BEING AN EMERGENCY ORDINANCE, 111:r,NDING ORDINANCE 110. 8, 1935,
RELATING TO THE FIXING OF A SCHEDULE OF ?.ATES TO BE CHARGED
BY THE CITY OF F02LT COLLIITS, INCLUDING RULES AND REGULATIONS
FOR ALL ELECTRIC SERVICE WITHIN THE CORPORATE LIMITS OF THE
CITY OF FORT COLLINS AND UPON THE FRINGE LINES OUTSIDE OF THE
CITY OF FORT COLLINS CONNECTED WITH THE DISTRIBUTING SYSTEM
OWNED BY THE CITY OF FORT COLLINS, PURSUANT TO THE PROVISIONS
OF SECTION 4 OF ARTICLE XVIII OF THE CITY CHARTER, BY ADDING
TO SECTION 2 THEREOF SCHEDULES NUMBERED 10 , 11, 12 AND 13.
11HEREAS, the City of Fort Collins is the owner
and operator of a Municipal Electric Light and Power System
and has heretofore adopted a schedule of rates and rules and
regulations as contained in Ordinance No. 8, 1935; and
VdIEREAS, the Commissioner of Works and Public
Utilities has recommended that four additional schedules
of rates be adopted by the City of Fort Collins , and the
City Council is of the opinion that said schedules are fair
and reasonable rates.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF TIE CITY OF FORT COLLINS:
Section 1. The City Council finds and determines
that the proposed rates to be charged and collected by the
City of Fort Collins, as set forth in Schedules 10 , 11, 12
and 13 hereinafter set forth, are reasonable rates to be
charged by the said City of Fort Collins and are the lawful
rates for the said City of Fort Collins to charge and collect
from consumers, both within and without the corporate limits
of the City of Fort Collins upon its distribution system,
for light, heat and power furnished to the consumers connected
to said Municipal Light and Power System, insofar as the said
schedules apply to said consumers , and that Section 2 of

Ordinance No 8 , 1935 should be amended by adding thereto
said additional schedules of rates
Section 2 That Section 2 of Ordinance No 8
1935, be and the same is hereby amended by adding thereto
Schedules numbered 10 11 12 and 13 , the same to follow
Schedule No 9 of said Ordinance , and which are as follows

SCHEDULE NO 10
Special ----- Primary
APPLICABILITY
Applicable within the City limits of� Fort Collins
AVAILABILITY —3
Available for alternating current , 60 cycle power
only Service to be taken at one point of delivery only and
metered at voltage of City' s primary distribution system
Not available for standby or resale service
RATE
First 20 ,000 KWH used per month per MM 24 cents
Next 10,000 a it it it ^ e 2 cents
If current used in any one calendar month exceeds
30,000 M, City' s Primary rate #6 to be applied

Net minimum cnarge for any calendar month per
meter per month $200 00
DELAYED PAYMENT CHARGE
To all bills not paid within ten days from date of
bill, there will be added five percent of the first $200 00
and 2% of the amount in excess of � 200 00
CONTRACT PERIOD
All contracts under this schedule shall be for a
minimum period of six months and thereafter until terminated,
where service is no longer required, on three days written
notice by either party
RULES AND REGULATIONS
It is specifically understood that the customer is
to hold the power factor of his motors to as near 80% as
possible with the above rate schedule

POINT OF MEASUREMENT
All current , under Schedule 10 shall be considered
as measured at the voltage of the City' s established Drimary
distribution system at the point where service is delivered
TRANSFORI &RS
Customers who do not guarantee to use service for 12
months each year under Schedule 10 shall be required to
furnish and maintain transformers for stepping-down voltage
from that furnished by City' s primary distribution voltage to
that required by customer' s installation
City shall not be required to furnish transformers in
any case unless they are of standard size and voltage
POWER FACTOR
Should the average monthly power factor or unbalance
between phases of the customer' s installation fall below 80%
under Schedule 10 the demand or contract horse-power shall
for purpose of billing be increased in the ratio of 80% to
the actual average power factor of unbalance

CONTRACT PERIOD
All contracts under this schedule except when a
line extension other than a service loop is required, shall
be made for a period of thirty (30) days , automatically
renewed for like periods provided the customer complies
with the special rules and regulations

SPECIAL RULES AND REGULATIONS
Under this schedule the customer agrees to install and
use service for hot water heating or cooking The cooking
unit shall be a standard electric range 5 kilowatts or
larger or a regulation 30 gal or larger, hot water heater
It is further agreed by the customer that the hot water heater
shall be regulated automatically by the department on peak
loads Peak loads shall be considered from sundown to 9 00
P M , or as otherwise specified later The department reserves
the right to put in either automatic meter control or other
electric control for regulation during peak hours on hot water
heater only
115-230 volt motors used on house appliances of either
split phase type or repulsion-induction type up to a HP are
included in this rate Other motors up to One HP subject to
inspection by the department
Consumer desiring service under this schedule shall make
written application therefor and subject their residence to
an inspection by the department if required
SCHEDULE NO 12
Special Hot Water Heater Rate
AVAILABILITY
Available for Clubs Sororities Lodges Hotels, or
other business houses
RATE (Net)

All contracts under this schedule except v�hen a line

for a like period but terminable thereafter when service is
no longer required on three day' s written notice
SPECIAL RULES AND REGULATIONS
Under this schedule the department reserves the right

to automatically control the service during peak hours
Peak hours considerea from sundown to 9 00 P M or as
otherwise specified later No other device shall be used
on this schedule other than the hot water heaters The
customer agrees to install such hot water heating device ,
standard 20 gal tanks or larger on a separate meter
service 115-230 volt service
It is understood by the customer that this special
hot water heating rate shall not affect other commercial
scheaules now in effect by the department in any way

Section 3 In the opinion of the City Council an
emergency exists for the preservation of the public health peace
and safety and this ordinance shall take effect upon its passage
under ana by virtue of the authority contained in Sections 6 and
7 of Article IV of the City Charter
Introduced, read at length and adopted by the
unanimous vote of all members of the City Council at a regular
meeting held this 29th day of January A D 1937

foregoing Ordinance consisting of three (3) sections was
duly proposed and read at length at a regular meeting of the
City Council, held on the 29th day of January A D 1937 and
was duly adopted and ordered published in the Fort Collins
Express-Courier, a daily newspaper and the official newspaper
of the City of Fort Collins by the unanimous vote of all
members of the City Council as an emergency ordinance in
accordance witn the provisions of Sections 6 and 7 of Article
IV of the City Charter and thereafter and on to-wit the
2nd day of February , A D 1937 , said Ordinance No 2
was duly published in The Fort Collins Express-Courier a daily
newspaper published in the City of Fort Collins Colorado
