BEING AN EMERGENCY ORDINANCE CONFIRMING AND
RATIFYING THE MANNER OF PUBLICATION OF THE
NOTICE TO CONTRACTORS FOR CONSOLIDATED
IMPROVEMENT DISTRICT NO 40 AND CONSOLIDATED
IMPROVEMENT DISTRICT NO 41 OF THE CITY OF
FORT COLLINS, AUTHORIZING THE ISSUANCE AND
SALE BY SAID CITY OF ITS SPECIAL IMPROVEMENT
BONDS IN THE NAME OF CONSOLIDATED IMPROVEMENT
DISTRICT NO 403, IN THE AGGREGATE PRINCIPAL
AMOUNT OF $5,500 00, AUTHORIZING THE ISSUANCE
AND SALE BY SAID CITY OF ITS SPECIAL IMPROVE-
MENT BONDS IN THE NAME OF CONSOLIDATED IMPROVE-
MENT DISTRICT NO 41, IN THE AGGREGATE PRIN-
CIPAL AMOUNT OF $8,000 002 AND PRESCRIBING
THE DETAILS THEREFOR
WHEREAS, by due and proper proceedings taken pur-
suant to Ordinance No 7 of 1921, the City of Fort Collins
did provide for the establishment of and did establish two
improvement districts, to-wit, Consolidated Improvement District
No 40, and Consolidated Improvement District No 41, and
WHEREAS, Ordinance No 7 of 1921, Ordinance No 2
of 1936, establishing Consolidated Improvement District No 40,
and Ordinance No 8 of 1936, establishing Consolidated Improve-
ment District No 41, all provided that the notice to advise
contractors that the city would receive bids for the con-
struction of the improvements therein provided for, should be
published for not less than ten (10) days in the official
newspaper of said city, and
WHEREAS, said notice relating to Consolidated Improve-
ment District No 40 was published in three issues of the
Fort Collins Express Courier, to-wit, March 26, 1936, April 1,
1936, and April 3, 1936, and
WHEREAS, said notice relating to Consolidated Improve-
ment District No 41 was published in three issues of the
Fort Collins Express Courier, to-wit, April 20, 1936, April
22, 1936, and April 24, 1936, and
WHEREAS, Ordinance No 2 of 1936 provided for the
issuance of bonds by the City of Fort Collins in the name
of Consolidated Improvement District No 40 and prescribed
the form of said bonds, but failed to designate the date of
said bonds, their denominations, their aggregate principal
amount, their numbers and the dates upon which the interest
on said bonds would be paid; and
WHEREAS, Ordinance No 8 of 1936 provided for the
issuance of bonds by the City of Fort Collins in the name
of Consolidated Improvement District No 41 and prescribed
the form of said bonds, but failed to designate the date of
said bonds, their denominations, their aggregate principal
amount, their numbers and the dates upon which the interest
on said bonds would be paid:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF FORT COLLINS:
1 That the action of the Commissioner of Safety
and ex-officio Mayor, in causing the Notice to Contractors
relative to the construction of improvements in Consolidated
Improvement District No 40 to be published in the Fort Collins
Express Courier on March 26, 1936, April 1, 1936, and April 3,
1936, be and the same hereby is confirmed and ratified and
declared of and to have the same force and effect as though
said publication was made in full conformity with the ordi-
nances of said city in such cases made and provided
2 That the action of the Commissioner of Safety
and ex-officio Mayor, in causing the Notice to Contractors
relative to the construction of improvements in Consolidated
Improvement District No 41 to be published in the Fort Collins

Express Courier on April 20, 1936, April 22, 1936, and April
24, 1936, be and the same hereby is confirmed and ratified and
declared of and to have the same force and effect as though
said publication was made in full conformity with the ordi-
nances of said city in such cases made and provided
3 That pursuant to Ordinance No 2 of 1936, the
City of Fort Collins shall issue its special assessment bonds
in the name of Consolidated Improvement District No 40, in the
aggregate principal amount of $5,500 00, bearing date September
11 1936, and bearing interest at the rate of five and three-
quarters per centum per annum, payable semi-annually on the
first day of March and the first day of September in each
year Said bonds shall be in the denomination of $500 00 each
and shall be numbered consecutively from one to eleven, both
inclusive
4 That pursuant to Ordinance No 8 of 1936, the
City of Fort Collins shall issue its special assessment bonds
in the name of Consolidated Improvement District No 41, in the
aggregate principal amount of $8,000 00, bearing date September
11 1936, and bearing interest at the rate of five and three-
quarters per centum per annum, payable semi-annually on the
first day of March and the first day of September in each year
Said bonds shall be in the denomination of $500 00 each and
shall be numbered consecutively from one to sixteen, both
inclusive
5 Anything in any other ordinance of this city to
the contrary notwithstanding, any of the bonds hereinabove
provided for may be sold by the City Council at public or private
sale, with or without prior advertisement, and upon such terms

and conditions as to it seem advisable, provided, however,
that such bonds shall not be sold at less than par plus
accrued interest
6 In the opinion of the City Council an emergency
exists for the preservation of the public health, peace and
safety, and this ordinance shall take effect on its passage
and publication under and by virtue of the authority contained
in Sections 6 and 7 of Article IV of the city charter
Introduced, read at length and adopted by the
unanimous vote of all the members of the City Council, this
11th day of December, 1936

City of Fort Collins do hereby certify and declare that the
foregoing Ordinance consisting of six (6) sections was du13
proposed and read at length at a regular meeting of the City
Council, held on the llth day of December , A D 1936 , and was
duly adopted ana ordered published in the Fort Collins Express-
Courier , a daily newspaper and the official newspaper of the
City of Fort Collins by the unanimous vote of all members of
the City Council as an emergency ordinance , in accoraance with
the provisions of Sections 6 and 7 of Article IV of the City
Charter, and thereafter and on to-vit the 15th day of
December A D 1936 said Ordinance No 18 was duly
published in The Fort Collins Express-Courier a daily news-
paper published in the City of Fort Collins Colorado
