ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
RIVERSIDE AVENUE ANNEXATION TO THE CITY OF FORT COLLINS
AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION
THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE
11, CHAPTER 139, COLORADO REVISED STATUTES, 1953
WHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139 Colorado Revised Statutes, by the owners of more than
fifty per cent (50%) of the area and who comprise the majority of landowners
residing in the area of land embraced in what is known as the Riverside Avenue
Annexation to the City of Fort Collins, wherein and whereby said petitioners
petitioned the City of Fort Collins for annexation of all the territory
embraced in what is known as the Riverside Avenue Annexation to the City of
Fort Collins Colorado comprising the lands shown in the plat thereof attached
to said petition and more particularly described as hereinafter set forth and
WHEREAS heretofore the Council of the City of Fort Collins by
ordinance attempted to approve said annexation but said ordinance was defective
in that the description therein used did not include all of the property within
the said Riverside Avenue Annexation, and
WHEREAS, thereafter notice for hearing on the 23rd day of April 1964,
on an ordinance approving the annexation of said territory and including the
same within the limits and jurisdiction of the City of Fort Collins was duly
published as provided by law and
WHEREAS the Council of the City of Fort Collins has found that the
petition and documents thereto attached meet the requirements of Article 11
Chapter 139 Colorado Revised Statutes 1953 and has accepted said petition and
WHEREAS no proceedings for an election to determine the question of
annexation have been initiated by written counter-petition as provided by law
and no objection to annexation having been made
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That after due consideration of the petition for annexation
the petition for the annexation of all the territory in what is known and
described as the Riverside Avenue Annexation to/the City of Fort Collins
Colorado, as shown by the plat thereof annexed to said petition and which is
more particularly described as follows, to-wit
Begin at a point 1,118 9 feet North of the SW corner of
the NFA of the NEA of Section 13, Township 7 North, Range
69 West of the 6th P M , thence South 49 221 East 186 5
feet thence South 223 1 feet thence East 281 0 feet,
thence North 30 0 feet, thence Northwesterly 373 66 feet,
thence Northwesterly again 181 0 feet thence South 65 6
feet to the point of beginning, containing 1 2 acres,
more or less
be accepted and approved and that said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and jurisdiction
of the City of Fort Collins as "D" Commercial District, and that the City
Clerk be and he is hereby authorized and directed to prepare certified copies
of this ordinance to each of which shall be attached a plat of said Riverside
Avenue Annexation to the City of Fort Collins, Colorado, and shall file a copy
thereof in the office of the Clerk and Recorder of the County of Larimer, and
another copy thereof in the office of the Clerk of the City of Fort Collins,
together with a certified copy of said petition, and another copy of said
petition and approving ordinance with the Secretary of State of the State of
Colorado
Section 2 That in accepting and approving the plat of the Riverside
Avenue Annexation to the City of Fort Collins, the City of Fort Collins does
not assume obligations respecting the construction of water mains, sewer lines
gas mains electric light lines or other services or utilities with respect to
service of said addition, except as may be required and provided by the owners
of the property within the limits of said addition in compliance with the terms
and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins,
Colorado 1958 as amended, relating to local and public improvements
Introduced, considered favorably on first reading and ordered
published this 23rd day of April, A D 1964 and to be presented for final
passage on the 14th day of May, A D 1964
