OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 71, ARTICLE I
OF THE CODE OF THE CITY OF FORT COLLINS
AS IT PERTAINS TO THE PUBLIC LIBRARY
WHEREAS, Chapter 71, Article I of the Code of the City of Fort Collins
pertains to the Public Library; and
WHEREAS, on April 5, 1977, the people of the City of Fort Collins
approved a Charter amendment affecting Chapter 71 , Article I of the
Code of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins wishes to amend
Chapter 71, Article I to conform with current practices; and
WHEREAS, the Public Library Board has reviewed and recommends approval
of said amendments.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
1. That Section 71-1 of the Code of the City of Fort Collins be, and
it hereby is, amended to read as follows:
§ 71-1 . Public Library Board; membership, term and
appointment.
(a) There is hereby created a Public Library Board,
which board shall consist of five ( 5 ) regular
members and two (2) alternate members to be ap-
pointed by the Council . The regular members shall
hold office for a period of four (4) years, as
provided by the Charter, Article XX, Section 1.
The alternate members shall hold office for a
period of two (2) years. All members of said
board shall serve without compensation. The Council
shall make the appointments so that at least one (1)
and not more than two (2) regular members shall be
appointed every year, except to fill vacancies for
unexpired terms.
(b) Regular members shall have the voting privilege as
specified in the bylaws of the Public Library
Board. Alternate members shall have the voting
privilege only when serving in the absence of a
regular member.
2. That Section 71-2 of the Code of the City of Fort Collins be, and
it hereby is, amended to read as follows:
§71-2. Officers; duties; rules and regulations.
The Public Library Board shall elect a president, vice
president and secretary from its membership annually,
whose duties shall be as such as may be prescribed
by the bylaws, rules and regulations to be adopted
by the Public Library Board, which said bylaws, rules
and regulations shall not be inconsistent with the
Charter and ordinances of the City of Fort Collins.
After adoption, a copy of said bylaws,' rules and regu-
lations shall be filed with the Clerk for the use of the
Council .
3. That Section 71-3 of the Code of the City of Fort Collins be, and
it hereby is, amended to read as follows:
§71-3. Public Library Board Authority.
The Public Library Board shall serve in an advisory
capacity to the Council on all issues pertaining
to the public library. The Public Library Board shall
have the following authority:
(a) To adopt such policies, rules and regulations
as it shall deem necessary to govern the use
of the public library and its facilities and
to do such other advisory acts as directed by the
Council as may be necessary for the orderly and
efficient management and control of the library.
(b) To take such steps as the board may deem feasible to
encourage grants or gifts in support of the City
library.
(c) To do any and all things usual and necessary
and not in conflict with the Charter and ordinances
of this City or the laws of the State of Colorado in
developing the public library and branch facilities
for the benefit of the inhabitants of the City of
Fort Collins.
4. That Chapter 71, Article I of the Code of the City of Fort Collins
be, and it hereby is, amended by deleting therefrom Section 71-4 (Submis-
sion of budget; claims approval . ) and renumbering the remaining sections
appropriately.

5 That Chapter 71, Article I of the Code of the City of Fort Collins
be, and it hereby is, amended by deleting therefrom Section 71-5 (Develop-
ment of library ) and renumbering the remaining sections appropriately
6 That Section 71-6 of the Code of the City of Fort Collins be, and
it hereby is, amended to read as follows
§71-6 Library to be free, regulations, reports
The Public Library and branch facilities as now estab-
lished and all public libraries and branch facilities to
be hereafter established within the corporate limits of
the City of Fort Collins, shall be forever free to the
use of the inhabitants of said City always subject to
reasonable rules and regulations as the Public Library
Board may adopt in order to render the use of said
library and branch facilities of the greatest benefit to
the greatest number Upon the direction of the Council
it shall be the duty of the Public Library Board
to make a report to the Council of the condition of the
library and its operation and management, said report to
contain such information as the Council may deem of
general interest
