ORDINANCE NO 13, 1959
BEING AN ORDINANCE RELATING TO THE CITY DOG POUND AUTHORIZING
AN AGREEMENT TO BE ENTERED INTO WITH THE STATE BOARD OF
AGRICULTURE CONCERNING THE CONSTRUCTION, OPERATION AND MAINTENANCE
OF A DOG POUND BY THE STATE BOARD OF AGRICULTURE TO BE USED BY
THE CITY OF FORT COLLINS AND APPROPRIATING THE SUM OF FIVE THOUSAND
DOLLARS ($5,000 00) FOR SUCH PURPOSES
WHEREAS, under the provisions of Ordinance 39, 1957, it is required
that dogs be impounded under certain situations in the City pound or other
suitable place and
WHEREAS, the City of Fort Collins presently has no City pound or
other permanent suitable place within which to impound dogs so required to be
impounded, and
WHEREAS, by Resolution adopted on March 53, 1959, the City Manager was
authorized to negotiate with officials of Colorado State University to the end
that Colorado State University in constructing a small animal laboratory would
include a bay in such building which could be used by the City of Fort Collins
as a City Dog Pound on a co-operative basis with the university, and
WHEREAS, such negotiations have been concluded satisfactorily by said
City Manager and an agreement has been prepared which provides in substance that
the City of Fort Collins will pay to Colorado State University the sum of Five
Thousand Dollars ($52000 00) to be used in construcling said bay and providing
further that said bay may be used by the City of Fort Collins for impounding
purposes for a term of five years, and thereafter from year to year until one
of the parties to said agreement notifies the other party that said agreement
will terminate at the end of the then current year and upon termination of said
agreement the State Board of Agriculture will refund to the City said sum of
Five Thousand Dollars ($51000 00) less a reasonable charge for depreciation and
obsolescence, and which further provides that the City of Fort Collins will
further pay to Colorado State University the actual cost of maintaining and
operating said dog pound
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That pursuant to the provisions of Section 16, Article II
of the City Charter, the City of Fort Collins shall enter into an agreement
with the State Board of Agriculture, xthe provisions of which contract shall be
essentially as are hereinabove mentioned, and the Mayor and City Clerk are
authorized and directed to enter into said contract on behalf of the City
of Fort Collins
Section 2 The sum of Five Thousand Dollars ($5,000 00) is hereby
appropriated, which said sum is hD be paid over to the State Board of Agriculture
pursuant to the terms of said agreement and for the purpose of assisting in
meeting the cost of the bay of the building to be used as a City Dog Pound
The necessity for the within appropriation is caused by the unforseen con-
tingency arising after the passage of the annual appropriation ordinance of
an agreement being negotiated with the State Board of Agriculture for the
construction of a building to serve as the City Dog Pound
Introduced, considered favorably on first reading, and ordered
published this 9th day of April, A D 1959, and to be presented for final
passage on May 14, 1959
