HomeMy WebLinkAbout089 - 10/14/1973 - ANNEXING THE BROWN FARM SECOND ANNEXATION (NOT CONSIDERED ON SECOND READING-SEE RESOLUTION 1973-090) xak 4 � �-Q-L ORDINANCE NO 89 1973 BEING AN ORDINANCE ANNEXING PROPERTY KNOWN AS THE BROWN FARM SECOND ANNEXATION TO THE CITY OF FORT COUINS WHEREAS heretofore a written petition together with four prints of an annexation map was filed with the City Clerk of the City of Fort Collins requesting the annexation of certain territory more particularly described below to the City, and WHEREAS the City Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the provisions of Colorado Revised Statutes, 1963 Section 137 21 6 as amended and WHEREAS the owners of 100 of the property to be annexed have petitioned for said annexation and WHEREAS not less than one sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a com munity of interest exists between the territory to be annexed and the City of Fort Collins and the territory to be annexed is urban or will be urbanized in the near future and such territory is integrated or is capable of being integrated with the City of Fort Collins, and WHEREAS none of the provisions of Colorado Revised Statutes, 1963 Section 139 21 4 as amended are violated by the annexation of this territory to the City, and WHEREAS, no election is required under the provisions of Colorado Revised Statutes 1963 Section 139 21 6(2) as amended, and no additional terms and conditions are to be imposed in connection with this annexation and WHEREAS the territory is eligible for annexation and the City Council desires to annex the same to the City of FortjCol has i NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT i COLLINS Section 1 That all of the territory more particularly described as situate in the County of Larimer State of Colorado to wit The East half of the Southwest quarter and the South half of the East half of the West half of the Southwest quarter of Section 21 Township 7 North Range 69 West of the 6th P M be and it hereby is annexed to the City of Fort Collins and made a part of said City to be known as the Annexation to the City of Fort Collins Section 2 That in annexing said territory to the City of Fort Collins the City does not assume any obligation respecting the construc tion of water mains, sewer lines gas mains electric service lines streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins and specifically the City of Fort Collins assumes no responsibility to provide water service to the property it being understood that existing city water facilities are not capable of supplying water to these lands and non city water service is available to the property through statutory water district Introduced, considered favorably on first reading and ordered published this 29th day of November A D 1973 and to be presented for final 2 a �. passage on the 20th day of December A D 1973 Mayor ATTEST A D 1973 Passed and adopted on final reading this 20th day of December I Mayor ATTEST I City Clerk I I I 3
