AGREEMENT BETWEEN THE COUNTY OF LARIMER AND THE CITY CONCERNING THE JOINT OPERATION OF THE COUNTY BOOK MOBILE AND COUNTY LIBRARY FACILITIES WHEREAS heretofore by agreement the City and County have combined their library facilities and WHEREAS both the City and the County desire to continue such arrange ment and an agreement has been prepared providing for the continuance of this arrangement during the year 1973 and WHEREAS the City Council desires to approve and authorize said agree ment NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the terms and conditions of the agreement attached hereto between the County of Larimer and the City providing for the joint operation of the County Book Mobile and County Library facilities be and the same hereby is accepted and approved and the Mayor and the City Clerk be and they hereby are authorized and directed to execute said agreement for and on behalf of the City of Fort Collins Introduced considered favorably on final reading this 22nd day of February A D J ATTEST /IM(ayor City Llerk t r AGREEMENT This agreement made this 1st day of January 1973 between the County of Larimer in the State of Colorado hereinafter called the "County and the City of Fort Collins in the State of Colorado hereinafter called the City WITNESSETH WHEREAS the City has operated a library within the city limits of Fort Collins Colorado and the County has operated a county library in conjunction and cooperation with the said city library and WHEREAS the County has operated a bookmobile in conjunction with its said county library with the assistance and cooperation of the City and WHEREAS it is the desire of the City and County to enter into a formal agreement relative to the operation and maintenance of their respective libraries for the period of time from January 1 1973 through December 31 1973 NOW THEREFORE THESE PRESENTS WITNESSETH that in consideration of their mutual convenants herein it is agreed between the parties hereto as follows 1 That this agreement shall be for the period of time from January 1 1973 through December 31 1973 2 That the City will operate the county bookmobile and maintain the county library facilities in the city library during the term of this agreemert 3 That the City will maintain the bookmobile with funds provided by the County in the amount of $15 000 payable in monthly installments of 1/12th each on the first day of each month during the term of this agreement beginning on January ] 1973 4 All of the employees receiving salaries for the operation of the bookmobile shall be considered to be and shall be employees of the City which shall I-ave the privilege of hiring or discharging such employees and shall have the responsibility of paying such employees from funds paid to it by the County 5 Except as herein otherwise provided the bookmobile shall be furnished by adequate insurance the County and maintained by the City including,/gas oil repairs and similai main- tenance In event a major overhaul or major replacement shall be necessary and the then Board of County Commissioners shall give its specific approval such major overhaul or major replacement shall be paid for by the County 6 The County Library will continue to function as a Board in conjunction with the City Library Board and shall advise concerning the bookmobile schedule and operation Members of the County Library Board shall be notified of and may attend all meetings of the City Library Board and shall have an-equal voice- in the bookmobile schedule and operations The County Library Board shall also be entitled to a vote on the City Library Board concerning all of the operations of the city library affecting the county library 7 The City shall make library cards and book withdrawals available to any citizen of the County on the same basis as they are made available to citizens of the City 8 In consideration of the service to be furnished in accordance with paragraph No 7 above the County shall pay to the City for the period covered by this agreement the sum of $16 832 to be used in the operation of library services The said sum shall be paid into four equal quarterly installments on January 1 April 1 July 1 and on October 1 1973 9 fhe book collection formerly owned by the County Library was turned over to the Foit Collins Public Library in 1967 The bookmobile is to have access to all books in the City Library In the event the relationship between the City and County libraries created by this agreement or any later agreements is terminated the county library shall be permitted to remove from the city collection any books provided by the county library IN WITNESS WHEREOF the parties hereto have hereunto set their hands and
