THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 110 CHAPTER 1399 COLORADO, REVISED STATUTES 1953 WHEREAS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, by the i owners of more than fifty per cent (507) of the area and who comprise the majority of landowners residing in the area of land embraced in what is known as the First Betz Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the First Betz Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more parti- cularly described as hereinafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on October 10, 1963, and WHEREAS, notice for hearing on the 21st day of November A D , 1963, on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes 1953, and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Sectionll That after due consideration of the petition for Annex- ation, the petition for the annexation of all the territory in what is known and described as the First Betz Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particu- larly described�as follows, to-wit "A tract of land situate in the Northwest Quarter of Section 18, Township 7 North, Range 68 West of the Sixth P M , County of Larimer, State of Colorado, which considering the West line of said Northwest Quarter as bearing S 00'06' W and with all bearings contained herewith relative thereto is contained within the boundary lines which begin at the Southwest corner of said Northwest Quarter and run thence N 00'061 E 150 00 feet along the West line of said Northwest Quarter, thence N 89015' E 1245 92 feet thence S 00'06' W 150 00 feet to a point on the North line of the Iarimer County Hospital Annexation to the City of Fort Collins, Colorado thence S 89015' W 1245 92 feet along said North line to the point of beginning " � J Beginning at a point on the East line of County Road � right-of-way which point bears N 89 08' East 30 feet from the West Quarter corner of Section 18 TownsWip 7 North, Range 68 West of the 6th P M r thence North 150 feet thence East 1215 92 feet thence South_ 150 feet, thence West 1215 92 feet to point of ` beginning be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as ID" Commercial District, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said First Betz Annexation to the City of Fort Collins, Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the First Betz Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to service of said addition, except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins Colorado 1958 as amended relating to local and public improvements
