ORDINANCE NO 269 1979,
BEING AN ORDINANCE APPROVING AN AGREEMENT
BETWEEN THE CITY OF FORT COLLINS AND
BOETTCHER & COMPANY FOR ThE LEASE PND OPTIOd
TO PURCHASE CERTAIN EQUIPMENT
WHEREAS, the City has received a proposal from Boettcher & Company
whereby Boettcher & Company will lease to the City the following described
equipment

(the "Equipment") , and
WHEREAS, the City is authorized, under the provisions of Part 8,
Chapter 15, Title 31 , C R S 1973, as amended, to acquire necessary equip-
ment and other property for its governmental and proprietary purposes under
the provisions of a long-term rental or leasehold agreement with an option
to purchase sucn equipment, and
WHEREAS, the City Council of the City has determined that the City is
in need of the Equipment and that it is in the best interest of the City to
lease the Equipment from Boettcher & Company, which is providing financing
for the acquisition of the Equipment, and
WHEREAS, the City desires to enter into an equipment lease agreement
(the "Equipment Lease Agreement") with Boettcher & Company with respect to
the leasing of the Equipment, copies of which have been presented to the
City Council at this meeting, and
WHEREAS, the City has appropriated funds for the fiscal year 1979
which may lawfully be used to make payments coming due under the Equipment

with all necessary steps, including any legal bidding requirements, und"
applicable law to lease the Equipment under the Equipment Lease Agreement
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOPT
COLLINS

Section 1 Tne form, terms and provisions of the Equipment Lease
Agreement be, and they hereby are, approved and the City shall enter into
the Equipment Lease Agreement in substantially the form of such document
presented to this meeting
Section 2 The Mayor of the City and the City Clerk be, and they
hereby are, authorized and directed to affix the City seal to the Equipment
Lease Agreement, and each of such officers is hereby authorized to execute
the Equipment Lease Agreement
Section 3 The City Finance Director has examined the bid specifica-
tions for the Equipment and the Equipment Lease Agreement and has deter-
mined that sufficient moneys have been budgeted for and appropriated by the
City to make payments under the Equipment Lease Agreement during the
original term thereof
Section 4 The officers of the City shall take all action not in
violation of law necessary or reasonably required to effectuate the
execution and delivery of the Equipment Lease Agreement and the leasing of
the Equipment from Boettcher & Company and for carrying out, giving effect
to and consummating the transactions contemplated by this Ordinance and the
Equipment Lease Agreement, including, without limitation, the execution and
delivery of any closing documents and certificates to be delivered in
connection with the leasing of the Equipment, provided, however , that
nothing contained in the Equipment Lease Agreement or herein snall be
deemed to constitute a pledge of the funds, moneys or credit of the City
except as funds of the City may be appropriated in any fiscal year to any
payments of rentals under the Lease
Section 5 As required by the provisions of the Fort Collins City
Charter, this Ordinance and the approval of the Equipment Lease Agreement
thereby shall not be effective until March 16, 1979

WHEREUPON, it was moved by Councilmember Lloi�d D St C2o2i and
seconded by Councilmember Ea217 W277ez7ts072 to adopt Ordinance No 36 ,
1979, on first reading The motion was put to a vote, the vote being as
follows

Thereupon, the presiding officer declared said motion carried and said
Ordinance passed on first reading
After consideration of other business not related to the Equipment
Lease Agreement, on motion duly made, seconded and adopted, the meeting
thereupon adjourned
