HomeMy WebLinkAbout035 - 11/14/1957 - ANNEXING PROPERTY KNOWN AS THE RADIO CITY ANNEXATION 10 ORDINANCE NO 35, 1957 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE RADIO CITY ANNEXATION TO THE CITY OF FORT COLLINS COLO- RADO AND AUTHORIZING THE ANNEXATION OF ALL THE TERRITORY EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS THE SAME TO BE MADE A PART OF THE CITY OF FORT COLLINS AND TO BE IN- CLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139 COLO- RADO REVISED STATUTES 1953 WHEREAS heretofore a written petition has been presented to the Council of the City of Fort Collins in substantial compliance with the pro- visions of Article 11 Chapter 139 Colorado Revised Statutes 1953 by three (3) individuals purporting to be 66 67/ of the land owners of the area in- volved and further purporting to be the owners of 89 76/ of the area of land embraced in what is known as Radio City Annexation to the City of Fort Collins wherein and whereby said petitioners and applicants petitioned the City of Fort Collins for the annexing of all the territory embraced in what is known as the Radio City Annexation to the City of Fort Collins Colorado comprising the lands shown in the platthereof attached to said petition and more particularly described as hereafter set forth and 14HEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on the 22nd day of August A D 1957 and WHEREAS notice for hearing on the 26th day of September A D 1957 an an ordinance approving theannexation of said territory and includ- ing the same within the limits and 3urisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents attached thereto meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the ques- tion of annexation have been initiated by written counter-petition as pro- vided by law and no ob3ection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation that the petition for the annexation of all the territory in what is known and described as the Radio City Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit A portion of the SE4 of the SEk of the NIA of Section 10 Township 7 North R nge 69 West of the 6th P M Larimer County Colo- rado, contained within boundary lines beginning at a point on the South line of the N614 of said Section 10 and 230 feet West of the SE corner of the NT4 of said Section 10 and running thence North 155 feet parallel to the East line of the NIA of said Section 10 thence West 80 feet parallel to the South line of the NW4 of said Section 10 thence North 398 feet parallel to the East line of the NW4 of said Section 10 thence West 20 feet more or less to a point on the East line of the W-3/4 of the SE4 of the NW4 and 553 feet North of the South line of the NK of said Section 10 thence West 285 feet parallel to the South line of the NW4 of said Section 10 thence South 553 feet to a point on the South line of the NIA of said Section 10 and 285 feet West of the SEcorner of the W-3/4 of the SE4 of the NW4 of said Section 10 thence East 285 feet along the South line of the MA4 of said Section 10 to the SEcorner of the W-3/4 of the SE4 of the NW4 of said Section 10 and thence East 100 feet more or less to the point of beginning subject to the right of way for the public road over the South 30 feet thereof and containing 4 158 acres moreor less be accepted and approved and that the said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof and that the City Clerk be and he is hereby author- ized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said Radio City Annexation to the City of Fort Collins, Colorado, and shall file one copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins to- gether with a certified copy of the said petition and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 3 That in accepting and approving the plat of the Radio City Annexation to the City of Fort Collins the City of Fort Col- lins does not assume obligations respecting the construction/of water mains - 2 - sewer lines gas mains electric light lines or other services or utili ties with respect to the service of said addition except as may be re- quired and provided by the owners of property within the limits of said addition at their own expense and except as may be initiated by the owners of said property within the limits of said addition in compliance with the terms and provisions of Ordinance No 7 1921 relating to local and public improvements as amended Introduced considered favorably on first reading and ordered published this 10th day of October, A D 1957 and to be presented for final passage on the Ikth day of November,A D 1957 Mayor ATTEST City Clerk Passed and adopted on final reading this 14th day of November A D 1957 Mayor ATTEST City Clerk -3-
