OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 95, ARTICLE VI OF THE
CODE OF THE CITY OF FORT COLLINS TO INCLUDE
PROVISIONS CONCERNING THE CONSTRUCTION OF
DRIVEWAYS FOR ACCESS TO STATE HIGHWAYS
WHEREAS, the General Assembly of the State of Colorado has enacted the
"Highway Access Statute" which statute has been codified into law in C R S
(1973) , 43-2-147, as amended, and
WHEREAS, pursuant to the aforesaid statute, the State Highway Commis-
sion has promulgated the "State Highway Access Code" , which code was
adopted on July 16, 1981, and
WHEREAS, there exists certain state highways within the municipal
boundaries of the City of Fort Collins which must be administered pursuant
to the provisions of the State Highway Access Statute and Code, and
WHEREAS, said statute provides that the City shall establish a reason-
able schedule of fees for access permits issued pursuant to the Access Code
and Statute, which fees shall not exceed the costs of administration of
access permits
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows
Section 1 That Section 95-50 (C) and (D) of the Code of the City of
Fort Collins be, and the same hereby are, repealed and reenacted to provide
as follows
"(C) The City Engineer may require, at his discretion, the
filing of any other information when in his opinion
such information is necessary to properly enforce the
provisions of this Article, or the State Highway
Access Code, if applicable
(D) No plans shall be approved nor a permit issued where
it appears that the proposed work, or any part there-
of, conflicts with the provisions of this Article or
any ordinance of the City of Fort Collins , or the
State Highway Access Code, if applicable, nor shall
issuance of a permit be construed as a waiver of the
zoning ordinance or other ordinance requirements
concerning the plan "
Section 2 That Section 95-51 of the Code of the City of Fort Collins
be, and the same hereby is, repealed and reenacted to provide as follows

1 95-51 Permit fees
The permit fee for each driveway approved by
the City Engineer shall be five dollars ( $5 ) for
a driveway up to fifteen (15) feet in width For each
additional foot of width in excess of fifteen (15)
feet, an additional charge of thirty cents ($0 30) per
foot shall be charged Notwithstanding the foregoing,
if any driveway is proposed to be constructed providing
vehicular access to or from a State Highway, the permit
fee for such driveway shall be twenty-five dollars
($25 ) regardless of width or use of said driveway "
Section 3 That Section 95-55 (A) of the Code of the City of Fort
Collins be, and the same hereby is, repealed and reenacted to provide as
follows
1 95-55 Standard plans and specifications, construc-
tion procedures
A All construction outlined in this Article shall
be located and constructed in accordance with
the City of Fort Collins ' Standard Plans and
Specifications which shall be drawn up by the City
Engineer, approved by the City Council and avail-
able and on file in the office of the City Engi-
neer, and, if applicable, in accordance with the
State Highway Access Code and shall be performed
to the satisfaction of the City Engineer or his
authorized representatives
