HomeMy WebLinkAbout017 - 05/23/1963 - ANNEXING PROPERTY KNOWN AS THE SOUTH TAFT HILL SECOND ANNEXATION r ORDINANCE NO 17 1963s ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE SOUTH TAFT HILL SECOND ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRIRORY EMBRACED IN SAID PINT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953, WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, by the sole owner of the area of land embraced in what is known as the South Taft Hill Second Annexation to the City of Fort Collins, wherein and whereby said petitioner petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the South Taft Hill Second Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more par- ticularly described as hereinafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on March 21, 1963, and WHEREAS, notice for hearing on the 2nd day of May, A D 1963, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annex- ation, the petition for the annexation of all the territory in what is known and described as the South Taft Hill Second Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit A tract of land situate in the NWk of Section 15, T 7N , R 69 W of the 6th P M , County of Larimer, State of Colorado, which considering the West line of said NWk as bearing N 00 32' W and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point which bears N 00 32' W 465 00 feet and again S 89 54'23" E 10 00 feet from the West k corner of said Section 15 and run thence N 00 32' W 197 15 feet, thence S 89 54123' E 656 05 feet to the NW corner of the South Taft Hill First Annexation thence S 00 29' E 332 15 feet along the Westerly line of said annexation thence N 89 54123 W 343 08 feet, thence N 00 32' W 135 00 feet thence N 89 54'23" W 312 67 feet to the point of beginning containing 4 0321 acres more or less be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins with the East 233 05 feet of said lands included in the 'B Residence District and the Westerly 403 feet in- cluded in the 'C Residence District, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said South Taft Hill Second Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the South Taft Hill Second Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be re- quired and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, t Code of Ordinances of the City of Fort Collins, Colorado 1959, as amended, relating to local and public improvements Introduced, considered favorably on first reading and ordered published this 2nd day of May, A D 1963, and to be presented for final passage on the 23rd day of May, A D 1963 Mayo- r ATTEST City C1 rk Passed and adopted on final reading this 23rd day of May, A D. 1963 blayor ATTEST City Cle k -3-
