HomeMy WebLinkAbout028 - 06/08/1972 - APPROVING THE ACQUISITION OF 7 SHARES OF THE WATER SUPPLY AND STORAGE COMPANY AND 300 ACRE FOOT UNIT �J ORDINANCE NO 1972 APPROVING THE ACQUISITION OF SEVEN (7) SHARES OF THE WATER SUPPLY AND STORAGE COMPANY AND THREE HUNDRED (300) ACRE FOOT UNITS OF THE WATERS OF THE NORTHERN COLORADO WATER CONSERVANCY DISTRICT DETER MINING THAT THE AVAILABILITY OF SUCH WATER RIGHTS IS AN UNFORESEEN CONTINGENCY ARISING AFTER THE PASSAGE OF THE ANNUAL APPROPRIATION ORDINANCE AND APPROPRIATING THE SUM OF TWO HUNDRED TWENTY NINE THOUSAND DOLLARS ($229 000 00) FOR THE PURPOSE OF PURCHASING SUCH WATER RIGHTS WHEREAS an offer has been made to the City of Fort Collins to sell to the City seven (7) shares of the capital stock of the Water Supply and Storage Company and three hundred (300) acre foot units of the waters of the Northern Colorado Water Conservancy District and WHEREAS the availability of such water rights was not anticipated at the time of the passage of the annual appropriation ordinance for the City and such availability is therefore an unforeseen contingency within the exception contained within Section 8 of Article V of theF Charter of—the city 6-f—Fort—Loll3ns and — WHEREAS in the opinion of the City Council it is in the best interest of the City to acquire such water rights at the price asked by the owner of the same to wit Two Hundred Twenty Nine Thousand Dollars ($229 000 00) NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the City Council hereby finds and determines that the availability of the water rights mentioned above is an unforeseen contingency arising after the passage of the annual appropriation ordinance Section 2 The acquisition of such water rights at a price of $229 000 00 is hereby authorized and the City Manager is directed to acquire such water rights at such price Section 3 There is hereby appropriated from unbudgefed surplus funds in the water fund for extensions improvements enlargement and betterment the sum of Two Hundred Twenty Nine Thousand Dollars ($229 000 00) such amount to be expended for the acquisition of additional water rights by the City Introduced considered favorably on first reading and ordered published this 18th day of May A D 1972 and to be presented for final passage on the 8th day of June A D 1972 Q C.
