HomeMy WebLinkAbout020 - 07/25/1957 - ANNEXING PROPERTY KNOWN AS THE INDIAN HILLS SUBDIVISION ANNEXATION ORDINANCE NO 20 1957 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE INTDIAN HILLS SUBDIVISION ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS THE SAME TO BE MADE A PART OF THE CITY OF FORT COLLINS AND TO BE IIQCLUDED WITHIN THE LIMITS AND JURIS- DICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11 Chapter 139 Colorado Revised Statutes 1953 by the sole owner of the land embraced in what is known as the Indian Hills Sub division Annexation to the City of Fort Collins wherein and whereby said petitioner and applicant petitioned the City of Fort Collins for the annexa- tion to the City of Fort Collins of all the territory embraced in what is known as the Indian Hills Subdivision Annexation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 9th day of May A D 1957 and WHEREAS notice for hearing on the 27th day of June A D 1957 on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been nade BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation that the petition for the annexation of all the territory in what is known and described as the Indian Hills Subdivision Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said peti- tion and which is more particularly described as follows to-wit Part of the E-2 of Section 24 Township 7 North range 69 West of the 6th Principal Meridian Larimer County Colorado contained within boundary lines which begin at the Northeast corner of the Sz of the NE4 of said Section 24 and ru-i thence South along the East line of the NE'k of said Section 24 1 322 feet more or less to the SE corner of the Sk of the NE4 of said Section 24 thence Westerly along the South line of the S2 of the NE4 of said Section 24 1 580 3 feet more or less to a point which is Easterly 1 055 7 feet from the Southwest corner of the S'k of the NE4 of said Section 24 thence S 11 05' W 170 5 feet thence S 83 15' W 153 0 feet thence 11 88 24' 11I 208 0 feet thence N 54 00' W 113 0 feet thence N 35 32' W 135 0 feet to the South line of the S' of the NEk of said Section 24 thence N 45 15' W 16 00 feet thence N 88 47' 11 265 2 feet thence Y 72 02' W 226 5 feet to a point on the West line of the SA-of the NE4 of said Section 24 which point is North 88 0 feet from the Southwest corner of the S' of the NE'k of said Section 24 thence North along the West line of the S' of the NE4 of said Section 24 634 feet more or less to a point which is South 600 0 feet from the Northwest corner of the S1 of the NE'k of said Section 24 thence East 360 0 feet thence North 240 0 feet thence East 1 050 0 feet thence North 360 feet to the North line of the S'k of the NE4 of said Section 24 thence East 1 226 3 feet more or less to the point of beginning containing an area of 70 928 acres more or less be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Indian Hills Subdivision Annexation to the City of Fort Collins Colorado and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of the said petition and another copy of said petition and approving ordinance with the Secretary of the State of Colorado - 2 - Section 2 That in accepting and approving the plat of the Indian Hills Subdivision Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to the service of said addition except as may be required and provided by the owners of property within the limits of said addition at their own expense and except as may be initiated by the owners of said property within the limits of said addition in compliance with the terms and provisions of ordinance No 7 1921 relating to local and public improvements as amended Introduced considered favorably on first reading and ordered published this 27th day of June A D 1957 and to be presented for final passage on the 25th day of July A D 1957 ATTEST Mayor City Clerk Passed and adopted on final reading this 24h day of July A D 1957 ATTEST Mayor City Clerl -
