BEING AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING
CLASSIFICATION FOR CERTAIN PROPERTY
AND MAKING CERTAIN FINDINGS RELATED THERETO
WHEREAS, heretofore, the City Council conducted a public
hearing for the purpose of considering a petition to rezone
certain property situate within the City limits and hereinafter
described, and aw
WHEREAS, at said hearing, the City Council received and
considered recommendations relative to said rezoning from the
City Planning staff and the City's Planning and Zoning Board
and further received and considered arguments from interested
persons both in favor of and opposed to said rezoning, and
WHEREAS, at said hearing, the City Council found and
determined based upon said recommendations, arguments and
evidence, and does hereby so find and determine as follows.
1 That a mistake was made at the time of rezoning
of said property from R-L, Low Density Residential
to R-M, Medium Density Residential, to-wit.
a The erroneous anticipation that enrollment at
Colorado State University would continue to
increase and thus necessitate more multi-
family uses close to the University
b. The erroneous belief that said property
would continue to convert to multi-family
uses
2 That, notwithstanding the fact that a mistake was
made in the prior rezoning of said property, there
has been a substantial change of conditions in the
neighborhood of the property, said changes consisting
of the following
a. Increased utilization of said property for
single-family dwellings
b. Conversion of existing multi-family dwellings to
single-family dwellings

c Reduced demand and necessity for multi-family
uses in the neighborhood
d Incompatibility of existing R-M, Medium Density
Residential zoning with predominantly single-
family uses In the area.
e. Increased traffic congestion in the area and
inability of the area to handle said congestion
f. Inadequate public improvements to accomodate
multi-family uses
3 That the within rezoning of the property promotes the
general welfare of the citizens of the City, is in
compliance with the City' s Comprehensive Plan and
in furtherance of the City's Goals and Objectives
of the Comprehensive Plan, to-wit
"l. To encourage the preservation and development of
unique qualities and characteristics of all
neighborhoods.
2 To preserve historical or unique buildings or
houses in older neighborhoods
3 To restrict extraneous motorized traffic from
residential areas.
4 To discourage the conversion to higher density
of older single-family neighborhoods where
supporting services and facilities would not
be sufficient
5 To identify those areas of the City which are
suitable for redevelopment of high intensity
residential uses and those areas which are
not, particularly noting availability of services,
facilities and services, and land uses in
adjacent areas
6 To promote the preservation and maintenance of
older houses and buildings which, while not of
a degree of significance to merit official
designation, make an important contribution to
the character and historical development of
the City "

4 . That on the basis of any or all of the above-referenced
findings, the property should be rezoned from R-M,
Medium Density Residential zone to R-L, Low Density
Residential zone.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF FORT COLLINS that the toning district map of the City of
Fort Collins, Colorado, adopted by the zoning ordinance of the
City of Fort Collins, is hereby amended by changing the zoning
classification from R-M, Medium Density Residential District
to R-L, Low Density Residential District for the following
described property in the City, to-wit
Beginning at the intersection of the centerline of
LaPorte Avenue and Shields Street, thence westerly
along the centerline of LaPorte Avenue 309 00 feet,
thence South - 332 94 feet, thence West - 154 40
feet, thence South - 2 56 feet, thence West - 73 00
feet, thence North - 1 56 feet, thence West - 80.50
feet, thence North - 153 94 feet, thence East -
78.50 feet, thence North - 180 00 feet, to the
centerline of LaPorte Avenue, thence Westerly along
the centerline of LaPorte Avenue to the centerline
of Lar caner County Canal #2, thence southerly along
said centerline to the centerline of Oak Street,
thence Easterly along said centerline to the center-
line of Roosevelt Avenue, thence Northerly along
said centerline, 250 feet, to the centerline of
the east-west alley running through Blocks 4, 3, 2,
and 1 of Scott-Sherwood Addition to the City of
Fort Collins, then Easterly along the centerline
of said alley to the centerline of Shields Street,
thence Northerly, 270 feet to the centerline of
Mountain Avenue, thence Westerly along said center-
line 125.25 feet, thence Northerly along the lot
line between Lots 2 and 3 of Grandview Addition to
the City of Fort Collins, to the centerline of the
east-west alley, thence Easterly to the centerline
of Shields Street, thence Northerly along said
centerline to the point of beginning.
Introduced, considered favorably on fir reading, and
ordered published this 20th day of June, A 978, and to be
presented for final passage on the 5t day July, A D. 1978
