HomeMy WebLinkAbout011 - 03/21/1963 - ANNEXING PROPERTY KNOWN AS THE MAXWELLS FIRST ANNEXATION ORDINANCE NO 1963 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE MAXWELL'S FIRST ANNEXATION TO THE CITY OF FORT COLLINS COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS- DICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139 COLORADO REVISED STATUTES 1953 WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11 Chapter 139 Colorado Revised Statutes by the owners of more than fifty per cent (507) of the area and who comprise the majority of landowners residing in the area of land embraced in what is known as the Maxwell's First Annexation to the City of Fort Collins wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Maxwell's First Annexation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on January 17 1963 and WHEREAS notice for hearing on the 28th day of February A D 1963 on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation the petition for the annexation of all the territory in what is known and described as the Maxwell's First Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly i described as follows to-wit Beginning at the Northwest corner of the Southeast Quarter of Section 9, Township 7 North Range 69 West of the 6th P M thence South 89039'15" East 1305 80 feet to the Northwest corner of the Northeast quarter of said Southeast quarter thence South 00 05' East 264 feet thence South 89 39'15 ' East 330 feet, thence North 00 05' West 264 feet, thence South 89 39'15 East 322 78 feet to the Northwest corner of the East half of the Northeast quarter of said Southeast quarter thence South 350 feet thence' South 89"39'15 ' East 202 78 feet, thence North 350 feet, thence South 89 39'15 ' East 450 feet to the Northeast corner of said Southeast quarter, thence along the East line of said Southeast quarter South 00 00'15 ' East 1784 63 feet thence North 89035'30 ' West 1303 15 feet thence North 00 04'30 West 71 70 feet thence South 89"55130 West 1303 07 feet, to the West line of said Southeast quarter, thence along the West line of said Southeast quarter North 00 10'15 ' West 1721 12 feet to the point of beginning containing 101 2 acres, more or less be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and ,jurisdiction of the City of Fort Collins as a part of B Residence District and that the City Clerk be and he is hereby authorized and directed to prepare certi- fied copies of this ordinance to each of which shall be attached a plat of said Maxwell's First Annexation to the City of Fort Collins Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Maxwell's First Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to service of said addition except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15 Code of Ordinances of the City of Fort Collins, Colorado 1954, as amended, relating to local and public improvements -2- Introduced considered favorably on first reading and ordered published this 28th day of February A.
