BROWN ANNEXATION ORDINANCE NO 33 , 1963 ACCEPTING AND APPROVING TRS-PIA'1` OF WHAT IS KNOWN AS THE EDWIN G BROWN ANNEXATION TO THE CITY OF FORT COLLINS, COLD- RAW, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED MITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAP- TER 139, COLORADO REVISED STATUTES, 1953 WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, by all the owners of the land embraced in what is known as the Edwin G Brown Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Edwin G Brown Annexation to the City of Fort Collins Colo- rado comprising the lands shown in the plat thereof attached to said peti- tion and more particularly described as hereinafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on May 16, 1963, and WHEREAS notice for hearing on the 5th day of September, A D 1963, on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for Annex- ation the petition for the annexation of all the territory in what is known and described as the Edwin G Brown Annexation to the City of Fort Collins, Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows to wit A portion of the NF& of Section 240 Township 7 North, Range 69 West of the 6th P M , County of Larimer, State of Colorado which considering the South line of the North one-half of said NF& as bearing West and with all bearings contained here- in relative thereto, is contained within the boundary lines which begin at a point which is North 229 45 feet and 30 0 feet East from the SW corner of the lift of the NSA of said Section 24 and run thence North 432 55 feet, thence East 301 76 feet, thence S 00 111304' W 662 01 feet to a point on the South line of the North one-half of said NEB thence West 164 77 feet thence North 229 45 feet thence West 134 77 feet to the point of beginning, be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a part of the "A" "B" and "C" Residence Dis- tricts as follows to-wit Commencing at a point which is East 164 77 feet from the SW corner of the Nft$ of the NE& of said Section 24 and run thence East 114 77 feet thence North 00 11'30" East 159 46 feet thence West 115 30 feet thence South 159 45 feet to the point of beginning, as a part of the 'A Residence District Beginning at a point which is North 229 45 feet and 30 0 feet East from the SQ corner of the Nft of the NE& of Section 24, Township 7 North Range 69 West of the 6th P M and run thence North 245 24 feet, thence South 59 14'15" East 349 74 feet, thence South 00 11'30" West 295 75 feet, thence West 50 feet, thence North 00 11'30 East 159 46 feet, thence West 115 30 feet thence North 70 00 feet thenfie West 134 79 feet to the point of beginning as a part of the B Residence District Commencing at a point which is North 229 45 feet and 30 0 feet East from the SW corner of the NWt of the NF& of said Section 24 and run North 245 24 feet to the true point of beginning, thence North 107 31 feet, thence East 301 76 feet, thence South 00 11'30" West 366.26 feet, thence North 59 14115 W st 33([�,9 74 eet to the true point of beginning, as a part of thee C" esi ence District and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Edwin G Brown Annexation to the City of Fort Collins Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Edwin G Brown Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be re- quired and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, f Code of Ordinances of the City of Fert3Collins, Colorado, 1958, as amended, relating to local and public improvements
