HomeMy WebLinkAbout019 - 06/27/1963 - ANNEXING PROPERTY KNOWN AS THE MAXWELLS SECOND ANNEXATION ORDINANCE NO 19 1963 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE MAXWELL'S SECOND ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TER- RITOTY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953 WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11 Chapter 139 Colorado Revised Statutes, by the owners of more than fifty per cent (507) of the area and who comprise the majority of landowners residing in the area of land embraced in what is known as the Maxwell's Second Annexation to the City of Fort Collins wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Maxwell's Second Annexation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on April 11 1963 and WHEREAS notice for hearing on the 23rd day of May A D 1963 on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of \ Article 11 Chapter 139 Colorado Revised Statutes 1953 and V WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annex- ation the petition for the annexation of all the territory in what is known and described as the Maxwell's Second Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit A part of the Southeast Quarter of Section 9 and of the North- east Quarter of Section 16 all in Township 7 North Range 69 West of the 6th P M County of Larimer State of Colorado which considering the South line of the said Southeast Quarter as bearing North 89 35'30' West and with all bearings contained herein relative thereto begin at a point on the South line of said Southeast Quarter which bears North 89 35'30" West 500 90 feet from the Southeast corner of said Section 9 and run thence North 89 35130 West 154 10 feet thence South 00 25' West 740 00 feet thence North 89 35'30' West 170 00 feet thence North 00 25' East 740 00 feet to a point on the South line of said Southeast Quarter thence North 89 35'30 West 477 10 feet thence North 00 04'30 West 860 00 feet to a point on the South line of Maxwell's First Annexation to the City of Fort Collins Colorado thence along said South annexation line South 89 35'30 East 801 69 feet thence South 00 02'15 East 860 00 feet to the point of beginning containing 18 7102 acres more or less ALSO begin at a point on the South line of said Southeast Quarter which bears South 89 35'30 ' East 110 00 feet from the South Quarter corner of said Section 9 and run thence North 00 10'15 West 389 02 feet thence South 82 06'30 ' West 111 01 feet thence North 00 10'15 ' West 548 14 feet to a point on the South line of Maxwell's First Annexation to the City of Fort Collins, Colorado thence North 89 55130 East 947 19 feet along said South annexation line thence South 00 04'30' East 194 27 feet thence South 89 55130 ' West 353 45 feet thence South 00 07' East 335 84 feet thence North 89 35'30" West 263 12 feet thence South 00 10'15' East 396 00 feet to a point on the South more or less be accepted and approved and that said territory be annexed and made a part of the C2.ty of Fort Collins and be included within the limits and Jurisdiction of the City of Fort Collins as a part of B Residence District and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Maxwell's Second Annexation to the City of Fort Collins Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado. Section 2 That in accepting and approving the plat of the Maxwell's Second Annexation to the City of Fort Collins, the City of Fort Collins does -2- Y not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to sbrvice of said addition except as may be required and provided by the owners of thelproperty within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins Colorado 1958 as amended relating to local and public improvements Introduced, considered favorably on first reading and ordered 6th June, published this day of*29� A D 1963 and to be presented for final passage on the JUM day of June A D 1963 yor ATTEST City Cl rk Passed and adopted on final reading this 27tth day of June A D 1963 yor ATTEST tMa City C erk -3-
