ORDINANCE NO 128 , 1980
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 32 OF THE CODE OF THE CITY OF
FORT COLLINS AS IT RELATES TO ALARM SYSTEMS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS
Section\ 1 That the following definition contained within Section
32-2 of the Code of the City of Fort Collins be, and the same hereby is,
amended to read as follows
"§32-2 A\arm System Any mechanical or electrical
(AC/DC) device or system which is designed or used for
the protection of an unauthorized entry into a building,
structure orNfacility or for the detection of fire or
other hazard to\life or property or used for mechanically
or electronically alerting others through externally
audible or visual`ignal to the commission of an unlawful
act, whether installed within or without a building
Devices which are excNlusively audible or visible within the
interior of a building` premise, struture, or area, are not
d included within this e inition or within this chapter
Section 2 That Section 32-4 E (3) of the Code of the City of Fort
Collins be, and the same hereby is, amendea to read as follows
"§32-4 E (3) In the event that any alarm system is deemed
unreliable pursuant to Section\32-4 E (2) , the Chief of the
Police Department or Fire Department may declare the system
"unreliable" and restrict or curtail the response of that
department to that alarm system \until such time as the
subscriber or alarm business can show a material change in
employee training, can show written proof that the system
has been repaired, can show written proof that the system
has been reinspected by the Building Inspection Division,
and can show proof of issuance of a new certificate of
compliance (alarm system) "
Section 3 That Section 32-5 D (2) of the Code\of the City of Fort
Collins be, and the same hereby is, amended to read as follows
"§32-5 D (2) No person shall receive a cer "f`icate
of compliance (alarm system) or renewal of such certificate
without a written maintenance contract with a licensed
alarm business who shall be responsible for maintenance
of the alarm or alarm system for the specified duration of

the contract The certificate of compliance (alarm system)
is considered valid only when a maintenance contract and
all other provisions listed herein exist The certificate
of compliance shall be kept on the premises where the alarm
system is located "
Section 4 That Section 32-6 of the Code of the City of Fort Collins
be, and it hereby is, amended by the addition thereto of a new subsection
(C) to read as follows with the remaining subsections to be renumbered
appropriately
"§32-6 C Enforcement Authority The enforcement authority
for any license or certificate issued hereunder shall be
the Police Department "
Section 5 That Section 32-8 C of the Code of the City of Fort
Collins be, and the same hereby is, amended to read as follows
'°§32-8 C Certificate The fee for a certificate of
compliance (alarm system) shall be Ten Dollars ($10 00)
which shall be due and payable within ten (10) days of
the installation of an operable alarm system by any
person possessing or using an alarm system, proprietory
alarm, fire alarm, or other emergency alarm within the
City Each such certificate shall be considered valid
until such time that the system is declared unreliable
under the provisions stated herein Each time a system
is declared unreliable, the system will need to be repair-
ed, reinspected, and have a new certificate of compliance
issued No portion of any certificate fee shall be refund-
able or applicable to the new certificate fee "
Introduced, considered favorably on first reading and ordered pub-
lished this 7th day of October, 1980, and to be presented for final
passage on the 21st day of October, 1980
