ORDINANCE NO 94 1972
BEING AN ORDINANCE CALLING A SPECIAL MUNICIPAL ELECTION ON
FEBRUARY 20 1973 AND SUBMITTING TO THE QUALIFIED ELECTORS
OF THE CITY CERTAIN CHARTER AMENDMENTS
WHEREAS heretofore a committee was appointed to make recommends
tions to the City Council as to any Charter Amendments to be submitted to the
qualified electors of the City and
WHEREAS said committee has recommended to the City Council that
certain Charter Amendments be submitted to the qualified electors of the City
for consideration and
WHEREAS Section 5 of Article XX of the Constitution of the State
of Colorado provides that the City Council may submit any Charter Amendment
question at any general or special state or municipal election held not less
than thirty (30) days after the effective date of the Ordinance or Resolution
submitting such question to the voters and
WHEREAS, the City Council is of the opinion that such Charter Amend
ments should be submitted for a vote of the people
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That a special municipal election in the City of Fort
Collins is hereby called for Tuesday the 20th day of February 1973
Section 2 There are hereby submitted to the qualified electors
of the City of Fort Collins at said special election the following proposed
Charter Amendments
PROPOSED CHARTER AMENDMENT NO 1
Shall the Charter of the City of Fort Collins be amended in the
following particulars
Amend Section 1 Article II of the Fort Collins Charter
to read as follows
Section 1 Membership
a The council shall have seven (7) members elected as herein
provided
b Three (3) of such council members shall be nominated
and elected from the city at large The remaining four (4) members
shall be nominated by districts in the City established by Ordinance
of the City Council and elected by the City at large Commencing
with the general election in 1977, the City Council shall by
Ordinance at least six (6) months before any election at which
council members will be elected from districts divide the City
into four (4) districts each consisting of approximately the same
numiberrof electors and each district representing one (1) con
f..inuous reasonably compact unit One (1) council member shall
be elected from each district so established by the City at large
c Until the regular city election in April 1973 the five
(5) present members of the council shall constitute the City Council
Not later than fifteen (15) days from the passage of this Amendment
the City Council shall by Ordinance divide the City into four (4)
districts meeting the qualifications set forth in (b) above which
shall be the districts from which councilmen shall be nominated
for the regular city election in 1973 and four (4) councilmen shall
be elected at such election one (1) from each such district Such
ordinance may be passed as an emergency measure The three (3)
incumbent council members whose terms do not expire in 1973 shall
constitute the at large members of the council and shall continue
to serve until the expiration of their term of office as now es
tablished after the general city election in April 1975 at which
election their successors shall be elected at large
d The term of office of all members of the City Council
shall be four (4) years each or until their successors have been
elected and have taken office Each regular bi annual city elec
tion shall alternate between selecting at large members of the
council and members nominated from districts The term of members
of the Council shall begin at 10 00 o'clock A M on the first Tues
day after the second Monday in April of the year in which they
shall have been elected
Amend Section 6 Article II of the Fort Collins Charter by deleting
the word four from the second sentence from the end of the second paragraph
of said section and by substituting therefore the word five
Amend Section 11 Article II of the Fort Collins Charter by deleting
the third sentence of said section and by substituting therefore the following
A majority of the Council shall constitute a quorum sufficient
to transact business
Amend Section 18 Article II of the Fort Collins Charter by deleting
therefrom the second sentence of said section and by substituting therefore
the following
Any vacancy in an elective office shall be filled within thirty
days by appointment of the Council Such appointment shall be
for the unexpired portion of the term
PROPOSED CHARTER AMENDMENT NO 2
Shall Section 3 Article II of the Charter of the City of Fort
Collins be amended as follows?
By deleting from said section the figures $400 and 1$500'
and by substituting therefor the figures $15001and 1$2000'
respectively
PROPOSED CHARTER AMENDMENT NO 3
Shall Section 2 Article II of the Charter of the City of Fort
Collins be amended to read as follows?
Section 2 Qualification of Members No person shall be ell
gi le to office as councilman unless at the time of his election
(or appointment, if appointed pursuant to this Charter to fill
an existing vacancy) he be a citizen of the United States, at

least 21 years of age and shall have been for two years imnedia
tely preceeding such election (or appointment) a resident of the
City of Fort Collins and at the time of his election (or appoint
ment) he shall be a registered elector of the City duly registered
to vote in elections in the City In addition, any person elected
(or appointed) after the general municipal election in 1973, shall
in order to be eligible to the office as councilman, have voted
in the last prior general or special municipal election an the
City Any person meeting the foregoing requirements on the date
of election shall be eligible to the office of councilman of the
City of Fort Collins "
Section 3 At such election there shall be submitted any additional
matters including proposed ordinances which the council may elect to refer to the
qualified electors of the City
Introduced considered favorably on first reading, and ordered published
this 14th day of December, 1972 and to be presented for final passage on the 4th day
of January A D 1973
