MILLER FIRST ANNEXATION ORDINANCE NO 1964 ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE ALVIN L MILLER FIRST FOOTHILLS ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139 COLORADO REVISED STATUTES 1953 WHEREAS heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions bf Article 11 Chapter 139 Colorado Revised Statutes, by the sole owners residing in the area of land embraced in what is known as the Alvin L Miller First Foothills Annexation to the City of Fort Collins wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Alvin L Miller First Foothills Annexation to the City of Fort Collins Colorado comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth and WHEREAS said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on December 12 1963 and WHEREAS notice for hearing on the 23rd day of January A D 1964 on an ordinance approving the annexation of said territory and in- cluding the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law and WHEREAS the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11 Chapter 139 Colorado Revised Statutes 1953 and WHEREAS no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annex- ation the petition for the annexation of all the territory in what is known and described as the Alvin L Miller First Foothills Annexation to the City of Fort Collins Colorado as shown by the plat thereof annexed to said petition and which is more particularly described as follows to-wit A tract of land situate in the Southeast �; of Section 16 Township 7 North Range 69 West of the Sixth P M Larimer County Colorado which considering the East line of said Southeast ;4 as bearing N 00 32' W and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point which bears N 89 43'30 W 1311 96 feet from the Northeast corner of said Southeast 'k and run thence S 00 22'30 E 1319 64 feet thence N 89 41' W 381 07 feet thence N 00 15' E 69 11 feet thence N 89 45' W 210 00 feet thence N 00 15' E 120 00 feet thence N 89 45' W 20 00 feet thence N 00 15' E 600 00 feet thence S 89 45' E 13 00 feet thence N 00 15' E 270 00 feet thence S 89 45' E 135 00 feet thence N 00 15' E 260 00 feet thence S 89 45' E 448 67 feet to the point of beginning containing 16 905 acres more or less be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and ,jurisdiction of the City of Fort Collins with Lots 2 3 11 12 13 and 14 to be in the 'B Lots 1., 2.9 3, 4., 5, and 6 of Tract F Residential District and with Tracts C D E andA to be in the C Residential District and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance to each of which shall be attached a plat of said Alvin L Miller First Foothills Annexation to the City of Fort Collins Colorado and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer and another copy thereof in the office of the Clerk of the City of Fort Collins together with a certified copy of said petition and another copy of said petition and approving ordinance with the Secretary of State of The State of Colorado Section 2 That� in accepting and approving the plat of the Alvin L Miller First Foothills Annexation to the City of Fort Collins the City of Fort Collins does not assume obligations respecting the construction of water mains sewer lines gas mains electric light lines or other services or utilities with respect to service of said addition except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15 Code of Ordinances of the City of Fort Collins Colorado 1958 as amended relating to local and public improvements Introduced considered favorably on first reading and ordered published this 23rd day of January A D 1964 and to be presented for final passage on the 13th day of February A D 1964 ATTEST or city Plerk Passed and adopted on final reading this dad day of February A D 1964 Mayor ATTEST City C erk
