RELATING TO THE GRPNTING OF A FRANCHISE TO PUBLIC SERVICE
COMPANY OF COLORADO, A CORPORATION, ITS SJCCESSORS AND ASSIGNS,
FOR FURNISHING GAS EITHER NATURAL, ARTIFICIAL OR MIXED, AND
GAS SERVICE TO THE CITY OF FORT COLLINS AND ITS INHABITANTS,
AND GRPNTING TO SAID COMPANY THE RIGHT TO USE AND OCCUPY THE
STREETS, AVENUES, ALLEYS, BRIDGES, ROADS, PUBLIC udAYS AND
PLACES ITT THE CITY, PROVIDING FOR AN AMENDED SCHEDULE OF RATES
AND CONDITIONS UNDER WHICH THE SAME SHALL BE APPLIED
WHEREAS, the Public Service Company of Colorado, to
which corporation was granted on October 14, 1947, the franchise
for the furnishing of gas, either natural, artificial or mixed,
and gas service to the City of Fort Collins and its inhabitants,
has submitted a proposed amended schedule of rates, together with
conditions under which the same shall be applied, to become
effective with meter readings begin^ing December 26, 1950, and
WFFREAS, the City Manager has recommended the approval
of said proposed amended schedule of rates, which recommendation
has been approved by the City Council of the City of Fort
Collins.
BE IT ORDAINFD BY THE CITY COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That Section 8 of Ordinance No. 13, 1947,
be amended to read as follows
"Section 8 All rates together with conditions under
which all rates shall be applied and the General Gas Service
Rules and Regulations, the Special Gas Service Rules and Regula-
tions pertaining to the various classes of service ands the
Service Connection and Main Extension Policy under which Rules,

Regulations and Policy all service is supplied shall be kept on
file at the office of the City Clerk and available for inspection
at the office of the Company
The following schedule of rates shall be in effect as
of meter readings beginning December 26, 1950 and shall continue
in accordance with the terms of this franchise

The above rates are net Bills for gas service are

DONTRACT PERIOD
11 contracts under this schedule shall be for a period
of thirty days and thereafter until terminated on two days'
written notice.
RULES AND REGULATIONS
Service under this schedule is for Residentigl customers
only and is not applicable to Commercial customers including clubs,
fraternities, sororities, lodges, hotels, restaurants, apartment
houses, rooming houses, tourist camps, cottage camps and multiple
dwellings where more than one dwelling or^more than one living
quarter is served through one meter.
Service is for the exclusive use of the customer and shall
not be resold or shared with others.
The General and Residential Gas Service Rules and Regu-
lations, together with such supplements thereto and revisions
thereof as are currently in effect , are made a part hereof by
reference thereto provided that copies of all such rules shall be
kept on file with the City Clerk and at the office of the Company

CONTRACT PERIOD
All contracts under this schedule shall be for a period

RULES AND REGULATIONS
Service hereunder is applicable only to commercial customers
for general use (Rate 5G) or spaceheating use (Rate 7G) . Service is
for the exclusive use of customer and shall not be resold or
shared with others Service is not applicable for temporary or
intermittent use, gas engines or for use as standby to other
sources of fuel.
If the estimated or actual gas requirement of 4 customer
in any month during the months of November to March inclusive is
in excess of twenty-five percent (25%) of the total annual use,
this rate does not apply
Service hereunder is subject to the "General" and "Commercial"
Gas Service Rules and Regulations, together with such supplements
thereto and revisions thereof as are from time to time in effect ,
provided that copies of all such rules shall be kept on file with
the City Clerk and at the office of the Company.
COMMERCIAL SERVICE

In consideration of the special commodity charge all
contracts under this schedule are subject to prior rights to
any available gas of all customers on the Residential Rate.

CONTRACT PERIOD
11 contracts under this schedule shall be for a minimum
period of twelve months and thereafter until terminated, where
service is no longer required, on three days' written notice
The reserved capacity specified shall prevail during the contract
period unless customer makes new application for additional capacity
and Company accepts same, in which event a new agreement for a full
contract period of twelve months shall be made
RULES AND REGULATIONS
Demand or capacity reservations shall in all cases be
contracted for on an annual basis and shall be made available in
the following standard quantities in cubic feet per hour 22 1/21
30, 37 1/22 45, 602 75, 900 1202 150, 180, 2409 300
The discontinuance of service or removal of meter by or
for any customer shall not entitle such customer to avoid payment
of Reserved Capacity Charge or Customer Charge under prior contract
if service is re-applied for by such customer at the same premises
during the annual period covered by the prior contract.

The company shall limit the demand of each customer to
the contract reservation by means of a standard demand meter
installed by the Company on the customer' s premises but at the
expense of the Company.
It is agreed that in the event of failure to supply any
demand or capacity reservation so contracted for, the customer
shall be entitled to receive and agree to accept as full compensa-
tion for such failure an amount equal to ten times the prorated
amount of the yearly demand or capacity reservation charge for
the period and proportion of such failure.
19here use is seasonal, as for spaceheating, the yearly
Customer and Reserved Capacity Charges may be billed and paid in
eight monthly installments equal to ten percent of said yearly
charges plus four monthly installments (during months of June to
September, inclusive) equal to five percent of said yearly charges.
The General and Commercial Gas Service Rules and Regula-
tions, together with such supplements thereto and revisions thereof
as are currently in effect , are made a part hereof by reference
thereto provided that copies of all such rules shall be kept on
file with the City Clerk and at the office of the Company
INTERRUPTIBLE INDUSTRIAL SERVICE
OFF-PEAK SERVICE - COMPLETE AND ADEQUATE STANDBY REQUIRED

APPLICABILITY
—Tnlicable to Industrial and Large Commercial Service where
Company has available a supply of gas in excess of that required
for service to higher priority customers and where customer has
complied with the standby requirements of the rate as set forth in
the Industrial Gas Service Rules and Regulations and in the indivi-
duel agreement between customer and Company

Plus, an On-Peak Demand Charge for the maximum
Daily On-Peak use of gas occurring during the
twelve months' period ending with the current

The Demand Charge payable per month for On-Peak gas used
shall be one-twelfth (1/12) of the total Demand Charge determined
above.
In calculating the bill for gas service the volume of gas
as registered on the meter shall be adjusted to a volume based on
sixty degrees Fahrenheit and at a pressure of four ounces per
square inch above average atmospheric pressure.
MINIMUM
Net minimum charge per month, .10.00

PAYMENT
The above rates are net Bills for gas service are due
and payable within ten days from date of bill
CONTRACT PERIOD
11 contracts hereunder shall be for a minimum period of
one year or for such longer periods as may be specified in the
individual agreement.
CUT-OFF PROVISIONS
n consideration of this special rate for Industrial Gas
Service, all use of gas under this rate is interruptible and is
subject to immediate cut-off by discontinuance of gas service to
customer by Company without notice. Company, whenever circumstances
permit , will endeavor to give customer advance notice of inter-
ruption or cut-off by telephone or otherwise.
Company will interrupt or cut-off all gas service to
customer under this rate in order to prevent a shortage of gas for
the use of customers supplied on higher priority service rates.
Company will interrupt or cut-off all gas- service to customer
under this rate, excepting On-Peak Gas Service supplied under
contract , in order to prevent an increase in the demand charge to
Company under Company' s gas purchase contract.
Customer shall immediately discontinue the use of gas
(including On-Peak gas) when and as directed by Company Authorized
representatives of Company shall have at all times the right of
ingress and egress to customer's premises Upon determination by
Company that the necessity for interruption or cut-off has ceased
service shall be resumed.
Residential and Commercial Gas Services have priority to
the use of gas service over all Industrial Gas Services.
The interruption of gas deliveries in whole or in part
under this rate shall not be the basis for claims for damages
sustained by customer.

ON-PEAK SERVICE
On-Peak gas shall be construed as "any gas used during
the period beginning at the time when customer is directed by
Company to discontinue or curtail his use of gas and ending at
the time when customer is authorized by Company to resume full
use of gas." The term "Daily" as used herein, shall be construed
as the 24-hour period commencing at 8 00 o'clock A M.
Commitments for On-Peak Service shall be at the option
of Company dependent upon the sufficiency of pipeline and distri-
bution system capacities with respect to the requirements of
Company' s other gas customers. The maximum Daily volume of
On-Peak gas to be supplied to customer shall be specified in the
individual agreement for service between customer and Company
and customer, when and as directed by Company, shall curtail his
use of gas to an amount not to exceed such Daily maximum If
customer uses On-Peak gas in excess of said Daily maximum or uses
On-Peak gas without contracting for same, customer shall pay
Company for such use at the rate herein set forth for On-Peak
Service Such gas so taken, however, shall have only the same
priority as the Off-Peak gas supplied under this rate On-Peak
Service contracted for shall have priority to the use of gas over
all Off-Peak Service supplied hereunder but shall be subject to
the priority to the use of gas of customers supplied under all
other of Company's rates.
RULES AND REGULATIONS
Service hereunder shall be by individual agreement between
customer and Company for the exclusive use of customer and shall
not be resold or shared with others.
Gas purchased under this rate shall not be used as fuel
for gas engines nor shall it be used either as standby to other
fuels or for auxiliary purposes
Any customer requesting service under this rate shall
make provision for interruptions of service as follows
Customer shall (1) install and maintain auxiliary
equipment capable of supplying the total heat re-
quirements normally supplied by the as burning
equipment served under this rate, (2 maintain a
supply of fuel adequate for a period-of not less
than seven (7) consecutive days maximum use of
such auxiliary equipment, and (3 ) have qualified
personnel employed and available at all times to
operate such auxiliary equipment
In the event that customer is unable to provide complete
and adequate standby for any portion of customer' s gas burning
equipment, customer, at his expense, shall arrange the gas piping
to the equipment not provided with standby so that the gas to such
equipment can be separately metered and gas service to such equip-
ment shall be supplied only under the appropriate commercial rate.

Necessary extensions and reinforcements of Companyts
established distribution system shall be made by individual
agreement between applicant and Company based upon the character
and permanency of the load
Service hereunder is subject to the "General" and
"Industrial" Gas Service Rules and Regulations, together with
such supplements thereto and revisions thereof as are from time
to time in effect , provided that copies of all such rules shall
be kept on file with the City Clerk and at the office of the
Company "
Section 2 In the opinion of the City Council an emergency
exists for the preservation of the public health, peace and safety,
and this ordinance shall take effect upon its passage under and
by virtue of the authority contained in Sections 6 and 7 of
Article IV of the City Charter.
Introduced, read at length and adopted by the unanimous
vote of all members of the City Council, at an adjourned meeting
held this 27th day of December, A D 1950.

Collins Coloradoan, a daily newspaper and the official newspaper
of the City of Fort Collins, by the unanimous vote of all members
of the City Council as an emergency ordinance, in accordance with
the provisions of Sections 6 and 7 of Article IV of the City Charter,
and thereafter and on to-wit the 2nd day of January ,

the Fort Collins Coloradoan, a daily newspaper published an the
City of Fort Collins, Colorado
