HomeMy WebLinkAbout043 - 05/03/1973 - ANNEXING THE STEWART ANNEXATION (TABLED ON SECOND READING) 4N 1 1 � � I ORDINANCE NO 43, 1973, BEING AN ORDINANCE ANNEXING PROPERTY KNOWN AS THE STEWART ANNEXATION TO THE CITY OF FORT COLLINS I i 1%]EREAS, heretofore, a written petition, together with four prints of an annexation map was filed with the City Clerk of the City of Fort Collins requesting the annexation of certain territory more particularly i described below to the City, and WSOREAS, the City Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the provisions of Colorado Revised Statutes, 1963, Section 137-21-6 as amended, and *1EREAS, the owners of 100% of the property to be annexed have petitioned for said annexation, and 1*1EREAS, not less than one-sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a com- munity of interest exists between the territory to be annexed and the City of Fort Collins and the territory to be annexed is urban or will be urbanized in the near future and such territory is integrated or is capable of being integrated with the City of Fort Collins, and MEREAS, none of the provisions of Colorado Revised Statutes, 1963, Section 139-21-4, as amended, are violated by the annexation of this territory to the City, and WHEZEAS, no election is required under the provisions of Colorado Revised Statutes, 1963, Section 139-21-6(2) , as amended, and no additional terms and conditions are to be imposed in connection with this annexation, and WHEREAS, the territory is eligible for annexation and the City Council desires to annex the same to the City of Fort' Collins NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS i Section 1 That all of the territory more particularly described as situate in the County of Larimer, State of Colorado, to-wit Being a part of the Southeast ', of Section 26, and the Northeast 4 of Section 35, Township 7 North, Range 69 West of the 6th P M , which considering the North line of the Northeast 4 of said Section 35 as bearing S 89 42'45" E and with all bearings contained herein relative thereto is contained within the boundary lines which be at the North 4 corner of said Section 35, and run thence S 89 42145" E 1503 30 feet along the Said North line, thence S 000la'15" W 30 00 feet, thence S 35 44'05" E 97 08 feet, thence S 56 18'37" E 106 22 feet to a point on the Westerly right-gf- way line of the Colorado and Southern Railroad, thence N 01 04' E 334 05 feet, thence S 88056' E 150 00 feet, thence S 01004' W 165 00 feet to a point on the North line of the said Northeast 4, thence N 89042145" W 50 00 feet along said North line to a point on the Easterly right-of-way line of the Colorado and Southern Railroad, thence along said Easterly right-of-way line, S O1 04' W 2645 16 feet to a point on the South line of the Northeast 4 of said Section 35, thence N 89049113" W 1697 59 feet to the center 4 corner of said Section 35, thence N 00 05153" W 2648 17 feet to the point of beginning be and it hereby is annexed to the City of Fort Collins and made a part of said City to be known as the Stewart Annexation to the City of Fort Collins Section 2 That in annexing said territory to the City of Fort Collins, the City does not assume any obligation respecting the construc- tion of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the oridinances of the City of Fort -2- Collins Introduced, considered favorably on first reading, and ordered I published this 19th day of April, A D 1973, and to be presented for final passage on the 3rd day of May, A D 1973 I yor ATTEST i .i o 1973 Passed and adopted on final reading this 3rld day of May, A D f Nia I yor i ATTEST i City Clerk -3-
