HomeMy WebLinkAbout070 - 06/03/1980 - ANNEXING THE CUNNINGHAM CORNERS, THIRD ANNEXATION OPDINANCE NO 70 , 1980 BEING AN ORDINANCE ANNEXING PROPERTY KNOWN AS THE CUNNINGHAM CORNERS, 3rd ANNEXATION TO THE CITY OF FORT COLLINS, CCLORADO WHEREAS, heretofore, a written petition, together with. four prints of an annexation map was filed with the City Clerk of Fort Collins requesting the annexation of certain territory more particularly described below to the City, and WHEREAS, the City Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the provisions of Section 31-12-107 of the Colorado Revised Statutes, 1973, as amended, and WHEREAS, the owners of 100% of the property to be annexed have peti- tioned for said annexation, and WHEREAS, not less than one-sixth ( 1/6th) of the perimeter of the area to be annexed is contiguous Frith the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins, and the territory to be annexed is urban or will be urbanized in the near future, and such territory is integrated or is capable of being integrated with the City of Fort Collins, and WHEREAS, none of the provisions of Section 31-12-105 of the Colorado Revised Statutes, 1973, as amended, are violated by the annexation of this territory to the City, and WHEPEAS, no election is required under the provisions of Section 31-12-107(2) of the Colorado Revised Statutes, 1973, as amended, ano no additional terms and conditions are to be imposed in connection with this annexation, and WHEREAS, the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That all of the territory more particularly described as situate in the County of Larimer, State of Colorado, to-wit Considering the South line of the Southwest 1/4 of said Section 26 as bearing N 69`42 '55" E and with all bearings contained herein relative thereto Commencinq at the Southwest corner of said Section 26, thence alona the said South line, N 89°42155" E, 1318 69 feet to the True Point of Beginning said point beinq the Southeast corner of Cunningham Corner Second Annexation, thence along the West line of Cunningham Corner Second Annexation, H 00021140" 41, 1325 24 feet to a point on the South line of Worthington Farm First Annexation, thence along said South line N 89°a6 '4C" E, 330 21 feet to a point on the West line of Cunningham Corner Annexation, thence along said West line S 00020110" E, 1324 88 feet to a point on the North line of the West Horsetooth Annexation, thence along said North line S 89*42155" W, 329 67 feet to the True Point of Beginning Said tract of land also described as the West 1/2 of the West 1/2 of the Southeast 1/4 of the Southwest 1/4 of the said Section 26 be, and it hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the Cunningham Corners, 3ro Annexation Section 2 That in annexinq said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins Section 3 Within ninety (90) days from the date this Ordinance becomes effective, no building permit shall be issued for any of the lands herein described unless said lands have been zoned unaer the zoning ordi- nances of the City Introduced, considered favorably on first reading, and ordered pub- lished this 20th day of May A D 1980, and to be presentee for final passage on the 3rd day of June A D 1980 Y ATTEST L' er< -2- Passed and aaopted on final reading this 3rd day of June A 0 1980 May AT-TE T i e -3-
