ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS
WEST MULBERRY AND ELIZABETH CONSOLIDATED ANNEXATION
TO THE CITY OF FORT.COLLINS, COLORADO, AND AUTHORIZING
THE ANNEXATION OF ALL THE TERRITORY .EMBRACED IN SAID
PLAT TO THE_CITY OF FORT COLLINS AND TO BE INCLUDED
WITHIN THE LIMITS AND JURISDICTION THEREOF, .PURSUANT
TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139,
COLORADO °REVISED STATUTES, 1953.
WHEREAS, heretofore a written petition was presented to the
Council of the City of Fort Collins -in substantial compliance with the
provisions of Article 11, Chapter 139, Colorado Revised Statutes, by
the owners of more than fifty per cent of the land embraced in what is
known as West Mulberry and Elizabeth Consolidated Annexation which
persons also comprise a majority of the land owners residing in said
territory at the time said petition was filed, wherein and whereby said
petitioners petitioned the City of Fort Collins for the annexation of
all the territory embraced in what is known as West Mulberry and
Elizabeth Consolidated Annexation to the City of Fort;Collins, Colorado,
comprising the lands shown in the plat thereof attached to said
petition and more particularly described as hereinafter set forth, and
WHEREAS, said petition was accepted by the Council of the City
of Fort Collins by resolution passed and adopted on June 2, 1960, and
WHEREAS, notice ,for hearing on the 14th day of July, A. D. 1960,
on an ordinance approving the. annexation of said territory and including
the same within the limits and jurisdiction of the City of Fort Collins
was duly published as provided by law, and
WHEREAS, on the 14th day of July, A. D. 1960, motion to adopt
said ordinance was tabled and action thereon was regularly continued
to the 6th day of October, A. D. 1960, and
WHEREAS, the Council of the City of Fort Collins has found that
the petition and the documents thereto attached meet the requirements of
Article 11, Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS, a counter petition, which the Council of the City of
Fort Collins has found meets the requirements of Article 11, Chapter 139,
Colorado Revised Statutes, 1953, has been filed with the City Clerk,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That after due consideration of the petition for
annexation, the petition for the annexation of all the territory in what is
known and described as West Mulberry and Elizabeth Consolidated Annexation
to the City of Fort Collins, Colorado, as shown by the plat thereof
annexed to said petition and which is more particularly described as
follows, to-wit:
A portion of the North half of Section 16 and of the
West half of Section 15, both in Township 7 North, Range
69 West of the 6th P.M., more particularly described as
follows: Considering the North line of Section 15,
Township 7 North, Range 69 West of the 6th P.M. as bearing
East and West, and with all bearings herein relative thereto;
Beginning at a point on the West line of said Section 15,
which point bears S. 00°32' E. 1320.00 feet from the
Northwest corner of said Section 15; thence along said
section line, S. .00°32' E. 76.90 feet; thence along the
South line'of Miller Brothers Third Subdivision, Third
Filing, East 664.93 feet to a point on the West boundary
line of tract owned by School District No. 5; thence along
said boundary line South 198.00 feet to the Southwest corner
of said tract; thence along the South boundary thereof, East
666.52 feet to the boundary line of Miller's Foothills Annexation;
thence along said boundary line, S. 00029' E. 88645 feet;
thence continuing along said boundary line N. 89054' w.
489.25 feet; thence' continuing along said boundary line S.
00032' E. 47 feet to 'the Northeast corner. of the G. J.
Reid Annexation; thence along the North line of said
G. J. Reid Annexation N. 89054'23" W. 840 feet to the
West line of Section 15; thence along said Section line,
S. 00032' E. 113.80 feet to the one-quarter corner common
to said Sections 16 and 15; thence along the East-West
centex-line of said Section 16, N. 89°42'30" W. 5213.19
feet to the West one-quarter corner of said.Section 16;
thence along the West line of said Section 16, N. 00024'30"
W. 2490.50 feet; thence along the center-line of the County
Road between Lots 1 and 2 of Mountain View Acres Subdivision,
N. 77057130" E. 699.70 feet to a point on the North line of
said Section 16; thence along said Section line, S. 89'42'30"
E. 3532.05 feet; thence S. 00°17 '30" W. 1319.90 feet to the .
South line of the North half of the.Northeast Quarter of said
Section 16; thence along said line, S. 89042'30" E. 1009.01
feet to the point of beginning; containing 315.55 acres, more
or less;
be accepted and approved and that said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and jurisdiction
thereof, subject to the Ielection required by the provisions of Section 4,
Article 11, Chapter 139, Colorado Revised Statutes, 1953, and that the
City Clerk be and he is hereby authorized and directed to prepare certified
copies of this ordinance to each of which shall be attached a plat of said
West Mulberry and Elizabeth Consolidated Annexation to the City of Fort

Collins, Colorado, and shall file a copy thereof in the office of the
Clerk and`Recorder of the County of Larimer and another copy thereof in
the office of the Clerk of the City of Fort Collins, together with a
certified copy of said petition and another copy of said petition and
approving ordinance with the Secretary of State of the State of Colorado,
and that the" Mayor and City Clerk be and they are he authorized and
directed to petition the County .Court of Larimer County for a decree
annexing the territory above described- to the City of Fort Collins,
which petition shall set forth the adoption of this ordinance and shall
be accompanied by a certified copy of this ordinance together with a
certified.copy of the petition and counter-petition upon which this
ordinance was based, and a copy of the plat of the territory herein
annexed.
Section 2, That in accepting and approving the plat of the
West Mulberry and Elizabeth Consolidated Annexation to the City of Fort
Collins, the City of Fort Collins does not assume obligations respecting
the construction of water mains, sewer lines, gas mains, electric light
lines or other services or utilities with respect to service of said
addition, except as may be required and provided by the owners of
property within the limits of said addition in compliance with the terms
and provisions of Ordinance No. 7, 1921, relating to local and public
improvements, as amended.
Introduced, considered favorably on first reading and ordered
published this 6th day of October, A. D. 1960, and ,to be presented for
final passage on the 27th day of October, A. D. 1960.
