BEING AN ORDINANCE AUTHORIZING POLICE,
FIRE AND EVERGFNCY MEDICAL PERSONNEL
TO ENTEP PRIVATE RESIDENCES WITHOUT
INVITATION DURING MEDICAL EMERGENCIES
WHEREAS, in furtherance of the public health and safety, the City of
Fort Collins provides personnel trained in emergency medical care and
treatment, and
WHEREAS, upon occasion, it is necessary for such persons to enter
private residences in response to perceived medical emergencies, and
WHEREAS, upon occasion, victims of medical emergencies are incapable
of consenting to the entry of the above-described premises, and
WHEREAS, it is both fitting and appropriate that certain designated
personnel trained in emergency care and treatment be granted the authority
to enter private residences in emergency medical situations
NO11, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 Authority to Enter Law enforcement officers commissioned
with the State of Colorado, members of the municipal fire department,
other fire departments operating under a mutual assistance agreement or
automatic aid agreement with the City of Fort Collins, certified emergency
medical technicians and paramedics during the course of employment with a
governmental agency are hereby qranted the authority to enter private
residences within the City of Fort Collins without invitation from the
occupant or occupants of said residence at any time such person has reason-
able grounds to believe a medical emergency is in progress kith r the
subject premises and the occupant or occupants of such premises are incap-
able of consenting to the entry because of such medical emergency
Section 2 Announced Purpose and Authority Unauthorized entry
pursuant to this Ordinance shall be permissable only after the individuals
seeking entry have announced both their purpose and authority in a loud and
conspicuous voice and have waited a reasonable period of time for the
occupants to respond before making entry
Introduced, considered favorably on first reading, and ordered pub-
lished this 6th day of February, A D 1979, and to be presented for
final passage on the 20th day of February, A D 979
