BEING AN EMERGENCY ORDINANCE, AMENDING ORDINANCE NO 301 19241
ORDINANCE NO 17 1925 AND ORDINANCE NO 6 1926 , REIATING TO
THE BUILDING CODE FOR THE CITY OF FORT COLLINS, PROVIDING RULES
AND REGULATIONS THEREUNDER, PENALTIES FOR VIOLATION THEREOF AND
REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
HEREWITH
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That Section 3 of Ordinance No 30 ,
1924, be and the same is hereby amended by adding thereto the
following, to-wit
"The shingling or reshingling of any building
or structure or part thereof, shall be construed to con-
stitute a construction or alteration requiring a permit
as herein provided rr
Section 2 That part of Ordinance No 30 1924,
as amended by Section 13 of Ordinance No 17 , 1925, be and the
same is hereby amended to read as follows , to-wit
"Section 158a Applications--Permits
Before any heating or air-conditioning work is
started, except in case of minor repairs or leaks, the person
firm or corporation, responsible for such work shall file with
the Building Inspector an application for a permit for each
separate ,job , giving tr et number and the n of the owner
of the premises Sucp�lsall b Lj with plans ,
drawings , specifications or descritition of the proposed work
The applicant shall pay the sum of one dollar upon the issuing
of any such permit authorizing installation of any air-con-
ditioner or equipment similar thereto or work upon not more than
six registers or radiators, the sum of ten cents for each addition-
al fixture In the case of air-conditioning where connections
are made whether permanent or temporary to the plumbing system
for the purpose of using water either in basin or by pipe, the
Building Inspector must be notified by the person doing such
work when the work is ready for inspection and all work for
which a permit is issued must be left uncovered and convenient
for examination until inspected and approved In case of any
violation of this regulation, the permit granted for the work
may be revoked upon the order of the Building Inspector, and
upon notice of said revocation being given, all heating work on
said building must cease Any person violating any of the pro-
visions of this section shall be fined not less than five dollars
nor more than fifty dollars for each offense TM

Section 3 That Sections 175, 176 176A, 178
and 180 of Ordinance No 301 1924 as amended by Ordinance No
173 1925 and Ordinance No 69 1926 , be and the same are hereby
amended to read as in this Section set forth and Part XKIII of
Ordinance No 30, 1924, be and the same is hereby amended by
adding thereto Sections 175A, 175B 1771) 177 A 180A 180B ,
180I , 1801
180C 180D 180E 180F, 180G, 180H/and 182A as follows, to-wit
"Section 175 - Duties of Electrical Inspector
All electrical wiring in the City of Fort Collins
shall be under the supervision of the Building Inspector and
must conform with the rules and regulations of the National
Board of Fire Underwriters , known as the 'National Electric
Code '
The 'National Electric Code' as now existing
and with all future modifications thereof is hereby made a
part of this Ordinance, except that concealed wiring known
as 'knob and tube' system, shall not be permitted in houses
costing $2500 00 or more Meters house service and meter
connections shall be located, installed and connected in
accordance with the requirements of this ordinance and the
Building Inspector
The installation, maintenance or alteration of
any and all electric wiring, connections apparatus or ecuip-
ment used in connection therewith, in, on, or attached to any
building and above , beneath and upon the surface of the streets
alleys and places within corporate limits of the City of Fort
Collins shall be under the supervision of the Building
Inspector, who shall also be the electrical inspector who is
hereby directed, authorized and empowered to enforce the pro-
visions of this Ordinance "
"Section 175A - Re-Inspections
The electrical inspector periodically shall make
a thorough examination of all the electrical wires and appliances
installed within the City of Fart Collins and when such wires
or appliances are found to be in a dangerous or unsafe condition,
he shall notify in writing the person, firm or corporation own-
ing, using operating or installing the same to place them in
safe condition Any person, firm or corporation failing or
refusing to make the necessary repairs or changes , and have
such work completed within 5 days or any longer period which
may be deemed reasonable by the electrical inspector, after the
receipt of said notice , shall forfeit and pay into the City of
Fort Collins , a sum of $5 00 for each day which shall elapse
after the expiration of said period, and the electrical inspector
is hereby empowered with authority to order the discontinuance
of electrical service to such defective wires or appliances
until they have been repaired, removed or changed as directed
by the electrical inspector subject to the limitation of this
Ordinance

"Section 175B - Right of Access to Building
Said electrical inspector shall have the right
during reasonable hours, to enter any public or private
buildings in the discharge of his official duties or for the
purpose of making any inspection or test of the electrical
wires and appliances contained therein and shall have the
authority to cause the turning off of all electrical currents
and cut or disconnect , in cases of emergency any wire where
such electrical currents are dangerous to life or property or
may interfere with the work of the fire department "
"Section 176 - Permits to Engage in Business
No person, firm or corporation shall be granted
a permit or engage in the business of installing electric
wiring, appliances or electrical apparatus of any nature kind
or description, inside of or on any building or buildings within
the corporate limits of the City of Fort Collins (except central
station, power houses substation, or car barns) for the purpose
of transmitting or utilizing electric current for light, heat
power, or electrical signal systems or other purposes unless
such person, firm or corporation shall have given bond and
received license as hereafter provided "
"Section 176A- Licenses and Bonds
Any person firm or corporation desiring to engage
in the business of contracting for or installing altering or
repairing electrical wiring and apparatus, shall first make
application for a license in writing to the City Clerk, stating
the name of person firm or corporation making application,
place of business, and any other information requested by the
City Clerk Such application shall be accompanied by good and
sufficient bond in the penal sum of one thousand dollars
($1,000 00) with a surety company as surety, conditioned that
all electrical work installed by said person, firm or corporation
or his or its employees shall be in accordance with the require-
ments of this ordinance and such application shall be accompanied
by an annual license fee of one hundred dollars ($100 00) Upon
compliance with the above provisions , the applicant shall be
given by the City Clerk, a License Card good for a period of
one year, subject to revocation by the Electrical Inspector at
any time if the holder thereof falls to comply with the pro-
visions of this Ordinance "
"Section 177 - Examination and Registration of
Electricians
Any and all electricians before engaging in the
installation of electric wiring, apparatus or appliances shall
first pass a satisfactory examination, compiled and given by the
Electrical Inspector or a Board appointed by the City Council
Upon completion of a satisfactory examination the applicant
shall be given a registration card, stating that he has passed
a satisfactory examination and granting permission to the appli-
cant to engage in the installation of electric wiring, apparatus
or appliances in the City of Fort Collins, for a period of one
year, subject to revocation at any time by the Electrical
Inspector or Examiners Board for failure to comply with the

provisions of this Ordinance A fee of ten dollars ($10 00)
shall be charged for this examination, and shall be collected
annually thereafter No electrician shall be permitted to do
any electrical work unless holding a license under Section 176A
or employed by one licensed under Section 176A
No apprentice electrician while in the performance
of his duty shall work upon any job while not under the super-
vision of a jglirneyman electrician, either in the installation
of new work mm repair work
No more than four apprentice cards shall be issued
to any one person At the expiration of four years of continuous
service as an apprentice electrician, said apprentice shall present
himself for examination as a journeyman electrician "
"Section 177A - Application for Permits
Before any electrical construction work is started,
either the installation of new apparatus or the repairing of
apparatus already in use , the person or corporation responsible
for such work shall file with the Electrical Inspector an appli-
cation for a permit, describing in detail the material and appli-
ances intended to be used Such application shall give the location
of the work by street and number and shall be countersigned by the
person under whose supervision the work is to be done and if found
proper and conforming to the rules and regulations contained herein
and the National Electrical Code, a permit shall be issued by the
Electrical Inspector No such work shall be permitted unless under
the supervision of a duly qualified journeyman
Electrical Contractors shall furnish such t)lans and
specifications of proposed work as may be deemed necessary by the
Electrical Inspector before any permit for same shall be issued
It shall be unlawful for any person firm or corporation
to allow any person not registered as a journeyman electrician,
apprentice electrician or helper to work on any permit obtained
by any licensed electrician "
"Section 180 - Fees for Inspection and Permits
In order to procure a permit for the installation of
electrical wiring, the said companies, firms, co-partnerships, cor-
porations or individuals shall, before having any electrical work
commenced or any addition made to old wiring, make written appli-
cation to the Electrical Inspector and shall pay the Department
the amount as required by the following schedule
For inspecting apparatus for which no fee is herein
prescribed the Inspector shall charge two dollars ($2 00) for the
first hour, or part thereof and one dollar ($1 00) for each addition-
al hour, or part thereof engaged in making the inspection When
an addition or change is made to work on which a certificate has
been issued where a permit was not issued for the addition, the
original certificate shall be canceled and the regular fee charged
for reinspecting the original work and additional work
All switches will be classed as outlets

Twenty-five (25) cents will be charged for the first fixture

TEMPORARY WIRING
Temporary wiring fees will be half of regular fees with no charge
for fixtures attached thereto and no fee shall be more than $10 00
for any one installation
Temporary permit will only be issued for 30 days
When temporary light is desired when all fixtures are not installed,
a permit for all fixtures to be installed must be taken out This
rule will also apply to motor installations
For reinspection on account of corrections, fifty (50) cents "
Section 180A - Certificates of Inspection
On the completion of the work covered by a permit
in accordance with the rules of this Ordinance and to the satis-
faction of the Electrical Inspector, said Electrical Inspector shall

issue a certificate of inspection In this certificate said
Electrical Inspector shall certify that the work is in accordance
with the rules covering the respective class to which it belongs
as specified by this Ordinance Whenever a permit is issued for an
addition to old work which does not conform to the rules as laid
down in this Ordinance , the Electrical Inspector shall issue a
statement that the new work complies with the rules but that
certificate cannot be issued owing to its connection with the old
work, which does not comply with the rules of the Electrical
Inspector "
"Section 180B - Construction Reouirements
No certificate of inspection shall be issued for
any new electrical construction unless all materials, apparatus
and devices used in connection with such construction are approved
and listed by the Underwriters' Laboratories ( or other electrical
testing laboratory satisfactory to the Electrical Inspector) and
unless all electrical construction wiring methods and workmanship
conform to such rules and regulations as are embodied in this Ord-
inance
The latest editions of the National Electrical Code
of the National Board of Fire Underwriters the Electrical Bulletins
of the Mountain States Inspection Bureau and the National Safety
Code of the Bureau of Standards shall be at all times as authorities
for determining questions arising as to details of electrical con-
struction except as otherwise provided in this Ordinance "
"Section 180C - Arbitration
The Chief Electrical Inspector shall be deemed the
,judge of what constitutes proper compliance with the provisions of
this Ordinance but should any person or persons disagree with the
findings of the Electrical Inspector, such person or persons will
have the right to submit to the City Council in writing any exception
they may have to findings of the Electrical Inspector The City
Council shall arbitrate such matters ana their findings shall be
final
The Chief Electrical Inspector is hereby authorized
to make such additional working rules and regulations with the
approval of the City Council for the guidance of the electrical
contractors and wiremen as he may deem necessary "
"Section 180D - Approved ialLterials and Appliances
All electrical materials and appliances used in the
installation of electric wiring systems or in connection with such
systems and all electrical materials and appliances sold or offered
for sale either in person of by agents clerks or employees in the
City of Fort Collins, shall be approved and listed by the Under-
writers Laboratories or by some other disinterested and properly
equipped electrical testing laboratory satisfactory to the Electrical
Inspector of the City of Fort Collins It is not the intent of
this provision to require that ordinary motors meters and such
devices which are not included in the list of inspected appliances
issued by the Underwriters Laboratories, shall be approved, but it
is the intent of this Ordinance to require that wiring materials
and devices such as those included in the list of "Inspected
Electrical Appliances" issued by the Underwriter' s Laboratories
shall be approved "

"Section 180B - Electric Services
(a) All electric services hereinafter installed
for buildings located whether within or without the city fire
limits and within the corporate limits , shall be in approved
rigid conduit
(b) This service device shall be located within
the buildings or within an enclosed back porch so constructed and
arranged as to afford adequate protection from the weather
(c) In no case shall fuse panels or fuse cabinets
be placed in clothes closets or enclosed where they will not be
readily accessible or in plain view
(d) The service cabinet shall be so located that the
handle of the service switch shall not be over seven feet above
a permanent floor
(e) Underground service shall be protected from
mechanical injury by galvanized metal conduit or the ducts and
protected from moisture by a lead sheathing
(f) All service wires shall be rubber covered and
for overhead services the rubber covering shall extend from the
service switch to at least the first point of support clear of
conduit on the outside of the building The neutral conductor of
No 6 or smaller shall have the outer covering finished to show a
white or natural grey color Service wires shall not be smaller
than No 8 '
"Section 18OF - Wiring Methods
(a) All electric wiring, including additions,
extensions or changes in existing wiring, hereafter installed for
transmission of electric current for light heat or power in or
on all buildings located within the corporate limits of the City
of Fort Collins, shall be approved rigid conduit electrical
metallic tubing or metal moulding with the following exceptions
( 1) One and two family dwellings , private garages and
outbuildings used in connection therewith may be wired with
approved metal armored cable (BX) or with approved concealed
knob and tube construction, except service runs which Oust be
in accordance with Section 13 Concealed knob and tube wiring
shall not be permitted for electric range circuits
(2) Metal armored cable (BX) may be used for ' fished'
work in dry places in retwiring any now existing buildings out-
side the Fire District All wiring in the Fire District shall
be in rigid and metal conduit BX will not be permitted for
exposed wiring in any building Conduit shall be used in wiring
show-cases counters or fixtures within the Fire District
(b) Branch lighting and appliance circuits shall be
limited to 1000 watts per circuit with not more than 10 current
consuming outlets per circuit Each outlet shall be considered
at not less than 100 watts These circuits shall be protected by
fuses or automatic circuit-breakers having a rated capacity or
adjusted for not greater than 15 amperes

(c) Branch lighting circuits in cases where No 14
rubber covered or No 16 slow-burning wire from circuit wires
is carried directly into keyless sockets or receptacles and where
the location of the outlets is such as to render unlikely the
attachment of portable devices or appliances thereto, the circuit
load may be 1500 watts providing the circuit conductors are not
smaller than No 12 These circuits shall be protected by fuses
having a rated capacity not greater than 20 amperes
( d) Branch lighting circuits supplying only sockets
or receptacles of the mogul type with wires not smaller than No
12 used for wiring the fixtures and for taps not over 18 inches
long from circuit wires may have not to exceed eight (8) mogul
sockets or receptacles on one circuit These circuits shall be
protected by fuses having a rated capacity of 40 amperes providing
the rated capacity of the fuses do not exceed the safe carrying
capacity of the circuit wires
(e) Branch lighting circuits and combination branch
lighting and appliance circuits shall be only two wire circuits
and the neutral conductors of these circuits shall not be inter-
connected except at the center of distribution
(f) For the purpose of determining the size of con-
ductors of services feeders and sub-feeders, each branch circuit
shall be considered as carrying full connected load but with a
minimum of 1000 watts per circuit
(g) Conductors for inside wiring systems shall be
of sufficient capacity to produce not to exceed 2% drop in voltage
between the service devices and the farthest outlet on circuits
(h) Grounding The neutral conductor of all two
or three wire single phase alternating current systems shall be
grounded at each individual service This grounding connection
shall be made to the neutral service conductor in the service
cabinet on the supply side of the service switch
(1) The grounding conductor shall be an insulated
copper conductor with a safe carrying capacity not less than
one-fifth that of the service conductor to which it is attached
In no case shall the grounding conductor be smaller than No 8
Shall be extended without joint or splice to a suitable water
pipe or where water pipes are not available to an approved
grounding rod or pipe driven into permanently moist earth
(2) The grounding conductor shall be properly protected
from mechanical injury and the connection made to the water pipe
or grounding electrode by means of an approved ground clamp or
fitting Where practicable the point of connection shall be
readily accessible This grounding conductor may also be used
to ground the conduit system In all cases grounding connections
shall be made to the service conduit or service cabinet by means
of approved grounding fittings or lugs
(3) The neutral conductor of an interior wiring system
shall be connectea from one point only, within the building to
the grounding pipe or electrode
(4) The neutral conductor shall not be used for ground-
ing electrical appliances or devices "

"Section 18OG - Service Connections
It shall be unlawful for any person, firm or
corporation to make any electrical connection or supply electric
current , to any wiring system or portion thereof hereafter
installed, in or on any building within the corporate limits of
the City of Fort Collins without first securing written permission
or inspection certificate from the Electrical Inspector of the
City of Fort Collins "
"Section 180H - Electric Signs
Any person, firm or corporation desiring to erect
or hang any electric sign or signs in, on or over any building
or buildings within the corporate limits of the City of Fort
Collins shall secure a permit from the Electrical Inspector and
shall furnish said Inspector such information as he may desire
regarding size and weight of sign method of supporting and
securing etc All electric signs must bear the Underwriters
Laboratories label of approval, and be grounded to a Permit
System ground All such signs must be passed and approved by
the inspector of the Municipal Light and Power Department for
power factor correction of transformers
Neon signs shall be properly equipped to avoid all
unnecessary and reasonably preventable radio interference and
have the latest corrective devices for correction of lagging
power factor "
"Section 180I - Int�rfsranco %ith Radio Deception
That it shall be unlawful for any person firm
co-partnership association or corporation knowingly or wantonly
to operate or cause to be operated any wire or wires for carrying
electric energy, or any machine, device apparatus or instrument
of any kind whatsoever within the corporate limits of the City of
Fort Collins , Colorado , the operation of which shall cause reason-
ably preventable electrical interference with radio reception
within said municipal limits, Provided, however, that X-ray
pictures, examinations or treatment may be made at any time if
the machines or apparatus used therefore are properly equipped
to avoid all unnecessary or reasonably preventable interference
with radio reception and are not negligently operated The
Building Inspector of the City of Fort Collins, or any person
designated by the governing body of such City for such purpose,
shall have the right at any reasonable hour to enter any place
of business or other premises in the City of Fort Collins for
the purpose of inspecting or locating or attempting to locate
any wires, machine , device, apparatus or instrument of any kind
whatsoever which is or may be kept or operated on any such
premises in violation of the provisions of this ordinance , and
any person who shall prevent or attempt to prevent such Building
Inspector or any person designated by the governing body of such
City for such purposes, from entering any premises in the City of
Fort Collins, shall be deemed guilty of a violation of this
Ordinance and each day during which such violation continues
shall constitute a separate offense

That this Ordinance shall not be held or con-
strued to embrace or cover the regulation of any transmitting,
broadcasting or receiving instrument apparatus, or device used
or useful in interstate commQrce or the operation of which
instrument , apparatus, or device is licensed or authorized by or
under the provisions of any act of the Congress of the United
States TM
"Section 180J - Light and Power Department Exempt.
The provisions of this Ordinance shall not apply
to construction by the Municipal Light and Power Department "
Section 4 That Sections 207, 209 and 223 of
Ordinance No 30 , 1924, as amended, oe and the same are hereby
amended to read as follows , to-wit
"Section 207 - Applications and Permits
Before any plumbing work is started, except in
the case of repairs or leaks , the person firm or corporation
responsible for such work shall file with the Building Inspector
an application for a permit for each separate ,job , except for
water and sewer connections made under the supervision of City,
giving street number and the name of the owner of the premises
Such permit shall be issued only on the order of the Building
Inspector, who shall be furnished with plans, drawings specifi-
cations or description of the proposed work The applicant shall
pay the sum of one dollar and fifty cents upon the issuing of
any such permit authorizing work upon not more than five fixtures,
and the sum of twenty-five cents for each additional fixture
Floor drains and shower bath heads shall be considered as fixtures
In the case of changing fixtures it shall be fifty cents per
fixture where the fixture is only taken off and a new fixture
installed providing, however, that the fixture removed is properly
trapped and vented If not properly trapped and vented, same shall
be made to comply with the plumbing code of the State of Colorado
and Ordinances of the Citj of Fort Collins
The Inspector must be notified by said plumber
doing work when the work is ready for inspection All work must
be left uncovered and convenient for examination until inspected
and approved In case of any violation of this regulation the
permit granted for the work may be revoked upon the order of the
Inspector, and upon notice of said revocation being given all
plumbing work on said building must cease Any person violating
any of the provisions of this section shall be fined not less than
five nor more than fifty dollars for each offense No permit shall
be issued to other than a duly licensed master plumber to connect
to any public sewer, and all such connections shall be made in the
presence of the Building Inspector or his representative TM

"Section 209 - License Fee for Master Plumbers
Journeyman Plumbers and Apprentice
Plumbers - Bond
Before any master plumber' s license shall be
granted by said City Clerk, there shall be deposited with the
City Clerk an annual license fee of 025 00 and every person so
applying for such license shall file with the City Clerk a
petition in writing, stating his name , place of business and
asking to become a licensed master plumber All journeymen
plumbers and apprentice plumbers shall be required by the City
of fort Collins to register with the City Clerk for a license
card paying $3 00 per year and must work under the supervision
of a master plumber, who has been licensed and bonded Any person
firm or corporation hiring apprentice plumbers shall register
same with City Clerk, paying the fee of 43 00 per annum and no
more than four apprentice cards shall be issued to any one person
At the ex-oiration of four years of continuous service as an
apprentice , said apprentice shall present himself for examination
as a journeyman plumber No apprentice plumber while in the
performance of his duty, shall work upon any ,lob while not under
the supervision of a journeyman plumber, either in the installation
of new work or re-oair work Said petition of master plumber shall
be accompanied by a bond to the City and shall be in the sum of
$10000 00 with a surety company as surety to be approved by the
Mayor, conditioned for the faithful performance of the duties
required by ordinance , rule or regulations of the Building
Inspector, and that he will suitably guard and protect any ex-
cavations or obstructions and defend, save and keep harmless
the City of and from all actions suits, costs, and damages, and
expenses which shall or may at any time happen or comd to it for
or on account of any injury or damage received or sustained by
any person caused by the negligence or from any unfaithful or
inadequate work done under his license "
"Section 223 - [taste Pipes Kitchen sinks Grease
b traps
Waste pipes from kitchen sinks of other fixtures
in restaurants, hotels, boaraing houses butcher shops slaughter
houses, packing houses creameries butter factories bakeries or
other places where greasy waste is discharged shall be connected
to an approved grease trap the clarification of greasy water
capacit3 of which shall not be less than sixty gallons per hour
ana shall be larger if found necessary by the Plumbing Inspector
Such grease traps shall be constructed with suitable baffle plates
sediment guides and ribs loose cover and flat slanting channelled
bottom so as to effectively separate grease and sediment and prevent
same from entry into a drainage system Grease traps shall be served
with a waste pipe not smaller than two inches in diameter Garages
and filling stations where car washing is being done shall be equipped
with the secondary sand and grease trap with a tight cover with lock
and key which key shall be held by the City of Fort Collins and
opened only by an authorized inspector from the City The inlet
pipe to the secondary trap shall be four inches cast iron extra
heavy, the outlet to house sewer shall be four inches cast iron
extra heavy Each secondary trap shall have a two inch cast iron
extra heavy vent four inches from under side of lid The discharge
side of secondary grease trap shall be located four inches below
the inlet and eighteen inches of extra heavy cast iron soil pipe
caulked in with a four inch vent caulked into a four inch extra
heavy cast iron tee on the house side of eewer Secondary trap

shall be no less than two feet inside diameter and six feet
deep There shall be provided in the pouring of concrete in
the making of this trap four secured bolts of not less than
one-half inch in diameter and twelve inches long holding lid
in firm place The thickness of concrete on the wall of trap
shall not be less than four inches and in the four to one
mixture of concrete it
Section 5 That Section 8 of Oidinance No 30
1924, be and the same is hereby amended to read as follows,
to-wit
"Section 8 - Fees for Permits
The amount charged for a permit to construct ,
erect enlarge , remodel, alter or repair any wall, structure,
building or part thereof shall be one dollar and fifteen cents
($1 15) for the first hundred dollars and fifteen cents a hundred
dollars thereafter of the estimated total cost of the labor and
material required for the proposed work For the purposes of
fixing the fees, the estimated cost shall be determined by the
Building Inspector as follows He may accept an estimate
furnished him by the applicant for the permit , or he may require
a certificate from a licensed architect or engineer or an affi-
davit from the owner or his agent of the total cost of the pro-
posed work or he may make such estimate as Building Inspector
The amount to be charged for permits to move , raise lower , under-
pin, or wreck a building or structure shall be as follows
(a) For moving habitable buildings or structure,#within
the area of any one lot $1 50
(b) For moving over upon or in any public highway
buildings or structures one and one-half stories or less
in height 7 00
(c) For moving over, upon or in any public highway
buildings of structures of more than one and one-half
stories in height 17 00
(d) For raising, lowering of underpinning any
habitable building or structure 2 00
(e) For permits to wreck habitable buildings or
structures outside the fire limits or any building or
structure inside the fire limits the fee shall be $"2 00
plus 5 cents per 1000 cubic feet of the contents of the
building or structure
The amounts to be charged for permits to install
construct , reconstruct , repair , enlarge or widen driveways
leading from or to a City Street, shall be $1 00 per lineal
foot , and no driveway leading from or to a City Street shall
be installed, constructed reconstructed, repaired, enlarged or
widened without the owner thereof first obtaining a permit and
paying the fee herein fixed
In addition to the permit fees named above there
shall be paid to the City Clerk for the use of water, such amounts
as are fixed by the tariff of water rates now in force or as same
may be amended All additional expense to the City of FortCollins
caused by the erection of buildings shall be borne by the owners
of such buildings

Section 6 That Section 29 of Ordinance No 30 ,
1924 be and the same is hereby amended by adding thereto the
following, to-wit
"The location of all new construction as shown on
the approved plot diagram or an approved amendment thereof,
shall be strictly adhered to It shall be unlawful to reduce
or diminish the area of a lot or plot of which a plot diagram
has been filed and has been used as the basis for a permit ,
unless a revised plot diagram showing the proposed change in
conditions shall have been filed and approved, provided that
this shall not apply when the lot is reduced by reason of a
street opening or widening or other public improvement It
Section 7 All licenses issued pursuant to the
Building Code shall expire December 31st of each year and any
part of a year shall be determined as one year
Section 8 General Penalty for Violation
Any person, firm or corporation violating any of
the sections or provisions of the Building Code shall be subject
to the specific penalty provided for the particular violation, if
such penalty is prescribed, and if no specific penalty is pre-
scribed, shall on conviction of such violation be fined in a sum
of not less than ten ($"10 00) Dollars, and not more than three
hundred ($300 00) Dollars for each and every offense , and for
each day any such violation continues he or they may be charged
and found guilty of a separate and distinct offense
Section 9 Repeal of Conflicting Ordinances
All ordinances or parts of ordinances conflicting
with the provisions of this ordinance are hereby repealed
Section 10 In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety, and this ordinance shall take effect upon its
passage , under and by virtue of the authority contained in
Sections 6 and 7 of Article IV of the City Charter

unanimous vote of all members of the City Council, at a regular
meeting held this 28th day of May, 1937

as an emergency ordinance , in accordance with the provisions of
Sections 6 and 7 of Article IV of the City Charter, and there-
after and on to-wit the 2nd day of June , A D 19379 said
Ordinance No 9 was duly published in The Fort Collins
Express-Courier, a daily newspaper published in the City of
Fort Collins , Colorado
