BEING AN EMERGENCY ORDINANCE VACATING A PORTION OF LINCOLN AVENUE AND A
PORTION OF WILLOW STREET ADJOINING BLOCK 15, CITY OF FORT COLLINS, COLORLDO
WHEREAS, a portion of Willow Street and a portion of Lincoln Avenue
were heretofore vacated by a certain ordinance, being Ordinance No 1, 1945,
and
WHEREAS the Colorado Milling and Elevator Company is the owner of
that portion of Block 15 which adjoins the following portions of Willow Street
and Lincoln Avenue, to-wit
F11 that portion of Willow Street in the City of Fort Collins,
Colorado, adjoining a portion of said Willow Street, which was
vacated by Orainance No 1 1945, and is contained within
boundary lines which begin at the Southeast corner of Block 15
in the City of Fort Collins, Coloraao, and run thence N 58 40t
IT 150 00 feet, thence S 31 20t W 16 00 feet, thence S 58 401
E 108 45 feet thence S 71 20t E 41 35 fee' and thence N 41
101 E 7 04 feet to the point of beginning, containing 0 05 acres
more or less and subject to the right of way of the Colorado and
Southern Railway Company,
All that portion of Lincoln Avenue, in the City of Fort Collins,
Coloraao, adjoining a portion of said Lincoln Avenue which was
vacated by Ordinance No 1, 1945 and is containea within boundary
lines hhich begin at the Southeast corner of Block 15, in the City
of Fort Collins, Colorado, and run thence N 88 35t E 78 00 feet,
thence S 74 351 IT 59 40 feet, thence N 71 20T W 26 75 feet ana
thence N 41 101 E 7 04 feet to the point of beginning, containing
0 015 zc~es more or less and subject to the right of way of the
Colorado and Southern Railway Company,
PND, WHEREAS, the Colorado Milling and Elevator Company, through the
local manager of the Denver Elevators Company, a branch of said Colorado Nulling
and Elevator Company has filed a petition for the vacation of the above aescribea
portions of Lincoln Avenue and Willow Street, and
WHEREAS, said portions of Lincoln Avenue and Willow Street have never
been opened to the public and have never been used for street purposes, and
WHEREAS said portions of Lincoln Avenue and Willow Street are not
necessary for any purpose by the public and are detrimental to the abutting
land owner which needs the same for a building location, and
WHEREAS, the City Council is of the opinion that it will be to the
best interests of the City of Fort Collins to vacate said portions of Lincoln
Avenue and Willow Street
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL Ov THE CITY OF FORT
COLLINS
Section 1 That that portion of Lincoln Avenue in the City of Fort
Collins, Colorado, more particularly described as follows, to-wit
All that portion of Lincoln Avenue in the City of Fort Collins
Colorado, adjoining a portion of said Lincoln Avenue which was
vacated by Ordinance No 1, 1945 and is contained within boundary
lines which begin at the Southeast corner of Block 15, in the City
of Fort Collins, Colorado, and run thence N 88 35? E 78 00 feet,
thence S 74 351 W 59 40 feet, thence N 71 20T W 26 75 feet end
thence N 41 10t E 7 04 feet to the point of beginning, containing
0 015 acres more or less and subject to the right of way of the
Colorado and Southern Railway Corrpany
and that portion of Willow Street in the City of Fort Collins, Colorado, more
particularly described as follows, to-hat
All that portion of Willow Street in the City of Fort Collins,
Colorado adjoining a portion of said Willow Street, which was
vacated by Ordinance No 1, 1945, and is contained within
boundary lines which begin at the Southeast corner of Block 15
in the City of Fort Collins Colorado, and run thence N 58 40t

E 108 45 feet thence S 71 201 E 41 35 feet and thence N 41'
10t E 7 04 feet to the point of beginning, containing 0 05 acres
more or less and subject to the right of way of the Colorado and
Southern Railway Company,
be and the same are hereby vacated, abolished ana abandoned
Section 2 That rights of way or easements are hereby reserved for
the continued use of existing sewer, gas, water or similar pipe lines and
appurtenances, and for electric, telephone and similar lines and appurtenances

Section 3 In the opinion of the City Council an emergency exists
for the preservation of the public health peace and safety, and this
ordinance shall take effect upon its passage under and by virtue of the
authority contained in Sections 6 and 7 of Article IV of the City Charter
Introduced, read at length, and adopted by the unanimous vote of
all members of the City Council, at a regular meeting held this 2nd
day of April, A D 1954

hereby certify and declare that the aforesaid Ordinance, consisting of
three sections, was duly proposed and read at length at a regular meeting
oz the City Council, held on the 2nd day of April, A D 1954, and was
auly adopted ana ordered published in the Fort Collins Coloradoan, a daily
newspaper and official newspaper of the City of Fort Collins, by the
unanimous vote of all members of the City Council, as an Emergency Ordinance,
in accordance with the provisions of Sections 6 and 7 of Article IV of the
City Charter and thereafter and on, to-wit the Ath day of April,
A D 1954, said Ordinance No 7 was duly published in the Fort
Collins Coloradoan, a daily newspaper published in the City of Fort Collins,
Colorado
IN WITNESS WHEREOF, I have hereunto set my hand and affixed the
seal of said City, this 6th day of April, A D 1954
