BEING AN EMERGENCY ORDINANCE, AfAEADIING ORDINANCE NO 55, 1946,
RELATING TO THE SALE OF MILK AND MILK PRODUCTS, DEFIJING
GRADE B RAV4 &IIaC ,ND GRADE C RA1 1ILK, AND LISTING THE
idILK PRODUCTS THAT MAY BE MkNUFACTUPED PAD SOLD FROM SUCH
GRADES -
BE IT ORDAINED BY THE CITY COUACIL OF THE CITY OF FORT COLLINS
Section 1 That Section 7 of Ordinance Ao 5, 19461V
be and the same is hereby amended by adding thereto the
following, to wit
"GRADE B RAW MILK — Grade B raw milk is raw milk which
violates the bacterial standard and/or the abortion testing
requirement for grade A raw milk, but which conforms with
all other requirements for grade A raw milk, and has an
average bacterial plate count not exceeding 1,000,000 per
cubic centimeter, or an average direct microscopic count
not exceeding 1,000,000 per cubic centimeter if clumps are
counted or 4,000,000 per cubic- centimeter if individual
organisms are counted, or an average reduction time of not
less than 32 hours, as determined under sections 1 (S) and 6
GRADE C RAW MILK — Grade C raw milk is raw milk which
violates any of the requirements for grade B raw milk "
Section 2 That Section 8 of Ordinance No 5, 1946,
be and the same is hereby amended by substituting therefor
the following, to wit
"SECTION 8 GRADES OF MILK rsND MILK PRODUCTS WHICH MAY
BE SOLD From and after 24 months from the date on which
this ordinance takes effect no milk or milk products shall
be sold to the final consumer or to restaurants, soda
fountains, grocery stores, or similar establishments
except Grade A milk or except that they be from Grade A
milk, PROVIDED, however, that ice cream, buttermilk, cot-
tage cheese a-rid batter may be manufactured by using Grade
B or Grade C milk and such milk products may be sold, AidD
PROVIDED, that when -any milk distributor fails to qualify
for the above grLdes for a period of 30 days after notice
thereof by the food inspector, the City Council is author-
ized to revoke his permit 11
Section 3 In the opinion of the Citv Council an
emergency exists for the preservation of the public health,
peace and safety, and this ordinance shall take effect
upon its passage, under and by virtue of the authority
contained in Sections 6 and 7 of Article IV of the City
Charter
Introduced, read at length and adopted by the unanimous vote
of all members of the City Council, at a regular meeting held

Ordinance consisting of three sections was duly proposed and
read at length at a regular meeting of the City Council held
on the 4tn day of November, A D 1948, and was duly adopted
and ordered published in the Fort Collins Coloradoan, a daily
newspaper, and the off.Lcial newspaper of the City of Fort
Collins, by the unanimous vote of all members of the City
Council as an emergency ordinance, in accordance with the
provisions of sections 6 and 7 of Article IV of the City
Charter, aid thereafter and on to merit the 9th day of
November, A D 1948, said Ordinance No 1j___was duly
published in the Fort Collins Coloradoan, a daily newspaper
published in the City of Fort Collins, Colorado
