HomeMy WebLinkAbout012 - 05/22/1958 - ANNEXING PROPERTY KNOWN AS THE MAXFIELD ANNEXATION ORDINANCE NO 121 1958 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE MAXFIELD ANNEXATION TO THE CITY OF FORT COLLINS COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JUR- ISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 119 CHAPTER 139, COLORADO REVISED STATUTES 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11 Chapter 139 Colorado Revised Statutes 1953, by thirteen (13) individuals purporting to be all of the qualified electors of the area of the territory involved and further purporting to be the owners of all the area of the territory involved whereby said petitioners petitioned the City of Fort Collins for the annexation of all the territory embraced in what is known as the Maxfield Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 27th day of February A D 1958, and WHEREAS notice for hearing on the loth day of April A D 19580 on an ordinance approving the annexation of said territory and including the same within the limits and ,jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS m proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexationbaving been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for an- nexation the petition for the annexation of all the territory in what is known and described as the Maxfield Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit Part of the SEk of Section 15, Township 7 North,Range 69 West of the 6th P M , Larimer County Colorado contained within boundary lines which considering the East line of said SEk of Section 15 as bearing due North with all bear- ings herein relative thereto begin at the SE corner of said SEk of Section 15 and run thence N 89 28' W along the South line of the SEk of said Section 15, 330 00 feet to a point on a Southerly ex- tension of the West lines of Lots 1, 21 3 4 and 5, in the Maxfield Subdivision of a portion of the SEk of said Section 15, according to the plat filed for record April 16, 1948 thence North, along the Test lines of Lots 1, 2 3, 4 and 5, in said Maxfield Subdivision 659 2 feet thence East 330 00 feet to the NE corner of the SEk of the SEk of the SEk of said Section 15 thence South along the East line of the SEA of said Section 15, 662 3 feet to the point of beginning and con- taining an area of 5 017 acres more or less, be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jur- isdiction thereof and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Maxfield Annexation to the City of Fort Col- lins Colorado and shall file a copy thereof in the Office of the Clerk and Recorder of the County of Larimer and another copy thereof in the Office of the Clerk of the City of Fort Collins, together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Max- field Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines gas mains electric light lines or other services or utilities with respect to service of said addition except as may be required and provided by the owners of property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7 1921 relating to local and - 2 - public improvements, as amended Introduced, considered favorably on first reading and ordered published this loth day of April, A D 1958 and to be presented for final passage on the 22nd day of May A D 1958 ATTEST Mayor �iY'C��.�,�✓.lam City Clerk Passed and adopted on final reading this 22nd day of May, A D 1958 ATTEST Mayor City Clerk - 3 -
