"WEST" ANNEXATION TO THE CITY OF FORT COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS- DICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN ARTICLE 11 CHAPTER 139 COLORADO REVISED STATUTES 1953 WHEREAS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, by the owners of more than fifty per cent (507) of the area and who comprise the majority of land- owners residing in the area of land embraced in what is known as the First Fairview "West" Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the First Fairview "West" Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as herein- after set forth, and WHEREAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on June 11, 1964, and WHEREAS, notice for hearing on the 23rd day of July, 1964, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter-petition as provided by law and no objection to annexation having been made, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That after due consideration of the petition for annexation, the petition for the annexation of all the territory in what is known and described as the First Fairview "West" Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to-wit Part of the Southwest Quarter (SWk) of Section 15, Township 7 North, Range 69 West of the 6th Principal Meridian, in the City of Fort Collins, County of Larimer, State of Colorado, contained within the boundary lines which considering the South line of said Southwest Quarter (SWk) of Section 15 as bearing North 89°49'30" West and with all other bearings contained herein relative thereto Commencing at the south- west corner of the Southwest Quarter (SWk) of Section 15, Township 7 North, Range 69 West of the 6th Principal Meridian, thence South 89'49'30" East along the South line of the South- west Quarter (SWk) of said Section 15 a distance of 1,419 00 feet to the True Point of Beginning, said point being the southeast corner of Miller Brothers South Foothills Subdivision, Fourth Filing, as platted and recorded in the Records of Larimer County, Colorado, thence North 00°32100" West along the East line of said Miller Brothers South Foothills Subdivision, Fourth Filing, 660 00 feet, thence South 89049'30" East 174 89 feet, thence South 00'32'00" East 264 97 feet, thence South 00010'30" West 10 00 feet, thence South 89°49'30" East 108 00 feet, thence North 00010'30" East 42 69 feet, thence North 77'08'10" East 118 58 feet, thence along the arc of a curve to the right whose radius is 325 00 feet and whose long chord bears North 10°19'20" West a distance of 28 82 feet, thence North 82013'10" East 181 23 feet, thence North 00*10130" East 52 14 feet, thence South 89`49'30" East 199 91 feet, thence North 14049'30" West 27 37 feet, thence North 75010130" East 165 94 feet, thence South 09'41'30" East 178 22 feet, thence South 00024'20" East 317 56 feet, thence South 12000'00" East 139 39 feet to a point on the South line of the Southwest Quarter (SWk) of said Section 15, thence North 89°49'30" West along the South line of the Southwest Quarter (SWk) a distance of 984 01 feet to the True Point of Beginning, be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as an "A" Residence District, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said First Fairview "West" Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition, and another copy of said petition and approving ordinance with the Secretary of State of the State of Colorado Section 2 That in accepting and approving the plat of the First Fairview "West" Annexation to the City of Fort Collins, the City of Fort Collins does not assume obligations respecting the construction of water mains, sewer lines, gas mains, electric light lines or other services or utilities with respect to service of said addition, except as may be required and provided by -2- the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, relating to local and public improvements Introduced, considered
