MILLER SECOND FOOTHILLS ANNEXATION ORDINANCE NO 2 1965 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE ALVIN L MILLER SECOND FOOTHILLS ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 112 CHAPTER 139, COLORADO REVISED STATUTES. 1953 - WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11 Chapter 139, Colorado Revised Statutes, by the sole owners of the area and who comprise the majority of landowners residing in the area of land embraced in what is known as the Alvin L Miller Second Foothills Annexation to the City of Fort Collins wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Alvin L Miller Second Foothills Annexation to the City of Fort Collins, Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on November 12, 1964 and WHEREAS, notice for hearing on the 24th day of December 1964 on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation the petition for the annexation of all the territory in what is known and described as the Alvin L Miller Second Foothills Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit A tract of land situate in the SEk of Section 16 Township 7 North Range 69 West of the Sixth P M County of Larimer State of Colorado which considering_the East line of said SEA as bearing N 00 32' W and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point which bears N 89 43130" W 1311 96 feet and again N 89 45' W 448 67 feet from the Northeast corner of said SEk, said point being the Northerly most corner of the Alvin L Miller First Foothills Annexation to the City of Fort Collins Colorado and run thence N 89 45' W 590 00 feet thence S 00 15' W 1130 00 feet thence S 89 45' E 35 00 feet thence S 00 15' W 120 00 feet thence S 17'31' E 71 82 feet, thence S 89 41' E 615 09 feet to the Southerly most corner of the West line of the Alvin L Miller First Foothills Annexation thence N 00 15' E 69 11 feet along said Westerly line thence N 89 45' W 210 00 feet along the Southerly line of the Alvin L Miller First FoothillstAnnexation thence N 00'15' E 120 00 feet along said Westerly line thence N 89 45' W 20 00 feet along said Southerly line, thence N 00 15' E 600 00 feet along said Westerly line thence S 89'45' E 13 00 feet thence N 00 15' E 270 00 feet thence S 89 45' E 135 00 feet thence N 00'15' E 260 00 feet to the point of beginning be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins in the following zoning districts a portion of said property to be included within and as a part of the "B" Residential District said portion being more particularly described as situate in the County of Larimer State of Colorado to-wit Begin at the Southeasterly most corner of the above described total tract and run thence N 00 15' E 69 dl feet, thence N 89'45' W 210 00 feet, thence N 00 15' E 120 00 feet thence N 89 45' W 20 00 feet thence N 00 15' E 280 00 feet thence N 89 45' W 272 00 feet thence S 00 15' W 280 00 feet thence N 89 45' W 135 00 feet thence S 00 15' W 120 00 feet thence S 17 31' E 71 82 feet thence S 89 41' E 615 09 feet to the point of beginning containing 3 9126 acres more or less and a portion of said property to be included within and as a part of the "C ' Residential District said portion being more particularly described as situate in the County of Larimer State of Colorado to wit Begin at the Northeasterly most corner of the above described total tract and run thence N 89 45' W 420 00 feet thence S 00 15' W 260 00 feet thence S 89'45' E 420 00 feet thence N 00'15' E 260 00 feet to the point of beginning containing 2 5069 acres more or less and all the remaining portion of said property to be included within and as a part of the "A" Residential District and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance -2- to each of which shall be attached a plat of said Alvin L Miller Second Foothills Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition, and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Alvin L Miller Second Foothills Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, relating to local and public improvements Introduced, considered favorably on first reading and
