HomeMy WebLinkAbout033 - 03/04/1980 - AMENDING CHAPTER 16 OF THE CITY CODE AND PROVIDING FOR THE WAIVER OF CERTAIN REQUIREMENTS IN THE FOR OPDIP'ANCE NO 33, 19EO OF THE COUNCIL OF THE CITY OF FORT COLLIi S AhEhDIP'a CH4PTEP 16 OF THE CODE OF THE CIT`t OF FORT COLLINS AND PPOVIDIPG FOR THE 14AIVEP OF CE:TAI,, RLQUIPLMEPITS In ThE FORP,ATIO,', OF LOCAL PUBLIC IPiPPOVEHENT DISTRICTS WHEREAS, Chapter 16 of the Code of the City of Fort Collins provides for the initiation and formation of Local Public Improvement Districts, and k'HEkEAS, in Chapter 16 a number of procedural safeguards have been included to provide for the protection of the public at large, and WHEREAS, upon occasion, in the interest of time and convenience, all property o m trs in an improvement district have requE,ted authorization to waive certain of the procedural reouiremerts set forth in Chapter 16 NOW, THEPEFOPE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 16 of the Code of tFe Cit, of Fort Collins be, and it nereby is, aTended by the addition thereto of a new Section 16-38 to read as follows §16-38 Waiver Any of the provisions of this Chapter relatinq to public heariPns, notice, puhlication, lettino of bids, or other procedural aspects relatino to the initiation or formation of districts may be waived In order to be effective, such a vaiver must be in writing, must be signed by the ovnern of all prope-ty in the dis- trict v,hich is to be assessed, and by the City Ptanager if the City is to bear any of the costs of the im- provements, and must state the requirements of this Chapter which are being waived No person shall be permitted to withdraw a ,vritten wdiver once it has been submitted to the City Council for consideration Passage of Ordinance That the in-riediate adoption of the foregoinq ,neesures a e necessary to preserve, protect, ar,a advance the general welfare and safety of the res .dents of the City of Fort Collins There- fore, the City Council hereby determines that an emergency does exist requiring the imrrediate passane of this Ordinance, and this Ordinance is, therefore, enacted Pursuant to Section 6 of 4rticle II of the Charter of the City of Fort Collins as an Energency Ordinance and shall become effec- tive upon its passane Introduced, considered favorably by 7 members of the City Council upon reading, finally passed as an Emergency Ord iriance and orderea pub- lished this 4th day of March A D 19b0 f is or ATTEST i y Clerk r -2-
