BEING AN EMERGENCY ORDINANCE CALLING AND PROVIDING FOR A SPECIAL ELECTION
TO BE HELD IN THE CITY OF FORT COLLINS, COLORADO, ON TUESDAY, THE 4th DAY
OF NOVEMBER, A D 1952, AND FOR THE SUBMISSION TO A VOTE OF THE QUALIFIED
ELECTORS CERTAIN MEASURES AND AMENDMENTS TO THE CITY CHARTER OF THE CITY
OF FORT COLLINS) COLORADO, AND PROVIDING FOR THE FORM OF SUBMISSION OF THE
SAME
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That a special election be and the same is hereby called,
as provided by law, and held in the several precincts of the City of Fort
Collins, Colorado, on Tuesday, the 4th day of November, A D 1952, at which
election there shall be submitted to the qualified electors certain initiated
ordinances and certain amendments to the City Charter of the City of Fort
Collins, Colorado, as herein contained, all of which is under and pursuant
to Sections 4, 5 and 6 of Article XX of the Constitution of the State of
Colorado
Section 2 The said election shall be held at the following places
in said precincts in the City of Fort Collins, Colorado, to-wit
Precinct A-1 - City Hall
Precinct B-1 - Colorado Farmers Supply Building
Precinct B-2 - Laporte Avenue School
Precinct B-3 - Community House at City Park
Precinct C-1 - Courthouse
Precinct C-2 - Junior High School
Precinct C-3 - Unitarian Church
Precinct C-4 - Washington School
Precinct C-5 - A H Dunn School
Precinct D-1 - Remington School
Precinct D-2 - Bethlehem Lutheran Church
Precinct D-3 - Laurel School
Precinct E-1 - State Armory
Precinct E-2 - Mame Harris School
Section 3 The polls shall be opened at the hour of 7 00 otclock A M
and shall remain open continuously and be closed at 7 00 otclock P M of said
day
Section 4 The said election shall be held and conducted as nearly
as may be in the manner prescribed by law in the case of elections for
municipal officers Each elector offering to vote in the said election
must be a qualified elector and must be registered under the provisions of
Session Laws of 1939, page 355, Section 19.
Section 5s The City Clerk of the City of Fort Collins is hereby
constituted supply clerk for said special election, and he is hereby
authorized and empowered to purchase and furnish stationery, ballots,
ballot boxes, poll books and all other supplies necessary for said special
election
Section 6 Upon the passage and adoption of this Ordinance the
City Clerk shall publish notice and call of said special election as herein
authorized in accordance with Section 5 of Article XX of the Constitution
of the State of Colorado
Section 7 All of the ordinances and amendments to the City Charter
submitted hereby to the voters by the City Council for an election shall
be placed upon the same ballot, which ballots shall be uniform in size and
color and shall contain printed thereon in legible type each ordinance or
amendment, which ballots shall be arranged substantially as follows

Voters desiring to vote for any of the following measures or amend—
ments shall mark a cross X in ink in the blank space to the right and
opposite the word "Yes'; voters desiring to vote against any of the following
measures or amendments shall mark a cross X in the blank space to the right
and opposite the word "No " If you wrongly mark, tear or deface this ballot,
return it to the Judges of Election and obtain another

Shall Section seven (7) of Article four (IV) of
the Charter of the City of Fort Collins be amended
by adaing there to the following

by deleting the following words
"and shall be ex—officio City Treasurer"

Shall the salaries of the Commissioners be in—
creased, effective forthwith
If so, shall the City Charter of the City of Fort
Collins be amended in the following particulars
a By amending Section one (L) of Article X to read as
follows
"Section 1 The ex—officio Mayor shall be paid a salary of
$1,500 00 per annum The other two Commissioners shall 4

RAILWAY, AND DISPOSE OF A PART OR ALL THEREOF
AS MAY BE DEEMED ADVISABLE BY THE CITY
COUNCIL OF THE CITY OF FORT COLLINS

INITIATED ORDINANCE NO 2, 1952
BEING AN INITIATED ORDINANCE AUTFOPIZING THE CITY
COUiCIL TO GRfi_NT A P..EVOCABLE PnMIT FOR THE
OPERATION OF BUSSES WITI-IN THE CITY
BE IT ORDAINED BY THE QUALIFIED VOTERS OF THE CITY OF
FORT COLLINS
Section 1 The City Council is hereby authorized to
grant a revocable permit for the operation of busses within
the City limits of the City of Fort Collins Said permit
shall contain such conditions as the City Council may deem

advisable including the folloring to—grit I
(a) The routes shall be agreed upon between the City
I
and the licensee but in no event shall the daily miles
{
covered be less than those now covered by the present trans—
portation system

(b) The licensee shall furnish and deliver to the City

a good ana sufficient surety bond in the penal sum of No I
$10,000 00 to be approved by the Mayor and conditioned 4
that he shall fully conform xnth the permit to be executed,

to the citizens of Fort Collins
(c) The City Council shall have the right and power
to regulate the rates fares, use of transfers, runs and

charges for service and the right to require uniform, con—
venient and adequate service to the public
(d) The licensee shall obtain and file with the City j
Clerk adequate public liability and property dam-ge insurance

fie) Any expense in connection with the granting of
said license shall be borne by the licensee
(f) The licensee shall pay to the City annually for the

use of the streets such amounts as may be fixed by the City
Council, based on a per cent of the years revenue or
flat rate basis
Section 2 All ordinances and parts of ordinances in
conflict with this ordinance are hereby repealed

Section 8 The City Clerk shall make publication and give such notice
and do all acts and things in such manner and form and at such tames as are
prescribed by the applicable provisions of the constitution and laws of the
State of Colorado, and by the charter of the City of Fort Collins. The ballots
cast at said election shall be canvassed and the results ascertained, deter-
mined and certified an accordance with the requirements of the applicable pro-
visions of the constitution and laws of the State of Colorado, and the charter
of the City of Fort Collins
Section 99 In the opinion of the City Council an emergency exists
for the preservation of the public health, peace and safety and this ordinance
shall take effect upon its passage and publication under and by virtue of the
authority contained in Sections 6 and 7 of Article IV of the City Charter
Introduced, read at length and adopted by the unanimous vote of all
the members of the City Council, this 19th day of September, A D 1952

I, MILES F HOUSE, City Clerk of the City of Fort Collins,
do hereby certify and declare that the foregoing ordinance, consisting
of nine (9) sections was duly proposed and read at length at a regular
rmeeting of the City Council held on the 19th day of
September, A D 1952, and was duly adopted and ordered published in
the Fort Collins Coloradoan, a daily newspaper and the official news-
paper of the City of Fort Collins, by the unanimous vote of all
members of the Council, as an emergency ordinance, in accordance
with the provisions of Sections 6 and 7 of Article IV of the City
Charter, and thereafter, on to wit the 23rci day of September, A D
1952, said Ordinance No 9 was published in the Fort Collins
Coloradoan, a daily newspaper published in the City of Fort Collins,
Colorado
IN WITNESS WHEREOF, I have hereunto set my hand and
affixed the seal of said City this 23rd day of September, A D 1952
