HomeMy WebLinkAbout027 - 08/13/1964 - ANNEXING PROPERTY KNOWN AS THE THUNDERBIRD ESTATES SIXTH ANNEXATION ORDINANCE NO , 27 , 1964, ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE THUNDERBIRD ESTATES SIXTH ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE ll, CHAPTER 139, COLORADO REVISED STATUTES, 1953 WHEREAS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, by the owners of more than fifty per cent (507) of the area and who comprise the majority of land- owners residing in the area of land embraced in what is known as the Thunderbird Estates Sixth Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the Thunderbird Estates Sixth Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on June 11, 1964, and WHEREAS, notice for hearing on the 23rd day of July, 1964, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation, the petition for the annexation of all the territory in what is known and described as the Thunderbird Estates Sixth Annexation to the City of Fort Collins, Colorado, as shown by thelplat thereof annexed to said petition and which is more particularly described as follows, to-wit A tract of land situate in the NWk of the NWk of Section 25, Township 7 North, Range 69 West of the Sixth P M , Which, considering the North line of said NWk as bearing N 89°45' E and with all bearings contained herein rela- tive thereto, is contained within the boundary lines which begin at the Northwest corner of said Section 25 and run thence N 89°45' E 200 00 feet, thence S 00000'45" E 190 00 feet, thence S 89°45' W 200 00 feet, thence N 00000'45" W 190 00 feet, to the point of beginning, containing 0 872 acres more or less, be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as a "D" Commercial District, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said Thunderbird Estates Sixth Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition, and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the Thunderbird Estates Sixth Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, relating to local and public improvements Introduced, considered favorably on first reading and ordered published this 23rd day of July, A D 1964, and to be presented for final passage on the 13th day of August, A D 1964 a or ATTEST City C rk -2- Passed and adopted on final reading this 13th day of August, A D 1964 -A All yor ATTEST City Cl rk -3-
