BEING AN EMERGENCY ORDINANCE AMENDO DINANCE NO 5, 1946,
AS AMENDED, RELATING TO THE SALE OF MILK.AND MILK PRODUCTS
AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT HEREWITH
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
SECTION 1 That Section 1-A of Ordinance No. 5, 1946, be amended by
deleting the following words, to-wit "which contains not less than 8 percent
of milk solids not fat", substituting therefor the following "which contains
not less than 8 5 percent of milk solids not fat"
SECTION 2 That Section 1-T of Ordinance No 5, 1946" be amended by
deleting the following words, to-wit "provided that the grading period shall
in no case exceed six months", substituting therefor the following "provided
that the grading period shall in no case exceed one month It
SECTION 3 That Section 6 of Ordinance No 5, 1946, be amended by
deleting the following words, to-wit "During each grading period at least four
samples of milk and cream from each dairy farm and each milk plant shall be taken
on separate days and examined by the food inspector", substituting therefor the
following "At least once during each calendar month one sample of milk and
cream from each dairy farm and each milk plant shall be taken and examined by
the food inspector "
SECTION 4 That Section 7 of Ordinance No 5, 1946, be amended in the
following particulars, to-wit
(a) By deleting the following words, to-wit "At least once every 6
months the food inspector shall compute the average grades of all milk and milk
products delivered by all distributors and ultimately consumed within the City
of Fort Collins, or its police jurisdiction", substituting therefor the following,
to-wit "Each month the food inspector shall compute the average grades of all
milk and milk products delivered by all distributors and ultimately consumed
within the City of Fort Collins, or its police jurisdiction 11
(b) By amending the definition of Grade A raw milk to read as follows
GRADE A RAW MILK "Grade A raw milk is raw milk, the average bacterial
plate count of which, as determined under Sections 1(S) and 6 of this ordinance,
does not exceed 50,000 per cubic centimeter, or the average direct microscopic
count of which does not exceed 50,000 per cubic centimeter if clumps or colonies
are counted or 200,000 per cubic centimeter if individual organisms are counted,
or the average reduction time of which is not less than 8 hours, provided that if
it is to be pasteurized the corresponding limits shall be 80,000 per cubic centi-
meter, 320,000 per cubic centimeter and 6 hours, respectively, and which is pro-
duced upon dairy farms conforming with all of the following items of sanitation "
(c) By deleting in item 26 R under the definition of Grade A

pasteurized milk the following words, to-wit "the average bacterial plate count
of which at no time after pasteurization and until delivery exceeds 30,000 per
cubic centimeter as determined under Sections l(s) and 6", substituting therefor
the words "the average bacterial plate count of which at no time after pasteuriza.•
tion and until delivery exceeds 15,000 per cubic centimeter as determined under
Sections 1(S) and 6 "
Section 5 � That Section 10 of Ordinance No* 5, 1946, be and the same is
hereby amended to read as follows, to-wit
"SECTION 10 MILK AND MILK PRODUCTS FROM POINTS BEYOND THE LIMITS OF
ROUTINE INSPECTION Milk and milk products beyond the limits of routine inspection of
the City of FortrCollins may not be sold in the City of Fort Collins unless
produced and,/or pasteurized under provisions equivalent to the requirements of
this ordinance, and provided further that the food inspector shall satisfy himself
that the health officer having jurisdiction over the production and processing is
properly enforcing such provisions "
SECTION 6 That Section 14 of Ordinance No 5, 1946, be and the same is
hereby amended by adding thereto the following, to-wit "Licenses of producers
beyond the limits of routine inspection by the City of Fort Collins shall be

waived provided such producers are licensed by their respective inspecting
authorities ^
SECTION 7 AMENMMNT AND REPFAAL
,,Ordinance No 5, 1946, as amended, is hereby further amended as in this
Ordinance provided, and all Ordinances and parts of Ordinances in conflict with
this Ordinance are hereby repealed
SECTION 8 DATE OF EFFECT
In the opinion of the City Council an emergency exists for the preser-
vation of the public health, peace and safety, and this ordinance shall take effect
upon its passage under and by virtue of the authority contained in Sections 6 and
7 of Article IV of the City Charter
SECTION 9 UNCONSTITUTIONALITY CLAUSE
Should any section, paragraph, sentence, clause, or phrase of this
ordinance be declared unconstitutional or invalid for any reason, the remainder
of said ordinance shall not be affected thereby
Introduced, read at length, and adopted by the unanimous vote of all
adjourned
members of the City Council, at an meeting of the City Council, held this

paper of the City of Fort Collins, by the unanimous vote of all members of the
City Council, as an Emergency Ordinance, in accordance with the provisions of
Sections 6 and 7 of Article IT of the City Charter, and thereafter and on, to-wit
the 2nd day of March , A D -1954, said Ordinance No 5 was
duly published in the Fort Collins Coloradoan, a daily newspaper published in
the City of Fort Collins, Colorado
