HomeMy WebLinkAbout021 - 07/03/1963 - ANNEXING PROPERTY KNOWN AS THE ELLIOTT-MILLER SECOND ANNEXATION ORDINANCE NO 21 y 1963 ACCEPTING AND APPROVING THE OF WHAT IS KNOWN AS THE SECOND ELLIOTT-MILLER ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRI- TORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139, COLORADO REVISED STATUTES, 1953 WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11 Chapter 139 Colorado Revised Statutes by the sole owner of the area of land embraced in what is known as the Second Elliott-Miller Annexation to the City of Fort Collins wherein and whereby said petitioner petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Second Elliott-Miller Annex- ation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on April 18 1963 and WHEREAS notice for hearing on the 6th day of June A D 1963 on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annex- ation the petition for the annexation of all the territory in what is known and described as the Second Elliott-Miller Annexation to the City of Fort 1 Collins, Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit A tract of land situate in the SEk of Section 16 Township 7 North Range 69 West of the 6th P M County of Larimer State of Colorado which considering the East line of said SEW as bearing S 00 32" East and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point which bears N 89 41' West 1048 59 feet and again S 00 32' East 530 00 feet from the NE corner of the SEt of the SEA of said Section 16 said point being the SE corner of the First Elliott-Miller Annex- ation to the City of Fort Collins Colorado and run thence S 00 32' E 356 28 feet thence N 89 40' W 270 14 feet thence N 00 20' W 356 26 feet to the SW corner of said First Elliott-Miller Annexation thence S 89 41' E 268 90 feet along said South line to the point of beginning be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a part of A Residence District and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Second Elliott-Miller Annexation to the City of Fort Collins Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Second Elliott-Miller Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines, gas mains, electric light lines or other services or utilities with re- spect to service of said addition except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15 Code of Ordinances of the City of Fort Collins Colorado 1953 as amended relating to local and public improvements Introduced considered favorably on first reading and ordered published this 13th day of June A D 1963 and to be presented for final -2- passage on the 3rd day of July A D 1963 " LL4�ml d07 �-tj fftyor ATTEST City C t rk Passed and adopted on final reading this 3rd day of July A D 1963 yor ATTEST City lerk -3-
