Judges of election, to be by them
furnished to the voters, and shall be in the following printed
form, and shall be deposited in a separate ballot box provided
by the City Clerk for such purpose.

=RUCTIONS TO VOTERS-- A voter wishing to
vote in favor of the a'doptionrof-the question submitted, shall
place a cross (X) mark in the space opposite the words "For

a Sewage Disposal Plant." A voter wishing to vote against
the adoption of the question submitted, shall place a cross
(%) mark in the space opposite the words "Against a Sewage
Disposal Plant " If you wrongly mark, tear or deface this
ballot, return it to the Judge of election and obtain another.
When your ballot has been properly marked, deposit it in the
separate ballot box provided for such purpose.

A vote in favor of the question submitted will
authorize the City Council to issue negotiable interest bearing
bonds of the City, not to exceed $200,000.00 principal, at such
rate of interest as is determined by the City Council and the
proceeds to be used for acquiring a sewage disposal plant,
together with necessary lands, rights of way, sewer mains and
appurtenances for the treatment of the sewage of the City of
Fort Collins.
A vote against the question submitted means
that the voter does not wish the City to issue the above bonds
Section 5 No ballots for or against said
question shall-be received by the Budges unless the person
offering the same shall be a qualified elector of the City of
Fort Collins, and shall in the year next preceding said election,
have paid a property tax therein.
Section 6 The Judges who shall act at the
general municipal election in said City are hereby appointed
as Judges of said election upon the question so submitted.

Section 7 The vote at said election on the
question aforesaid shall be canvassed and returned, and the
return made and the result declared in the same manner, as
nearly as may be, as provided by the charter of the City of
Fort Collins for the canvass, return and declaring of the
result of the votes cast at an election of a City Commissioner,
Section 8. A notice of the time and place of
said election shall be published in the Fort Collins Express-
Courier, a daily newspaper and the official newspaper-of the
City of Fort Collins, at least fifteen days before such election,
and also a copy of such notice shall be posted at the place of
voting in each precinct, at least fifteen days before such
election, announcing the time, place and object of the election,
which notice may be included in and made a part of the general
election notice of said election, and the Clerk of the City of
Fort Collins is hereby charged with the duty of effectuating
this provision. Said notice shall be in substantially the
following form

NOTICE IS HgRERY GIVEN that pursuant to the
provisions of Section 1 of Article XIV of the Charter of the
City of Fort Collins, a general election will be held in the
several precincts and wards within the corporate limits of said
City, on the 5th day of April, A D 1938, for the purpose of
electing one Commissioner of Highways, Public Works and Utilities
and ex-officio Mayor pro-tempore to serve for a period of six
(6) years from the first Tuesday after the second Monday of
April, 1938, and that said election will be held at the follow-
ing places in said City, to-wit

Precinct 1, Ward 1, City Hall
Precinct 19 Ward 21 218 West Mountain Avenue
Precinct 2, Ward 21 LaPorte Avenue School,
Precinct 11 Ward 39 Court House ,
Precinct 2, Ward 31 Junior High School,
Precinct 30 Ward 31 Washington School,
Precinct 1, Ward 4, First Christian Church,
Precinct 21 Ward 4, Bethlehem Evangelical Lutheran
Church, 300 Whedbee Street
Precinct 1, Ward 5, State Armory,
Precinct 2, Ward 50 Lincoln School.
And also, pursuant to Ordinance No. 3 of
the City of Fort Collins , Colorado, adopted and approved on the
5th day of^ March A D. 1938, public notice is
hereby given that at the aforesaid election of a City Commissioner
of the City of Fort Collins, to be held in said City on Tuesday,
the 5th day of April, 1938, there will be submitted to a vote of
such qualified electors of the City of Fort Collins as shall,
in the year next preceding said election, have paid a property
tax therein, the following question

The question above submitted will be voted upon
during the hours and at the voting places in the several precincts
and wards of said City hereinbefore designated as the time and
places of voting at the said regular election for municipal
officers
The ballots to be used in voting upon the question
above submitted, will be furnished to the voters by the Judges
of Election, to be deposited in a separate ballot box which will
be provided for that purpose
(Inserted in the above notice will be notice of
the election of a Commissioner of Works for the six (6) year
term and certain provisions thereof Also notice of all other
matters to be voted upon by the electors at said election )
The polls for said general election shall be
opened at the hour of seven o'clock A M and shall remain
open continually and be closed at seven o'clock P M of said
day, and said election shall be conducted in the manner prescribed
by the City Charter and the law of the State of Colorado appli-
cable thereto

Section 9 In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety, and this Ordinance shall take effect upon its
passage under and by virtue^of the authority contained in Sections
6 and 7 of Article IV of the City Charter

the unanimous vote of all members of the City Council at a
regular adjourned meeting, held this 5th day of March, .A D

City of Fort Collins , do hereby certify and declare that the
foregoing Ordinance, consisting of nine (9) sections, was duly
proposed and read at length at a regular adjourned meeting of
the City Council, held on the 5th day of March, A D 1938,
and was duly adopted and ordered published in the Mountain and
Plains Weekly, a weekly newspaper and an official newspaper of
the City of Fort Collins, by the unanimous vote of all members
of the City Council, as an emergency ordinance , in accordance
with the provisions of Sections 6 and 7 of Article IV of the
City Charter, and thereafter and on to-wit the 11th day of
March, A D 1938, said Ordinance No 3 was duly published
in the Mountain and Plains Weekly, a weekly newspaper published
in the City of Fort Collins, Colorado
