OF THE CITY OF FORT LOLLINS RELATING

BE IT ORbAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that
Section 1 That Section 16-'L0 of the Code of the City otFort Collins
be, and it hereby is, amended to read as follows
"Section 16-20
No property in the district snall be assessed for any
improvement in an anount exceeding one-half ( 1/2) of
sucri property' s actual value For the purpose of the
within provision, the value of any propert; shall be
conclusively presumed to be 3 1/3 times said property' s
valuation for assessment for cereral taxes for the year
precedino the assessirq ordinance as shown on the
records of tee County Assessor, Larimer County, Colo-
rado The foreooing limitation on dssessments shall not
apply in the case of and property when all of the owners
of such property expressly waive the limitation in
writing In tiie event a street is inprovea as an
arterial or collector street rather than as e resi-
dential street , the City Engineer shall compute the
extra expense causeo by such streets being improved as
arterial or collector streets and for traffic signaliza-
tion wren required because of collector or arterial
status , and for the extra base associated with the
construction of arterial streets Such cost shall be
paid by the City at larqe out of qeneral revenues or the
Street Oversizinq Fund as determined by the City Council
and shall not be assessed aciai net particular properties
in the distict No payment shall be made for any extra
basr- required for collector streets above the minimum
stanc,arcls for such streets The City at large shall

wroth qreater than thirty-six (36) feet The determina-
tiori made by the City Engineer and approved by the City
Council as to the cost to be apportioned by reason of
impiovinq a street as an arterial or collector rather
than as a residential street or improving a street to a
uidtn pore than thirty-six (36) feet shall be conclu-
sive "
Section 2 Passage of Ordinance That the immediate adoption of the
foiegoinC measure is necessary to preserve, protect, and advance the
general welfare and safety of the residents of the City of Fort Collins
Therefore, the City Council hereoy determines that an errergency does exist
requirina the impeuiate Fassaye of this Orainance, and this Ordinance is,
therefore, enacted pursuant to Section 6 of Article II of the Charter of
the c,ty of Fott Collirs as an N f-igency Ordinance and shall become effec-
tive upon its passage
