BEING AN ORDINANCE REGULATING CONDUCT CONSTITUTING AN
OFFENSE BY PERSONS IN THE CITY, PREVENTING VICE DISORDER,
IMMORALITY, PROMOTING PUBLIC PEACE, SAFETY AND HEALTH,
PROTECTING PUBLIC AND PRIVATE PROPERTY, PROTECTING PUBLIC
MORALS AND PROHIBTING OFFENSES INVOLVING CHILDREN
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 Offenses Against Public Peace No person in the City of
Fort Collins shall
(a) Disturbing the Peace Disturb, tend to disturb, or
aid in disturbing the peace of others by violent, tumultuous,
offensive, disorderly or obstreperous conduct, and no person
shall knowingly permit such conduct upon any premises owned
or possessed by him or under his control
(b) Vagrancy Have the status or condition of a vagrants
Any person able to work and support himself who shall be found
loitering or strolling about on the street at a late or unusual
hour without lawful business, frequenting public places or
begging or leading an idle, unmoral or profligate course of
life in the City of Fort Collins or not having any visible means
of support, shall be deemed a vagrant
(c) Loitering Stop, loaf, or loiter on any highway,
street, alley or sidewalk within the City of Fort Collins or
in the vicinity of any public place of amusement or of worship
in the City of Fort Collins and refuse to disperse or vacate any
such place when requested to do so by any Police Officer of the
City
(d) Loitering and Other Acts About Schools Loiter, idle,
wander, stroll or play in, about or on any public, private or
parochial school, college or seminary grounds or buildings, either
on foot or in or on any vehicles without having some lawful business
therein or thereabout or in connection with such school
or the employees thereof Nor shall any person annoy,
disturb or otherwise prevent the orderly conduct of classes
or activities of any1such school or annoy, assault, disturb
or molest any student or employee of any such school, college
or seminary while in any such school building or on any school
grounds or conduct himself in a lewd, wanton, lascivious manner
in speech or behavior in or about any such school building or
school grounds nor shall any person park or move a vehicle in
the vicinity or on the grounds of any such school, college or
seminary for the purpose of annoying or molesting the students
or employees thereof or in any effort to induce, entice or
invite students into such vehicles for immoral purposes
(e) Congregating on private property, when Congregate
or remain in any place of business or private residence within
the City of Fort Collins against the will of the proprietor or
the person in charge of such premises after having been requested
by such person to vacate such premises
Section 2 Offenses Against Morality and Public Policy No
person in the City of Fort Collins shall
(a) Carrying or Drinking Liquor or Fermented Malt Beverages
Prohibited Certain Places Carry or have any open containers of
liquor or fermented malt beverages on any street, sidewalk, alley
or other public place in the City of Fort Collins or in any
automobile in the City or on the grounds of any public or private
school, college or university in said City nor shall any person
drink any liquor or fermented malt beverages in or on any of the
above enumerated places in the City
(b) Intoxication Be found upon any street, alley or other
public grounds of the City in the state of intoxication
(c) Nudity, Improper or Indecent Dress, Indecent Exposure, etc
Appear in any public place in the City in a nude state, or state of

undress, or in a state of dress not belonging to his,
her or their sex, or in an indecent or lewd state of dress
nor shall any person make any indecent exposure of his or
her person or be guilty of any lewd or indecent act or behavior
(d) Solicitation of Drink No female persons shall
frequent or loiter in any place selling fermented malt
beverages for the purpose of soliciting men to purchase
drinks, nor shall any proprietor or operator of any such
place allow the presence in such place of any woman who
violates this sub-section
(e) Vulgar, Profane or Indecent Language Use vulgar,
profane or any indecent language on any public street or other
public place or any public dance hall, club dance, skating rink,
restaurant or any place of business open for public patronage
(f) Window Peeping Look peer, or peep into or be found
loitering around or within view of any window not on his own
property with the intent of watching or looking through said
window
Section 3 Offenses Against Property No person in the City of
Fort Collins shall
(a) Injuring or Removing Property Wilfully, maliciously,
wantonly, negligently or otherwise injure, deface, destroy or
remove real property or improvements thereto or personal property
belonging to the City or any person in the City
(b) Litter Throw or permit to be deposited or scattered
upon any sidewalk, alley, street or other public place in the
City or on any private property in the City any loose paper,
rags, waste or other material of any kind, nor shall any person
distribute or scatter hand bills, dodgers, or other papers nor
shall any person owning or occupying any lot or ground in the City
allow or permit any loose paper, rags, waste or other material

which may be liable to be blown or scattered by the wind
or otherwise to remain upon such lot or grounds
(c) Posting Notices Fasten in any way any show card,
poster or other advertising device upon public or private
property in the City unless legally authorized so to do
(d) Tampering Tamper with, injure, deface, destroy, or
remove any sign, notice, marker, fire alarm box, fire plug,
topographical survey monument or any other personal property
directed or placed by the City
Section 4 Offenses Against Public Authority No person in the City
of Fort Collins shall
(a) False Alarm of Fire or Need for Police or Ambulance
Assistance Intentionally make, turn in or give a false alarm
of fire, or of need for police or ambulance assistance or aid
or abet in the commission of such act
(b) False Report of Crime Make to or file with the Police
Department of the City any false, misleading or informal statement
or report concerning the commission or alleged commission of any
crime occurring within the City
(c) Interference with Police Department
(1) Resisting Officers Resist any police officer,
any member of the Police Department or any person duly
empowered with police authority while in the discharge
of his duty or in any way interfere with or hinder him
in the discharge of his duties
(2) Assisting an Escape Offer or endeavor to
assist any person in the custody of at-police officer,
a member of the Police Department or person duly empowered
with police authority to escape or attempt to escape from
such custody

(3) Impersonating an Officer No person other
than an official police officer of the City shall wear
or carry the uniform, apparel, badge, identification
card or any other insignia of office, like or similar to,
or a colorable imitation of that adopted or worn, or
carried by the official police officers of the City
Nor shall any person in any other way falsely represent
himself to be a police or other officer of the City nor
shall any person not being authorized exercise any duty,
power or function of any police officer or other officer
of the City
(4) Refusal to Assist Refuse to assist any police
officer in making any arrest, or quelling any disturbance
when requested by such officer to do so
(d) Escape of Prisoners
(1) Assisting an Escape of Prisoner Make available
to, present to or place within the reach of any persons
confined under authority of the City, intoxicating or
malt liquors or any tool, implement or other thing
calculated to aid in the escape of such persons so confined
or any other persons confined through the authority of the
City
(2) Aiding Escapes Assist or aid or attempt to
assist or aid any person in the custody of or confinement
of the City to escape from jail, place of confinement or
custody
(3) Escape from Jail While a prisoner in the City
jail or any other place where prisoners are confined or
otherwise in custody or confined by the City, escape or
attempt to escape or to assist others to escape or attempt

to escape from such custody or confinement
Section 5 Offenses Against Public Safety No person in the City
of Fort Collins shall
(a) Discharge of Weapons Discharge any firearms,
provided, however, that nothing contained in this section
shall apply to any police officer or other officer of the
City in the execution of his duties or to any person lawfully
defending property
(b) Thowing of Missiles Throw any stones, snowballs
or other objects or missiles, upon or at any vehicle, building,
tree or other public or private property or upon or gat any person
in any public way or upon other public grounds
(c) Ball Playing Throw, kick or knock a ball or play
ball in any other manner upon any public street, alley or
sidewalk
Section 6 Offenses Involving Children
(a) Curfew No person under the age of 17 years shall
frequent, loiter, loaf, play or remain upon any street, alley
or public grounds in an unoccupied or vacant lot or lots, block
or blocks in or about or upon any stairway, hall, or area of
any business or public building or in any vacant or unoccupied
building or buildings within the corporate limits of the City of
Fort Collins between the hours of 9 00 P M and 6 00 A M
(b) Parents and Guardians Not to Permit Children to Loiter
No parent, or parents, guardian or guardians or any other person
or persons having the care or custody of children under the
age of 17 years shall knowingly permit such children to loaf,
loiter, play or remain upon the street or any of the places
named in sub-section (a) above between the hours named in said
sub-section

(c) Abandoned Refrigerators or Iceboxes No person
shall leave outside of any building or dwelling place or in
any place or in any uninhabited building or any place accessible
to children, any abandoned, unattended or discarded refrigerator,
icebox or similar container which has an air tight or sound proof
door having a snap lock or similar devise which can not be opened
from the inside without first removing the lock or similar devise
on the doors from the refrigerators or icebox or similar containers
(d) Hanging on Moving Vehicles No minor shall hang on to
any moving vehicle in the City of Fort Collins
Section 7 Violation of Ordinances Any person who violates any provision
of this ordinance shall be guilty of a violation of the ordinances of the City of
Fort Collins and shall be punished according to provisions of said ordinances
Section 8 Severance Clause If any section, sentence, clause or phrase
of this ordinance is for any reason held to be unconstitutional or invalid for
any reason such devision shall not affect the validity of the remaining sections,
sentences, clauses or phrases of this ordinance or of the ordinances as an
entirety It being the legislative intent that this ordinance shall stand
notwithstanding the validity of such section, sentence, clause or phrase
Section 9 Repeal Chapter 18 of the Code of Ordinances of the City of
Fort Collins, Colorado, 1958, and all other ordinances of parts of ordinances
in conflict with the within ordinances are hereby repealed
Introduced, considered favorably upon first reading and ordered published
this 6th day of January, A D 1966, and to be presented for final passage on the
27th day of January, A D 1966
