STREET ANNEXATION TO THE CITY OF FORT COLLINS COLORADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139 COLO- RADO REVISED STATUTES 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11, Chapter 139, Colorado Revised Statutes 1953 by One Hundred Two (102) individuals purporting to be 59 77 of the land owners of the area involved and further purporting to be the owners of 58 47 of the area of land embraced in what is known as the West Prospect Street Annexa- tion to the City of Fort Collins, wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the West Prospect Street Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 8th day of August, A D 1957 and WHEREAS notice for hearing on the 26th day of September, A D 1957, on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953, and WHEREAS, no proceedings for an election to determine the ques- tion of annexation have been initiated by written counter-petition as pro- vided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation that the petition for the annexation of all the territory in what is known and described as the West Prospect Street Annexation to the City of Fort Collins Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit Part of the SW'k of Section 14 and part of the M of Section 23 both in Township 7 North, Range 69 West of the 6th P M , Larimer County, Colorado, contained within boundary lines which considering the West line of the SWk of said Section 14 as bearing due North and with all bearings herein relative thereto begin at the SW corner of said Section 14 and run thence-M 1324 65 feet more or less, along the West line of the SW-4 of said Section 14 to the NW corner of the S'k of the S'k of said Section 14 which point is the NW corner of the College Heights Subdivision accord- ing to the plat dated April 22 1926 thence Easterly along the North line of said College Heights Sub- division 927 1 feet more or less, to the NE corner of Lot 12 in Block 1 of said College Heights Subdivision thence Southerly along the East line of said Lot 12 716 32 feet to the SE corner of said Lot 12 on the North line of Lake Street thence Easterly along he South line of Lot 11 in Block 1 of said College Heights Subdivision�$�b`,fieTSE corner of said Lot 11 thence Northerly along the East line of said Lot 11 715 50 feet to the NE corner of said Lot 11 thence Easterly 153 9 feet along the North line of Lot 10 in Block 1 of said College Heights Subdivision, to the NE corner of said Lot 10, thence Southerly along the East line of said Lot 10 714 68 feet to the SE corner of said Lot 10 thence Easterly, along the South line of Block 1 of said College Heights Subdivision 990 62 feet more or less to a point 424 5 feet West of the East line of the SW'k of said Section 14, thence SoutA 60 00 feet, more or less to the NW corner of Lot 1 of the Blevins Subdivision (according to the plat of the Annexation of the Blevins Subdivision)as approved and accepted by Ordinance No 19, 1956 thence South552 6 feet, along the West line of said Blevins Sub- division to alpoint on the South line of the SW4 of said Section 14 which is 424 5 feet West of the SE corner of the SW% of said Section 14 thence West along the South line of the SW'k of said Section 14 22 31 feet, to the NW corner of the Arthur C Sheely Annexation, of a part of the NWT of said Section 23, to the City of Fort Collins, Larimer County, Colorado according to Ordinance No 6, 1957, passed on final reading by the City Council of the City of Fort Collins Colorado, on March 28, 19570 thence South along the West line of said Arthur C Sheely Annexa- tion 661 67 feet to the SWcorner of said Arthur C Sheely Annexation thence Westerly along the South line of the Arthur C Sheely Third Subdivision the Arthur C Sheely Second Subdivision and the Arthur C Sheely First Subdivision all in the NW4 of said Section 23 1186 28 feet, to the SE corner of Lot 1 in said Arthur C Sheely First Subdivision thence 19orth, along the East line of Lot 1 in said Arthur C Sheely First Subdivision 390 00 feet, thence West parallel to the North line of the NWT of said Section 23 345 00 feet to the West line of Lot 1 in the Arthur C Sheely First Sub- division in the NWk of said Section 23 thence North along the West line of said Lot 1, 56 68 feet more or less, to the SE corner of Lot 6 Seamans Subdivision of a part of the NW' of said Section 23, 2 - thence Westerly along the South line of said Seamans Subdivision 432 0 feet to the SW corner of Lot 1 said Seamans Subdivision thence Northerly along the West line of Lot 1 of said Seamans Subdivision 215 00 feet to the North line of the NW'4 of said Section 23 and thence Westerly along the North line of NW4 of said Section 23 228 0 feet more or less to the point of beginning containing an area of 71 426 acres more or less be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is hereby author- ized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said West Prospect Street Annexation to the City of Fort Collins Colorado, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins to- gether with a certified copy of the said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 3 That in accepting and approving the plat of the West Prospect Street Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric Light lines or other services or utilities with respect to the service of said addition except as may be required and provided by the owners of property within the limits of said addition at their own expense and except as may be initiated by the owners of said property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7 1921 relating to local and public
