HomeMy WebLinkAbout011 - 05/22/1958 - ANNEXING PROPERTY KNOWN AS THE MILLER BROTHERS SECOND FOOTHILLS ANNEXATION J ORDINANCE NO 11 1958 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS MILLER BROTHERS SECOND FOOTHILLS ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXA- TION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CON- TAINED IN ARTICLE 11 CHAPTER 139 COLORADO REVISED STAT- UTES, 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11, Chapter 139 Colorado Revised Statutes 1953, by the sole owner of the area of land embraced in what is known as the Miller Brothers Second Foothills Annexation to the City of Fort Collins, wherein and whereby said petitioner petitioned the City of Fort Collins for the annexation of all the territory embraced in what is known as Miller Brothers Second Foothills Annexation to the City of Fort Collins Colorado compris- ing the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 27th day of February, A D 1958, and WHEREAS notice for hearing on the loth day of April, A D 1958, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for an- nexation, the petition for the annexation of all the territory in what is known and described as the Miller Brothers Second Foothills Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to- wit Part of the SA of Section 15 Township 7 North Range 69 West of the 6th P M which considering the West line of the SW'k of said Section 15 as bearing S 00 32' E and with all bearings contained herein relative thereto begin at a point which bears S 00 32' E 350 feet from the NW corner of the SWk of said Section 15, said point being the SW corner of Miller Brothers Foothills Annexation according to the plat recorded August 22, 1957 and run thence S 00 32' E 410 feet along the West line of the SW'k of said Section 15, thence N 83 00' E 1295 17 feet thence N 00 32' W 250 05 feet to the SE corner of said Miller Brothers Foothills Annexation thence N 89 54123" W 1287 00 feet along the South line of said Miller Brothers Foothills Annexation to the point of beginning and containing an area of 9 749 acres more or less and subject to right of way of County Road over the Westerly 30 feet thereof be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jur- isdiction thereof and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said Miller Brothers Second Foothills Annexation to the City of Fort Collins Colorado, and shall file a copy thereof in the Office of the Clerk and Recorder of the County of Larimer and another copy thereof in thelOffice of the Clerk of the City of Fort Collins, together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colo- rado Section 2 That in accepting and approving the plat of the Miller Brothers Second Foothills Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be re- quired and provided by the owners of property within the limits of said - 2 - addition in compliance with the terms and provisions of Ordinance No 7 1921 relating to local and public improvements as amended Introduced considered favorably on first reading and ordered pbblished this loth day of April A D 1958, and to be presented for final passage on the 22nd day of May A D 1958 a A ATTEST Mayor -�R City Clerk Passed and adopted on final reading this 22nd day of May A D 1958 ATTEST Mayor s� City Clerk - 3 -
