HomeMy WebLinkAbout013 - 05/09/1957 - ANNEXING PROPERTY KNOWN AS THE SECOND WESTERN HEIGHTS ANNEXATION ORDINANCE NO 13 1957 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE SECOND WESTERN HEIGHTS ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS THE SAME TO BE MADE A PART OF THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS- DICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11 Chapter 139 Colorado Revised Statutes 1953 by six individuals and the Western Heights Land Corporation purporting to be 66 677 of the qualified electors in the area of the territory in- volved and further purporting to be the owners of 81 9/ of the area of the land embraced in what is known as the Second Western Heights Annexa- tion to the City of Fort Collins wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the Second Western Heights Annexation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 17th day of Jan- uary 1957 and WHEREAS notice for hearing on the llth day of April A D 1957 on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation that the petition for the annexation of all theterritory in what is known and described as the Second Western Heights Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit A portion of the NE'k of the SEk and a portion of the SE'k of the SE'k of Section 15 Township 7 North Range 69 West of the 6th P M Larimer County Colorado contained within boundary lines beginning at a point on the East line of the SFA of said Section 15 and 541 34 feet South of the NE corner of the Nk of the N'k of the S' of the NEk of the SFA of said Section 15 and running thence Westerly in a direct line 330 feet to a point which is 44 6 feet South of the SE corner of Lot 15 in the Western Heights Subdivision of part of the SE'k of Section 15 Township 7 North Range 69 West of the 6th P M according to the plat dated September 14 1955 thence North 44 6 feet to the SE corner of Lot 15 in said Western Heights Subdivision thence Westerly 110 feet along the South line of Lot 15 in said Western Heights Subdivision to the SW corner of said Lot 15 thence North 51 16 feet to the NE corner of Lot 39 in said Western Heights Subdivision thence Westerly 615 feet in a direct line to the SW corner of Lot 23 in said Western Heights Subdivision thence North 110 feet to the NW corner of said Lot 23 thence Northeasterly in a direct line 61 85 feet more or less to the SW corner of Lot 5 in said Western Heights Subdivision thence North 110 feet to the NW corner of Lot 5 in said Western Heights Subdivision thence Westerly 280 feet to the NW corner of Lot 1 in said Western Heights Subdivision thence South 843 50 feet to the SW corner of Lot 75 in said Western Heights Subdivision thence Easterly 880 feet to the SE corner of Lot 64 in said Western Heights Subdivision thence Easterly 440 feet to a point on the East line of said Section 15 which is 977 88 feet North of the SE corner of said Section 15 and thence North 467 74 feet more or less to the point of beginning be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is authorized and directed to prepare certified copies of this ordinance to each of which - 2 - shall be attached a plat of said Second Western Heights Annexation to the City of Fort Collins Colorado and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of the said petition and another copy of said peti- tion and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Second Western Heights Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to the service of said addition except as may be required and provided by the owners of property within the limits of said addition at their own expense and except as may be initiated by the owners of said property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7 1921 relating to local and public improvements as amended Introduced considered favorably on first reading and ordered published this llth day of April A D 1957 and to be presented for final passage on the 9th day of May A D 1957 Cj Mayor ATTEST �/ yevL -
