CREATING AND ESTABLISHING A BOARID OF TRUSTEES OF THE POLICE-
IMN'S PENSION FUND, DEFINING ITS DUTIES AND POWERS, AUTHORIZING
THE ADOPTION OF RULES AND REGUL4TIONS FOR THE Z,%NAGEu3IvT AND
DISCHARGE OF ITS DUTIES, MKING ITS ACTIONS FINAL AND CONCLU-
SIVE AND DECLARING AN EMERGENCY.
VOIEREAS, the City of Fort Collins maintains a
regularly organized and paid Police Department , employing
full time paid policemen and by virtue thereof is entitled
to the benefits of the policemen' s pension fund as provided
by law.
THEREFORE, BE IT ORDAINED BY THE CITY COUIMIL
OF THE CITY OF FORT COLLINS:
Section 1. There is hereby created and established

a Board of Trustees of the policemen' s pension fund of the
City of Fort Collins and said Board shall consist of the
Commissioner of Safety and Ex-Officio MLyor, the Commissioner
of Finance and Ex-Officio City Treasurer, the City Clerk and
one member of the Police Department , who shall be elected by
that Department , and said Trustees shall elect from their
number a President and Secretary; said Trustees shall serve
without pay.
Section 2. The Board of Trustees shall control,
manage , administer and apply the policemen' s pension fund in
accordance with the Laws of the State of Colorado, Ordinances
of the City of Fort Collins and the rules and regulations
adopted by it.
Section 3. The Commissioner of Finance and
Ex-Officio City Treasurer is hereby made the custodian of
all the pension funds and the moneys belonging thereto, he
shall be liable on his bond as such Commissioner of Finance

and $x-Officio City Treasurer for the faithful performance
of all the duties imposed upon him under this Ordinance , the
laws of the State of Colorado in relation to the policemen' s
pension fund and the rules and regulations of the Board of
Trustees, and for the faithful accounting of all moneys and
securities which may come into his hands belonging thereto,
and he shall keep a separate account thereof, which shall at
all times show the true condition of such fund and upon the
expiration of his term of office he shall surrender and
deliver to his successor all bonds and all unexpended moneys
or other property which may have come into his hands as
Treasurer of said fund.
Section 4. Immediately upon the adoption of
this Ordinance, the Board of Trustees shall meet and organize
and adopt all necessary rules and regulations for the managing
and discharge of its duties, not inconsistent with the laws of
the State of Colorado.
Section 5. The Board of Trustees shall hear
and decide all applicatiorisfor relief or pensions and its
action on such applications shall be final and conclusive,
except that when in Its opinion justice demands that said
action should be reconsidered, the same may be reversed by
said Board and a record of said action and all other matters
coming properly before said Board shall be kept and preserved.
Section 6. In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety, and this Ordinance shall take effect upon
its passage under and by virtue of the authority contained in
Sections 6 and 7 of Article IV of the City Charter.

foregoing Ordinance , consisting of six (6) sections, was duly
proposed and read at length at a regular adjourned meeting of
the City Council, held on the 23rd day of May , A. D.
1938) and was duly adopted and ordered published in the ISountain
and Plains Weekly, a weekly newspaper and an official newspaper
of the City of Fort Collins , by the unanimous vote of all members
of the City Council, as an emergency ordinance , in accordance
with the provisions of Sections 6 and 7 of >rticle IV of the
City Charter and thereafter and on to-wit : the 27th day of
May , A. D. 1938, said Ordinance No. 7 , 1938, was duly
published in the Mountain and Plains Weekly, a weekly newspaper
published in the City of Fort Collins , Colorado.
IN WITNESS' WHEREOF, I have hereunto set
