BEING AN EMERGENCY ORDINANCE, PROVIDING FOR THE REGULATION
AND LICENSING OF SECOND HAND DEALERS AND FIXING PENALTY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 DEFINITION. Every person who buys,
sells, exchanges or deals in personal property that has
been previously used, broken or disfibured shall be con-
sidered a second hand dealer This definition, however,
and the terms of this ordinance shall not apply to
merchants who deal in new furniture, dishes or other
regular household furnishings and accept such articles
for credit on tre purchase price of new or usea articles
sold contemporaneously which are of similar character
to the goods so exchanged
Section 2 LICENSE-FEES. No person shall conduct
any business as secona hand dealer in the City of Fort
Collins without a license therefor The fee for said
license shall be One Dollar ( ,�l 00) per year or for any
part of a year The City Clerk, if he shall be satisfied
that the applicant is a fit person to engage in or carry
on such business, shall issue a license to the applicant
upon payment of the fee herein specified
Section 3 RECORDS-INSPECTION
(a) Every dealer licensed under this ordinance shall Keep
at his place of business an accurate , detailed record of
every article purchased by him, such record to include the
date of purchase , name of seller , amount paia and
description of article , and shall be clean and legible
(b) Every second hand dealer shall, upon request during
ordinary business hours , submit and exhibit the records
herein required to the inspection of the Chief of Police
or any regular police officer of the City of Fort
Collins and permit any of said officers to make a copy
thereof He shall also upon request exhibit for the
inspection of any of the above named officers any personal
property or merchandise that may be so received by him
Section 4 HOLD PERIOD Every second hand dealer
shall keep all readily portable property purchased by
him for a period of ten days before the same is sold
Section 5 AGE RESTRICTION No second hand dealer
shall purchase any second hand personal property or
merchandise from any person under the age of eighteen ( 18)
years
Section 6 GOODS STOLEN OR ILLEGALLY OBTAINED, TO
BE SURRENDERED Any second hand dealer who shall have
accepted, obtained or bought any personal property or
merchandise, either new or second hand, from any person,
not knowing the same to have been stolen or illegally ob-
tained, shall deliver the same into the hands of the
lawful owner when said owner shall have made a reasonably
accurate and certain identification by means of number,
description, or otherwise in the presence of the investigat-
ing officer

Section 7 PENALTY Any person violating any pro-
vision of this ordinance shall upon conviction be fined
in a sum not less than Five Dollars ($5 00) nor more
than One Hundred Dollars ($100 00) for each offense
Section 8 EIERGENCY In the opinion of the City
Council, an emergency exists for the preservation of the
public health, peace and safety, and this ordinance shall
take effect, upon its passage, under and by virtue of the
authority contained in Sections 6 and 7 of Article IV
of the City Charter
Introduced, read at length and adopted by the unanimous
vote of all members of the City Council at a regular meeting
held this 3rd day of March, A D 1949

I , MILES F HOUSE, City Clerk of the City of Fort
Collins, do hereby certify and declare that the foregoing
Orainance consisting of eight sections was duly proposed and
read at length at a regular meeting of the City Council held
on the 3rd day of March, A D 1949, and was duly adoptea
and ordered published in the Fort Collins Coloradoan, a
daily newspaper, and the official newspaper of the City of
Fort Collins, by the unanimous vote of all members of the
City Council as an emergency ordinance, in accordance with
the provisions of Sections 6 and 7 of Article IV of the
City Charter, and thereafter and on to-Nit the 8th day of
March, A D 1949 , said Ordinance No 3 was duly published
in the Fort Collins Coloradoan, a daily newspaper published
in the City of Fort Collins , Colorado
