BEING AN ORDINANCE SUMMING TO THE QUALIFIED
ELECTORS OF THE CITY OF FORT COLLINS THE QUESTION
OF AMENDING SECTION 19 ARTICLE IV and ARTICLE IX
OF THE CITY CHARTER AID DECLARING AN EMERGENCY.
WHEREAS, Section 5 of Article XX of the constitution of the State of Colorado
provides that the City Council may on its own initiative submit any charter amendment
at any general municipal election held not less than thirty days after the effective
date of the ordinance submitting such question to the voters, and
WHEREAS, a general city election will be held on Tuesday, the a day of April,
A D., 1967, and
WHEREAS, it is the opinion of the City Council that there should be submitted
to the qualified voters of the City of Fort Collins the matter of amending Section 1
of Article IV and Article IX of the Charter of the City of Fort Collins.
NOW, THMEFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That there is submitted to the qualified voters of the City of
Fort Collins at the general election to be held on Tuesday, the a day of April,
A D , 1967, the question of whether or not Section 1, Article IV of the Charter of
the City of Fort Collins should be amended by inserting after the words "a Board
of Zoning Appeals" the words "a Water Board" and whether or not Article IX of the
Charter of the City of Fort Collins should be amended by adding thereto the following
Section
"Section 7 Water Board.
There shall be a Water Board which shall consist of
such number of members as set by the City Council not to exceed
ten. All members of the Water Board shall serve without compensation
and shall be appointed by the City Council The City Manager shall
serve as an ex officio voting member of such board. The term of the
appointed members of the board shall be four years except that the
initial appointment shall specify the term of office of each individual
in order to achieve overlapping of terms. All members shall be subject
to removal by the Council and any vacancy during the unexpired term of
any member shall be filled by the Council for the remainder of the term.
The duties and functions of the Water Board shall be
A. To advise the Council on all matters
pertaining to the acquisition, control and disposition
of water rights.
B. To advise the Council in all matters
pertaining to the municipal water works system.
C. To perform such other duties and functions
and have such other powers as may be provided by ordinance
of the City Council"
Section 2. In the opinion of the City Council an emergency exists for the
actual preservation of the public peace, health, safety and property and this
ordinance shall take effect upon its passage under and by virtue of the authority
contained in Sections 6 and 7 of Article II of the Charter of the City of Fort
Collins
Introduced, read at length and adopted by the unanimous vote of all members
of the City of Fort Collins City Council at a regular meeting held this 91 day
of February, A D., 1967

I, MILES F HOUSE, City Clerk of the City of Fort Collins, do
hereby certify and declare that the aforesaid Ordinance, consisting of
two sections, was duly proposed and read at length at a regular meeting
of the City Council held on the 9th day of February, A D. 1967, and
was duly adopted and ordered published in the Fort Collins Coloradoan,
a daily newspaper and official newspaper of the City of Fort Collins,
by the unanimous vote of all members of the City Council, as an Emergency
Ordinance, in accordance with the provisions of Section 6 and 7 of Article
n of the City Charter, and thereafter and on, to-wit the 14th day
of FebroalT , A. D 1967, said Ordinance No 8 was duly
published in the Fort Collins Coloradoan, a daily newspaper published in
the City of Fort Collins, Colorado
IN WITNESS WHEREOF, I have hereunto set my hand and affixed the
seal of said City, this lath day of February , A D 1967
