OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE FROM THE AMERICAN RECOVERY
AND REINVESTMENT ACT TO THE TRANSIT FUND
WHEREAS,the American Recovery and Reinvestment Act("ARRA"), signed into law by
President Barack Obama on February 17, 2009, included $8.4 billion made available for transit
capital improvements; and
WHEREAS,the City has received$2,474,832 in ARRA funds("ARRA Funds")that do not
require local matching funds; and
WHEREAS, $2,433,792 of the ARRA Funds will be used to replace the oldest model
vehicles in the Transfort fleet, consisting of heavy duty Gillig buses, with six NABI 40 foot low-
floor Compressed Natural Gas ("CNG") replacement buses; and
WHEREAS,the addition of these new buses will increase the City's CNG fleet component
to ten buses and demonstrate the City's commitment to sustainability; and
WHEREAS, the remaining $41,040 of ARRA Funds will be used to purchase Proximity
Card Readers for Transfort's fixed route fleet of buses to facilitate the use of Colorado State
University student identification badges as legitimate fare media; and
WHEREAS, Article V, Section 10, of the City Charter authorizes the City Council to make
supplemental appropriations by ordinance at any time during the fiscal year, provided that the total
amount of such supplemental appropriations,in combination with all previous appropriations for that
fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received
during the fiscal year; and
WHEREAS,-City staff has determined that the appropriation of the revenue as described
herein will not cause the total amount appropriated in the Transit Fund to exceed the current estimate
of actual and anticipated revenues to be received in that fund during any fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated from unanticipated revenue from the American Recovery
and Reinvestment Act in the Transit Fund the sum of TWO MILLION FOUR HUNDRED
SEVENTY FOUR THOUSAND EIGHT HUNDRED THIRTY TWO DOLLARS ($2,474,832 for
expenditure in the Transit Fund.

October, A.D. 2009, and to be presented for final passage on th rd ay of November, A.D. 2009.
