BEING AN ORDINANCE AMENDING CHAPTER 47 OF THE
CODE OF THE CITY OF FORT COLLINS ADOPTING AN
ELECTRICAL CODE AND PROVIDING FOR THE PROTECTION
OF THE PUBLIC HEBLTH AND SAFETY AND RELATING TO
THE REGULATION OF PERSONS ENGAGED IN THE BUSINESS
OF ELECTRICAL WIRING, PERSONS LABORING AT THE
TRADE OF ELECTRICIAN, THE INSTALLATION, ALTERA-
TION OR REPAIR OF ELECTRICAL WIRING, AND THE
INSPECTION THEREOF, IN THE CITY OF FORT COLLINS
AND ADOPTING BY REFERENCE THE NATIONAL ELECTRICAL
CODE, 1978, PROMULGATED BY THE NATIONAL FIRE
PROTECTION ASSOCIATION, AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
Section 1 Pursuant to the authority conferred by Section 7 ,
Article II, of the Charter of the City of Fort Collins, there is
hereby adopted by the City of Fort Collins for the purpose of
providing for the protection of public health and safety and
for the purpose of regulating persons engaged in the business
of electrical wiring, or persons laboring at the trade of
electrician, or for the purpose of regulating the installation,
alteration or repair of electrical wiring systems in the City
of Fort Collins, Colorado, that certain code known as the
National Electrical Code, 1978 , promulgated by the National
Fire Protection Association and the whole thereof, including
the introduction, tables and examples, index and appendix
thereto, of which Code not less than three copies have been
and now are filed in the office of the Clerk of the City of
Fort Collins and may be inspected at regular business hours
or purchased by the public at a price not to exceed the actual
cost of the same to the City of Fort Collins, and such Code is
hereby adopted and incorporated as fully as if set forth at
length herein and from the date on which this ordinance shall
take effect, the provisions thereof shall be controlling within
the limits of the City of Fort Collins, Colorado
Section 2. That Section 47-2B of the Code of the City of
Fort Collins be, and the same hereby is, repealed.
Section 3 That Section 47-3 of the Code of the City of
Fort Collins be, and the same hereby is, amended by deleting
therefrom the words and figures "National Electrical Code,
19750, and by substituting therefor the words and figures.
"National Electrical Code, 1978" .
Section 4. Amendments to Code Adopted.
A. By deleting Section 250=81 and substituting in its
place the following•
"250-81. Water Pi a Electrode. Where available on
the premises, a meta un erground water pipe shall
always be used as the grounding electrode, regard-
less of its length and whether supplied by a
community or a local underground water piping system
or by a well on the premises Where the buried
portion of the water pipe (including any metal well
casing effectively bonded to the pipe) is less than
10 feet long or where the water pipe is or is
likely to be isolated by insulated sections or
joints so that the effectively grounded portion
is less than 10 feet long, it shall be supplemented
by the use of an additional electrode of a type
specified by Section 250-82 or 250-83. The interior
metal cold water piping system shall always be
bonded to the service-equipment enclosure, the
grounded conductor at the service, the grounding
electrode conductor where of sufficient size, or
to the one or more grounding electrodes used.
Expanding use of nonmetallic piping for water systems and
insulating couplings on metal water systems makes it more
important that water piping within a building be adequately
grounded without depending on connections to an outside
piping system "
B. By the addition to the Code of the following section•
"250-82. Other Available Electrodes. Where a water
system as described in Section 250- 1 is not available,
the grounding connection shall be made to any of the
electrodes specified in (a) through (d) below, where
available
(a) The metal frame of the building, where effectively
grounded

(b) Concrete-encased steel reinforcing bar or rod
systems of underground footings or foundations where
the total rod length, diameter, and depth below earth
surface are not less than 50 feet, 3/8 inch, and
2h feet respectively The required length shall be
made up of one or more rods
(c) An electrically continuous metal underground
gas piping system that is uninterrupted with insulating
sections or joints and without an outer nonconductive
coating, and then only if acceptable to and expressly
permitted by both the serving gas supplier and the
authority having jurisdiction
(d) Other local metal underground systems or structures,
such as piping systems and underground tanks."
c By the deletion from the Code of Section 250-83 and
the substitution therefor of the following Section:
"250-83 Made Electrodes Where none of the electrodes
specified in Sections 250-81 and 250-82 is available,
one or more of the electrodes specified in (a) , (b) ,
or (c) below shall be used. Where practicable, electrodes
shall be embedded below permanent moisture level. Where
more than one electrode is used (including those used
for signalling or communication circuits, radio or
television installations, or lightning rods) , each
electrode shall not be less than 6 feet from any other
electrode
Two or more electrodes that are effectively bonded together are
to be treated as a single electrode in this sense
(a) Concrete-Encased Electrodes. Not less than 20
feet of 1 are copper conductor not smaller than
No. 4 , or (2) steel reinforcing bar or rod encased
by at least 2 inches of concrete and located within
and near the bottom of a concrete foundation footing
that is in direct contact with the earth
(b) Rod and Pipe Electrodes. Rod and pipe electrodes
shall not be less than 8 feet in length and shall
consist of the following materials, and shall be installed
in the following manner.

(1) Electrodes of pipe or conduit shall not be
smaller than 3/4 inch trade size and, where of iron
or steel, shall have the outer surface galvanized
or otherwise metal-coated for corrosion protection
(2) Electrodes of rods of steel or iron shall be
at least 5/8 inch in diameter Nonferrous rods
or their equivalent shall be listed and shall be
not less than 1/2 inch in diameter.
(3) Where rock bottom is not encountered, the
electrode shall be driven to a depth of 8 feet.
Where rock bottom is encountered at a depth of less
than 4 feet, electrodes not less than 8 feet long
shall be buried in a trench. All electrodes shall
be free from nonconductive coatings, such as paint
or enamel.
(c) Plate Electrodes. Each plate electrode shall
expose not less than 2 square feet of surface to exterior
soil Electrodes or iron or steel plates shall be at
least 1/4 inch in thickness Electrodes of nonferrous
metal shall be at least 0.06 inch in thickness "
Section 5. The Code adopted by this ordinance (the National
Electrical Code, 1978) does not contain any separate penalty
provision Section 1-23 of the Code of the City of Fort Collins,
which provides as follows:
"61-23. General penalty for violations.
"Any person, firm or corporation who shall violate any
provision of the Code, or any provision of any code or
other regulation adopted by reference by this Code, by
doing any act prohibited or declared to be unlawful
thereby, or declared to be an offense or misdemeanor
thereby, or who shall engage in or exercise any
business or occupation or do anything for which a
license or permit is required, without having a valid
license or permit therefor as required, or who shall
fail to do any act required by any such provision, or
who shall fail to do any act when such provision declares
such failure to be unlawful or to be an offense or mis-
demeanor, shall be guilty of a misdemeanor, and, upon
conviction, shall be punished by a fine not exceeding
three hundred dollars ($300 ) or by imprisonment not
exceeding ninety (90) days, in addition to the collection
of any costs which may be provided for, unless a specific
penalty is provided for a particular misdemeanor. Each
day upon which any violation shall continue shall con-
stitute a separate misdemeanor unless some other specific
time period is provided for any particular violation. "
